MOVED by Member DA Collings, seconded by Member JR Donald:  

That the Howick Local Board Swimming Pool Fencing Exemptions Committee:

a)         confirm the ordinary minutes of its meeting, held on Tuesday, 14 April 2015, as a true and correct record.

Special Exemption (Section 6) Fencing of Swimming Pools Act 1987

 

Resolution number HWSP/2015/8

MOVED by Member DA Collings, seconded by Member JR Donald:  

That the Howick Local Board Swimming Pool Fencing Exemptions Committee:

a)      receives the report.

b)      receives the applications by the owner/occupier of:

          i)       66 Fordyce Avenue, Pakuranga

          ii)      6 Isaac Place, Howick

          iii)     47 Finnerty Avenue, Howick

c)      determines each application, by way of resolution, either to:

          i)       grant the application for special exemption as sought, or

          ii)      grant the application subject to conditions, or

          iii)     decline the application for special exemption sought.

MOVED by Member DA Collings, seconded by Member G Boles:  

That the Howick Local Board Swimming Pool Fencing Exemptions Committee:

a)            receives the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by Wenhui Qiu, 66 Fordyce Avenue, Pakuranga, Auckland.

b)         notes Members Collings, Boles and Spiller were in attendance at a site visit which took place on Tuesday 28th July 2015 at the applicant’s residence at 66 Fordyce Avenue, Pakuranga with Auckland Council Officer, Vanessa Leddra, also in attendance.

c)         DECLINES the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 (FOSPA) by Wenhui Qiu, 66 Fordyce Avenue, Pakuranga as the granting of an exemption would significantly increase the danger to young children and the requirements of FOSPA could be met by moving the pool 1200mm from the rear wall of the house and raising the pool to 1200mm.

MOVED by Member DA Collings, seconded by Member JR Spiller:  

That the Howick Local Board Swimming Pool Fencing Exemptions Committee:

a)         receives the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by Stephen and Michelle Loo, 6 Isaac Place, East Tamaki Heights, Auckland.

b)         notes Members Collings, Boles and Spiller were in attendance at a site visit which took place on Tuesday 28th  July 2015 at the applicant’s residence at 6 Isaac Place, East Tamaki Heights, with Auckland Council Officer, Vanessa Leddra, also in attendance.

c)         DECLINES the application for a special exemption under Section 6 of the Fencing of Swimming Pool Act 1987 (FOSPA) by Stephen and Michelle Loo, 6 Isaac Place, East Tamaki Heights, Auckland as the granting of an exemption would significantly increase the danger to young children and the requirements of FOSPA could be met by permanently bolting the doors closed, or by installing self closing inward facing doors, or by installing a compliant pool fence isolating the immediate pool area, or by installing a compliant gate within the door frame that complies with FOSPA.

MOVED by Member DA Collings, seconded by Member JR Spiller:  

That the Howick Local Board Swimming Pool Fencing Exemptions Committee:

a)         receives the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by Daniel and Lindsay Moffitt, 47 Finnerty Avenue, Howick, Auckland.

b)         DECLINES the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 (FOSPA) by Daniel and Lindsay Moffitt, 47 Finnerty Avenue, Howick, Auckland as the granting of an exemption would significantly increase the danger to young children and the requirements of FOSPA could be met by raising the spa pool to 1200mm, or by installing a compliant fence around the immediate spa pool area.
