Approval of the Waitakere Ranges Local Board Community Lease Renewals 2013/2014

Purpose
1. This report seeks Waitakere Ranges Local Board approval for the Waitakere Ranges Local Board Community Lease Renewals 2013/2014 (lease renewals).
Executive Summary
2. At a local board meeting on 25 September 2013 the Community Lease Workplan for 2013/2014 was approved (Attachment A), resolution WTK2013/194.
3. The workplan prioritises community leases with a final expiry or renewal term expiry up to 30 June 2014 together with other lease projects. Prioritising the workplan allows visibility of the portfolio and gives staff clear direction on expectations and reporting.
4. As part of the workplan process the local board is also requested to consider and approve outstanding community lease renewals as per the schedule attached (Attachment B).
5. Titirangi Badminton Club Incorporated has a right of renewal for a term ‘to be agreed’. The club has requested a term of 33 years which the local board has indicated support. The Community Occupancy Guidelines July 2012 contemplates a 10 year term for groups that own their own building.
6. The renewal of lease for The Auckland Playcentres Association Incorporated, Oratia United Association Football Club Incorporated and Titirangi Badminton Club Incorporated allows Auckland Council to include new terms and conditions. The renewal of lease for Camp Fire Club Glen Eden is on the original terms and conditions.
That the Waitākere Ranges Local Board: a) Grants approval of the renewal of the leases specified in the Community Lease Renewals Schedule for i) Camp Fire Club Glen Eden Incorporated (renewal period12/10/2002-11/10/2012); ii) Camp Fire Club Glen Eden Incorporated (renewal period 12/10/2012-11/10/2022); iii) The Auckland Playcentres Association Incorporated for Laingholm Playcentre iv) Oratia United Association Football Club Incorporated v) Titirangi Badminton Club Incorporated b) Approves the following clauses to be included in the renewal of lease for The Auckland Playcentres Association Incorporated, Oratia United Association Football Club Incorporated and Titirangi Badminton Club Incorporated: i) Auckland Council has adopted a Smoke-Free Policy to apply on Council land, which Policy the Lessee is obliged to abide by during the Term. The Lessee will use its best endeavours to ensure its members, employees, invitees, contractors and agents abide by the Policy; c) Approves all other terms and conditions in accordance with the Auckland Council Community Occupancy Guidelines July 2012. |
Discussion

9. As part of the workplan process, the local board is requested to consider and grant approval of the outstanding community lease renewals detailed in the Community Lease Renewals schedule attached. Approval through this report process will allow the deeds of renewal to be prepared and executed. The renewal process includes confirmation of the Tenant’s performance during the course of the lease term that the Tenant is not in breach of any of their obligations under their lease, financial sustainability, legal status, compliance requirements, a review of the operation of the group and a site inspection to ensure the facility is being maintained to an appropriate standard.
10. It is recommended that the Waitakere Ranges Local Board grants approval of:
· The renewal of the leases specified in the Community Lease Renewals schedule
11. The renewal of lease for The Auckland Playcentres Association Incorporated, Oratia United Association Football Club Incorporated and Titirangi Badminton Club Incorporated allows Auckland Council to include new terms and conditions. The renewal of lease for Camp Fire Club Glen Eden is on the original terms and conditions.

12. The recommendations within this report fall within the local board’s allocated authority relating to local, recreation, sport and community facilities.
13. The workplan and prioritisation has been discussed with the local board portfolio holder.

14. Ensuring community facilities are well maintained and accessible for members of the community is of benefit to all, including Maori.
General
15. The recommendations within this report do not trigger the Auckland Council Significance Policy.
16. Council staff has sought input from relevant Council departments.
Implementation Issues
17. There are no cost implications for Auckland Council.
18. Additional work will be required to implement all resolutions resulting from the community lease local board work plans, staff estimate this will result in a six month turnaround. Council staff will work with organisations and groups to manage expectations and will, where required, issue a letter to groups outlining the local board’s resolution to assist with funding requirements.

Purpose
1. This report seeks Waitakere Ranges Local Board approval to grant a new community lease to The Scout Association of New Zealand for part Bishop Park, 209-211 Atkinson Road, Titirangi.
Executive Summary
2. The Scout Association of New Zealand (the Scouts) had a 50 year lease with legacy City of Auckland from 1 June 1961 expiring on 31 May 2011. The Scouts lease has been continuing on a month by month basis. The Scouts own the building.
3. According to the Auckland Council Community Occupancy Guidelines July 2012 groups that own their own building have the automatic right to re-apply at the end of their occupancy terms without public notification.
4. The Scouts wish to continue leasing part Bishop Park, 209-211 Atkinson Road, Titirangi being Part Allotment 46 Parish of Wikomiti and contained in NA778/154 (Part-Cancelled). The land is held by Auckland Council in fee simple and classified as a recreation reserve and forms part of the Waitakere Ranges Regional Park. The land is subject to the Reserves Act 1977. A Reserve Management Exchange Agreement dated 19 August 2003 between legacy Auckland Regional Council and Waitakere City Council records that the land and the Scouts lease be managed by Waitakere City Council. This agreement remains in place.
5. The activity of the Scouts is of a local purpose nature rather than recreation. A lease under Section 73(3) of the Reserves Act 1977 will be required. Prior to granting the lease, public advertising of Council’s intention will be required under Section 73(4) of the Reserves Act 1977 and iwi consultation will be required under Section 4 of the Conservation Act 1987. Council staff will consider reclassifying the footprint of the scout building from recreation reserve to local purpose (community buildings) reserve in accordance with the Reserves Act 1977.
6. This report recommends the granting of a new community lease to The Scout Association of New Zealand for ten years commencing 1 June 2011 with one ten-year right of renewal. This is the recommended term in the Auckland Council Community Occupancy Guidelines July 2012.
That the Waitākere Ranges Local Board: a) Approves granting a new lease under Section 73 (3) of the Reserves Act 1977 to The Scout Association of New Zealand for part of Bishop Park, 209-211 Atkinson Road, Titirangi being Part Allotment 46 Parish of Wikomiti and contained in NA778/154 (Part-Cancelled) (Attachment A) subject to the following terms and conditions: i) Term – 10 years commencing 1 June 2011 with one 10-year right of renewal; ii) Rent - $1.00 plus GST per annum if requested; iii) The public notification of the new lease and that it will meet the costs associated with the public notification, estimated at approximately $500.00; iv) Council staff will consider and initiate if required a process to reclassify of the footprint of the scout building from recreation reserve to local purpose (community buildings) reserve in accordance with the Reserves Act 1977; v) The Scout Association of New Zealand Community Outcomes Plan as approved be attached to the lease document (Attachment B); vi) Auckland Council has adopted a Smoke-Free Policy to apply on Council land, which Policy The Scout Association of New Zealand is obliged to abide by during the Term. The Scout Association of New Zealand will use its best endeavours to ensure its members, employees, invitees, contractors and agents abide by the Policy; b) Approves all other terms and conditions in accordance with the Auckland Council Community Occupancy Guidelines July 2012. |

10. The Scouts operate as a not for profit organisation and has been registered as an incorporated society since 25 July 1966.
11. The scouts aims and objectives are to:
· Encourage the physical, mental, emotional, social and spiritual development of young people so that they may take a constructive place in society
· The method of achieving the aim of the Association is by providing an enjoyable and attractive scheme of progressive training based on the Scout Law and Promise and guided by adult leadership
12. The Scout unit occupying Bishop Park, 209-211 Atkinson Road, Titirangi is the Titirangi Air Scout Group (Air Scouts). The Air Scouts have an open membership and there are currently 20 members under the age of 20 enrolled with 75% being male and 25% female.
13. The Air Scouts no longer base their programme solely around air activities. The other activities they participate in include camping, tramping, stream crashing, geocaching abseiling and pioneering. The Air Scouts won the Pioneering Trophy at the 2012 Founders Day.
14. Auckland Council staff have no current plans to plant within the area outlined in blue on the site plan (Attachment A).

Local Board Views
15. At a local board portfolio holder meeting held on 18 December 2013, informal support was given for a new lease to be granted to the club for a term of 10 years plus one 10-year right of renewal.
16. The recommendations within this report fall within the local board’s allocated authority relating to local, recreation, sport and community facilities.
Maori Impact Statement
17. Local iwi have been consulted. A submission was received from Te Kawerau a Maki advising that they do not oppose the terms of the lease.
18. Ensuring community facilities are well maintained and accessible for all members of the community, will be of benefit to all, including Maori. There are no changes in use or operational activities being conducted on the land.
General
19. The recommendations contained in this report do not trigger the Auckland Council Significance Policy.
20. Council staff have sought input from relevant council departments.

Purpose
1. This report seeks Waitakere Ranges Local Board approval to grant a Deed of Lease for Additional Space to The Auckland Playcentres Association Incorporated located on part of Laingholm Hall Reserve, 69 Victory Road, Laingholm.
Executive Summary
2. The Auckland Playcentres Association Incorporated (the playcentre) had a community lease with legacy Waitemata City Council for a term of 23 years commencing 1 December 1988 and expiring on 30 November 2011. The playcentre has one 10-year right of renewal which it is exercising. This will be considered by the Waitakere Ranges Local Board in the Community Lease Renewals report scheduled in February 2014.
3. An amendment to the original lease was granted to the playcentre on 1 November 2000 to include an additional area of Lot 40 for play equipment. A letter of amendment and site diagram was attached to the lease document (Attachment A). This form of amendment to the lease is not legally binding. A Deed of Lease for Additional Space will formalise this arrangement. The club own the building and play equipment.
4. Lot 40 is held by the Crown through Department of Conservation and vested in Auckland Council, in trust and classified as a local purpose (site for public hall) reserve and subject to the Reserves Act 1977.
5. This report recommends the granting of a Deed of Lease for Additional Space to The Auckland Playcentres Association Incorporated for a term of 10 years commencing 1 December 2011.

Discussion
6. The Auckland Playcentres Association Incorporated (the playcentre) had a community lease with legacy Waitemata City Council for a term of 23 years commencing 1 December 1988 and expiring on 30 November 2011. 8. The playcentre operates as a not for profit organisation and has been registered as an incorporated society since 8 December 1949.
9. The playcentres objectives are to:
· Provide a quality early educational play opportunity for young children (from birth to school age)
· To provide a parent education programme to ensure quality playcentre sessions and to foster quality family life
· To assists parents to co-operatively establish, organise, maintain, equip and supervise their local playcentre.
10. The playcentre has a total membership of 47 made up of 14 families and operates 4 days per week.

Local Board Views
11. The recommendations within this report fall within the local board’s allocated authority relating to local, recreation, sport and community facilities.
12. At a portfolio holder meeting held on 18 December 2013 informal support was given for a Deed of Additional Space to be granted to the playcentre for a term of 10 years commencing 1 December 2011.
Maori Impact Statement
13. There are no changes in use or operational activities being conducted on the land.
General
14. The recommendations contained in this report do not trigger the Auckland Council Significance Policy.
15. Council staff has sought input from relevant council departments.
16. Lot 40 is held by the Crown through Department of Conservation and vested in the Auckland Council, in trust and classified as a local purpose (site for public hall) reserve and subject to the Reserves Act 1977.

Purpose
1. This report seeks approval for the Waitakere Ranges Local Board member, Saffron Toms to attend the Dune Restoration annual conference in March 2014.
Executive Summary
2. The Dune Restoration annual conference runs from 11th to 13th March 2014 and focuses on bringing together people's knowledge, experiences, up-to-date research and visions for dune restoration. The conference is run in collaboration with the local Council, Department of Conservation and Coast Care community.
3. The format includes some lecture style talks, a 'regional round-up' where the floor is open for anyone to give a 10 minute presentation on their project, practical workshops (e.g. seed collection, pest control), fieldtrips and plenty of time for discussion.
4. Delegates each year include research scientists, staff from Councils and the Department of Conservation, local businesses, Coast Care group members, students and individuals from all around the country with a passion for our coastal environment.
5. The Waitakere Ranges Local Board has ongoing dune management issues at its west coast beaches. Attendance at the conference will broaden their knowledge and provide examples of dune restoration and assist the Local Board members with their future local decision making and sub regional advocacy.
That the Waitākere Ranges Local Board: a) Endorses member Saffron Toms to attend the Dune Restoration annual conference in March 2014. b) Approves the payment of registration fees of $280.00 from it’s local board professional development allocation. c) Agrees that accommodation and travel expenses for attending the Dune Restoration annual conference be provided for in line with Auckland Council's Elected Members' Expense Rules. d) Requests that following the conference Local Board member Saffron Toms provide a written report on the conference and lead a workshop discussion with Waitakere Ranges Local Board members to share learnings and insights. |

TOPIC: CITIZEN’S ADVICE BUREAUX UPDATE

The CAB Waitakere Board
· This Board is the governance body for the West Auckland cluster of Citizen’s Advice Bureaux.
· The Board has an Administration Office at Glen Eden.
· The Board is responsible for five Branches at the following locations:
· Massey
· Henderson
· Glen Eden
· New Lynn
· Avondale
CAB Glen Eden (Manager – Kim Faifua)
· CAB Glen Eden is the only Citizens Advice Branch in the Waitakere Ranges Local Board area. Operating hours: 9am - 4.30pm Monday to Friday. Located within the Library.
· Our service is professional and confidential and free. We have 4 methods of contact: - phone, walk in, fax and email via our Website.
· Our aim is to empower clients with advice and information and options.
· Our Website www.cab.org.nz offers the public the availability of conducting self-search; and most recently we have set up a Face Book page.
· As well as face to face and telephone advice and guidance, CAB Glen Eden offers the following free services -
· Daily morning JP services.
· Three Budget clinics.
· A CV clinic, by appointment.
· Personal Counselling, by appointment.
· Fortnightly free Legal Advice.
· A specialist Advocacy clinic, by appointment
In the last six months, 42% of all CAB Glen Eden clients accessed the above free services.
OTHER TRENDS OVER THE PAST SIX MONTHS
1. Housing is number 1 on CAB Glen Eden’s top 10 trends categories list. The wait lists for Housing NZ rentals in the Waitakere area show evidence of the shortage of low cost housing. These hover around 175 per month for those with priority A eligibility and about 400 per month for priority B eligibility. The area we serve is a high needs area for low cost rental accommodation. CAB Glen Eden alone had 72 requests from the community in the last 6 months either in need of rental properties or being evicted from or having leases terminated at short notice. We also answered 19 calls for emergency accommodation, 10 with residential housing issues/needs, enquiry for Maori housing along with 5 people with flatting needs, and a further 3 with boarding issues.
2. The second most common issue was separation and relationship breakdown, access/custody and guardianship.
3. Third in our top ten is budgeting and general financial difficulties. Of these Budgeting and debt management was the most requested and support to access Kiwi Saver funds due to genuine hardship resulting in most cases from loss of job or sickness with has led to loss of wages. Debt recovery and Bankruptcy are issues that the Branch and Budget Advisers deal with on an all too regular basis.
CAB Glen Eden also takes the highest requests for food parcels out of all the West Auckland Branches and has a very close working relationship with a number of local food banks.
THE FUTURE
CAB Glen Eden is under pressure to provide afternoon JP clinics along with extending the CV clinic hours and a second Counsellor and Advocacy services but are trapped by accommodation constraints. This is a Council political issue but the Branch and the CAB Waitakere Board would hope to have the Waitakere Ranges Local Board’s involvement and support in resolving these challenges.
