Purpose
1. To seek approval from the Otara-Papatoetoe Local Board to publicly notify its intention to issue five agreements to lease and a licence to occupy at Colin Dale Park, Prices Road, Wiri.
Executive Summary
2. After a number of approaches to Council and many workshops that identified Auckland did not meet the needs of motorsports and other similar sports regionally, Colin Dale Park was acquired by Council in 2003. It was considered an appropriate site to promote motorsports as a recreational activity and establish quality facilities to provide for a range of family entertainment, safe participation for young people and for commercial attractions.
3. The former Manukau City Council sought expressions of interest in 2009 through a publicly notified process and identified six potential users groups of Colin Dale Park.
4. These potential user groups are Counties Manukau Offroad Racing Club Incorporated, Kartsport Manukau Incorporated, Papakura City BMX Club Incorporated, Auckland Radio Car Control Club Incorporated, Main Jet Events Limited and Coggan and Williams Limited (Family Jet Sprints).
5. Counties Manukau Offroad Racing Club Incorporated (the club) has been a registered Incorporated Society since 27 May 2002. The club was formed in 1986 to foster and build interest in the sport of off-road racing and presently has 34 members with anticipated growth expected to be rapid when the club is able to relocate to Colin Dale Park.
6. Kartsport Manukau Incorporated (Kartsport) has been a registered Incorporated Society since 12 July 2012. Kartsport has a membership of over 200 families. Kartsport provides social and family activities and also offers national and international competition opportunities.
7. Papakura City BMX Club Incorporated (the BMX Club) has been a registered Incorporated Society since 15 August 1986 and has been registered under the Charities Act 2005 since 30 June 2008. The BMX Club has a current membership of 120 that range in age from young persons to mature club members.
8. Auckland Radio Car Control Club Incorporated (the car control club) has been a registered Incorporated Society since 19 March 1981. The car control club involves members racing miniature cars around different tracks. The car control club currently has 17 members. The car control club has projected a significant rise in membership as the relocation to Colin Dale Park occurs that will allow the group to develop capacity.
9. Main Jet Events Limited (MJE Motocross) is registered as a New Zealand limited liability company since 17 May 2007. Motocross is a form of motorcycle racing held on enclosed off-road circuits. Main Jet Events Limited is in the process of forming a Charitable Trust to support its operations.
10. Coggan and Williams Ltd (Family Jet Sprints) has been a registered as a New Zealand limited liability company since 25 March 1981. Family Jet Sprints involves ‘jet sprinting’ in small 1.6litre engine boats around a purpose built pond or ‘mini-lake’.
11. It is recommended that Counties Manukau Offroad Racing Club Incorporated, Kartsport Manukau Incorporated, Papakura City BMX Club Incorporated, Auckland Radio Car Control Club Incorporated and Main Jet Events Limited are issued an agreement to lease for a period of up to two years. Subject to the conditions of the agreement to lease being met, Council would then issue community leases to these five potential user groups.
12. It is recommended that Coggan and Williams Ltd be issued a concession agreement to facilitate limited commercial activity that will generate revenue to support the maintenance of Colin Dale Park and to support the operations of a club facility along with a licence to occupy.
13. Auckland Council staff recommend that the Otara-Papatoetoe Local Board agree to publicly notify its intent to issue five agreements to lease and a licence to occupy upon a portion of Colin Dale Park in accordance with the Reserves Act 1977 as shown within the proposed concept plan (Attachment A).
14. The public notification process attracts costs for advertising. The Otara-Papatoetoe Local Board is asked to consider payment of costs estimated at $1,600.
That the Ōtara-Papatoetoe Local Board: a) Approves progressing the Colin Dale Park project with the current potential users, identified through the expression of interest exercise. b) Approves the public notification of Auckland Councils’ intention to issue agreements to lease to Counties Manukau Off road Racing Club Incorporated, Kartsport Manukau Incorporated, Papakura City BMX Club Incorporated, Auckland Radio Car Control Club Incorporated, Main Jet Events Limited and a concession and licence to occupy to Coggan and Williams Limited upon the land indicated on the site plan at Colin Dale Park, Prices Road, Wiri in accordance the terms of the Community Occupancy Guidelines. c) Approves that a further report, including findings and recommendations resulting from the public notification exercise, be presented to the Otara-Papatoetoe Local Board at the earliest possible opportunity and before any further action is taken to advance the development of the Colin Dale Park. d) Approves the payment of costs associated with public notification exercise estimated at $1600. |
Discussion
15. Motorsports have unique environmental effects which need to be managed appropriately. Accordingly motor sport activities are restricted to specific locations where adverse effects can be minimised. Colin Dale Park was determined to be a location appropriate for motorsport activities for some of, but not limited to, the following reasons; close proximity to the Auckland International Airport which also generates unique environmental effects, the limited number of and distance from residential neighbours, minimal impact on traffic movement, the agricultural nature of surrounding land and the natural contour of the site.
16. Colin Dale Park is a 57.6 hectare reserve acquired by Council originally in 2003 to initially accommodate the Rally of New Zealand and more broadly to promote motorsports as a legitimate recreational activity and to establish quality facilities for a range of family entertainment, safe participation for young people and for commercial attractions.
17. It is acknowledged that there is also an agreement to lease and lease between the former Manukau City Council and Te Ara Rangatu O Te Iwi O Ngati Te Ata Waiohua Incorporated for 10.1ha on the western side of Colin Dale Park for a national marae.
18. Colin Dale Park is a legacy development project of the former Manukau City Council initiated in response to a number of approaches to Council that indicated that the needs of motor sports and other similar sports are not currently being met in the Auckland region.
19. A preliminary concept plan also highlighted potential uses for Colin Dale Park and underlined the need for both club based activities as well as limited commercial activities on a shared basis.
20. Council sought expressions of interest for the development of Colin Dale Park in 2009 and council determined from that the 6 potential user groups who best complemented the concept design and purpose of Colin Dale Park.
21. The user groups that were selected as a result of the expressions of interest process are Counties Manukau Offroad Racing Club Incorporated, Kartsport Mt. Wellington Incorporated, Papakura City BMX Club Incorporated, Auckland Radio Car Control Club Incorporated, Main Jet Events Limited and Coggan and Williams Limited.
22. Counties Manukau Offroad Racing Club Incorporated has been a registered Incorporated Society since 27 May 2002. The club was formed in 1986 to foster and build interest in the sport of offroad racing. The club provides for the whole family with its annual Counties Classic Series. Junior racing starts from the age of 7 years with their own series and trophies, through to the senior experienced racers who compete for the Counties Classic Cup and the Sir Barry Curtis Cup. The club is volunteer based and is a not for profit organisation. The club presently has 34 members and is affiliated to the National Off-Road Racing Association of New Zealand.
23. Kartsport Manukau Incorporated (Kartsport) has been a registered Incorporated Society since 12 July 2012.Kartsport Manukau Incorporated is the entity which is intended to encompass Kartsport Mt. Wellington Incorporated (registered 28 September 1976), Kart Sport Auckland Incorporated (registered 14 December 1959) and Formula S Kartsport Club Incorporated (registered 13 June 2005). The three clubs have restructured in preparation of occupying Colin Dale Park after Kartsport were advised they had been successful in the expressions of interest process. Karts are an inexpensive form of motor racing in a safe and controlled environment. Kartsport has a large membership with over 200 families registered and karts have a wide appeal as a social and family activity and also offer national and international competition opportunities. Kartsport is a part of the National body of KartSport New Zealand who has a signed agreement of mutual recognition of the organisation by the national body controlling four wheeled motorsport in New Zealand, MotorSport New Zealand (MSNZ). Through MSNZ affiliation to the Federation Internationale de L'Automobile (FIA), KartSport New Zealand are the delegated the authority for control of kartsport in New Zealand by the Commission Internationale de Karting (CIK).
24. Papakura City BMX Club Incorporated (the BMX Club) has been a registered Incorporated Society since 15 August 1986 and has been registered under the Charities Act 2005 since 30 June 2008. The BMX club is run by a volunteer committee and presently operates at Keri Downs Park, Dominion Road, Papakura. The BMX Club has a current membership of 120 that range in age from young persons to mature club members. The BMX Club is affiliated to the national body of BMX New Zealand. In 2013 The BMX Club had 51 members compete at the World Championships and six of its members were placed in the top 10 in the world in their respective divisions. The BMX Club has been given the opportunity to host the World Cycle Speedway Championships in 2017.
25. Auckland Radio Car Control Club Incorporated (the car control club) has been a registered Incorporated Society since 19 March 1981. The car control club offers recreational activity and involves members racing miniature cars around either an off-road dirt track or an on-road track. The car control club currently has 17 members that the club anticipates will rise significantly upon relocation. The car control club currently holds a temporary community lease located in Saville Drive, Mangere.
26. Main Jet Events Limited (MJE Motocross) has been a registered New Zealand limited liability company since 17 May 2007. Motocross is a form of motorcycle racing held on enclosed offroad circuits. MJE Motocross was established after approaches by the former Manukau City Council recommended to continue the work that Carl Sorenson of MJE Motocross was doing within the community with regards to road safety awareness and to form a body that would encourage Motocross enthusiasts to participate in the sport safely in Colin Dale Park rather than upon beaches and public parks.
27. Coggan and Williams Ltd (Family Jet Sprints) has been a registered New Zealand limited liability company since 25 March 1981. The club itself will be known as Family Jet Sprints and will be an Incorporated Society. Family Jet Sprints involves jet sprinting in small 1.6 litre engine boats around a purpose built pond or ‘mini-lake.’ Family Jet Sprints owns and operates family jet sprint boats where individuals, young people and families get the opportunity to participate in this watersport and to gain experience in crewing a boat. Family Jet Sprints offer the most affordable options for family participation.
28. All of the potential user groups are still eager to progress the Colin Dale Park development beyond the expression of interest stage. The potential user groups attend user group meetings regularly with Council staff and are still very much connected to the Colin Dale Park project. The potential user groups are still viewed by Council as appropriate, although it has been five years since the expression of interest process occurred.
29. Taking account of the potential user groups identified in 2009, a concept plan for Colin Dale Park was developed (Attachment A).
30. The next stage of this process is public notification of the leases and the licence. Council has a responsibility to publicly notify its intention to grant agreements to lease in respect ofs54(1)(b)(c) and (d) of the Reserves Act 1977.
31. A number of the identified users have secured external grants to develop their proposed facilities. The Auckland Plan envisages a co-ordinated approach to facility development with collaboration and partnerships between public and private sector; Directive 5.4 “actively collaborate and partner to maximise joint resources”, Directive 5.6 “grow the contribution the recreation and sport sector makes to Auckland’s prosperity” are referred. Some of these grants are now at risk of recall due to the delays experienced. Public notification will support the retention of grant monies received.
32. The Auckland Council draft Annual Plan 2014/2015 identifies the key priority; “Begin construction of Colin Dale Park in Papatoetoe which will be Auckland’s first dedicated motor sports park” (page 94).
33. It is recommended that approval to publicly notify the intention to issue agreements to lease for the land indicated on the concept master plan at Colin Dale MotorSports Park, Prices Road, Wiri for Counties Manukau Offroad Racing Club Incorporated, Kartsport Manukau Incorporated, Papakura City BMX Club Incorporated, Auckland Radio Car Control Club Incorporated, Main Jet Events Limited and a concession and licence to occupy to Coggan and Williams Limited be given.
34. The public notification period of one month is required to give iwi and the general public the opportunity to provide comments and submissions. Council anticipates that the public notification process will commence late April/Early May 2014. Council will determine how to proceed after this notification period has ended and will report to the Otara-Papatoetoe Local Board at this point. It will be up to the Otara-Papatoetoe Local Board to determine whether it issues agreements to lease or a licence to all, some or none of the potential users of Colin Dale Park.
35. The public notification process attracts costs for advertising that Council has no operational budget for. The Otara-Papatoetoe Local Board is asked to consider the costs of public notification. In this instance it is recommended that public notification is given both through the Manukau Courier and via the New Zealand Herald to ensure full coverage and an open and transparent process. The Otara-Papatoetoe Local Board is asked to consider payment of costs estimated at $1600. Council has not approached the user groups in respect of a contribution towards payment of these costs.
Consideration
Local Board Views and Implications
36. The recommendations within this report fall within the Otara-Papatoetoe Local Board’s allocated authority relating to the local, recreation, sports and community facilities.
37. A workshop was held with the Otara-Papatoetoe Local Board during the week starting 10 December 2013 on Colin Dale Park to discuss and ensure adequate iwi consultation is undertaken.
38. An additional hui was held with members of the Otara-Papatoetoe Local Board, Council staff, Ngati Te Ata-Waiohua and Te Roopu Waiora on 21 February 2014 to collectively commence discussions on the context of the proposed national marae concept on the western side of Colin Dale Park and the high level planning context, including motorsport intentions.
39. A workshop was held with the Otara-Papatoetoe Local Board on 14 March 2014 to discuss the motorsport lease report and to enable further information to be considered regarding the potential user groups and to clarify the steps that Council is taking to advance the development of this site.
Maori Impact Statement
40. There are ten mana whenua-iwi groups identified by Council with interests in the Otara-Papatoetoe Local Board Area. These tribal groupings are Ngati Maru; Ngai Tai Ki Tamaki Tribal Trust; Ngati Te Ata – Waiohua; Te Aakitai Waiohua; Ngati Paoa; Te Kawerau a Maki; Ngati Whanaunga; Ngati Tamatera; Waikato-Tainui and Ngati Tamaoho.
41. Part of the reserve was offered through a legacy council arrangement as a site for the Ngati Te Ata-Waiohua Marae to support a long held aspiration of Ngati Te Ata-Waiohua for the development of their Marae in Manukau. Further consideration was given to the Marae site allocation to Ngati Te Ata-Waiohua as part of the Auckland Council District Plan change to zone Colin Dale Park for motorsport.
42. Plan change 19 was effected in November 2008 and operative zoning under Auckland Council District Plan (Manukau Section) and now provides a special Public Open Space 3 (Sport) zone for a wide range of motorsport activities, approximately 11 hectares of Public Open Space 4 (community) zone beside the coast for a marae, and Public Open Space 5 (Esplanade) zone on the coastal and riparian margins at 20 metres in width.
43. The Policy and Activities Committee on behalf of the former Manukau City Council made three resolutions on 4 June 2009 that were carried in respect of the site allocation at Colin Dale Park for a Ngati Te Ata-Waiohua Marae. These resolutions were;
i) that Council supports the formal allocation of the site at Colin Dale Park for a Marae for Ngati Te Ata and for lease negotiations to commence; and
ii) that site allocation of all of the Public Open Space 4 land at Colin Dale Park be granted to Ngati Te Ata for the purposes of a Marae; and
iii) that a long term lease of the land be entered into with NgatiTe Ata, subject to Council process.
44. It is acknowledged that there is an agreement to lease and lease between the former Manukau City Council and Te Ara Rangatu O Te Iwi O Ngati Te Ata Waiohua Incorporated for 10.1ha on the western side of Colin Dale Park for a proposed national marae.
45. The concept plan has been amended since the initial proposals that have also given rise to the opposition from Ngati Te Ata-Waiohua in respect of the potential motorsport user groups of Colin Dale Park as listed above.
46. Consultation is underway with Ngati Te Ata-Waiohua and the nine other mana whenua groups in regards to its intention to publicly notify the agreements to lease for motor sports.
47. Council acknowledges its responsibility and obligation to Ngati Te Ata-Waiohua as the only user group with a formal agreement with Council upon Colin Dale Park.
Implementation Issues
48. Council has no operational budget for the undertaking of the public notification process. It is a requirement that public notification take place in order to satisfy the requirements of the Reserves Act 1977 and The Conservation Act 1987 and its amendments.
49. The Otara-Papatoetoe Local Board is asked to consider costs of $1600 for the public notification process to commence as in this case it is recommended that notice is given in both the Manukau Courier and the New Zealand Herald to ensure wide coverage is met.
