Resolution number AEH/2014/11 MOVED by Member GD Easte, seconded by Member MJ Watson: That the Albert-Eden Local Board Swimming Pool Fencing Exemptions Committee: a) receives the Swimming Pool Fencing Exemption – Special Exemption (Section 6) Fencing of Swimming Pools Act 1987 report. b) receives the applications by: i) Paul Rouse – 7 Verona Ave, Mt Albert ii) Chris & Katie Noble – 7a Fairlands Road, Waterview iii) Grant & Sheridan Alexander – 17a Stilwell Road, Mt Albert iv) Lisa & Michael Barker – 23 La Veta Ave, Mt Albert v) Nigel Pengelly – 55 Fourth Ave, Kingsland vi) Yvonne Hack – 88 Richardson Road, Mt Albert c) determines each application, by way of resolution, to: i) grant the application for special exemption as sought, or ii) grant the application subject to conditions, or iii) declining the application for special exemption sought. |

Resolution number AEH/2014/12 MOVED by Chairperson RAJ Langton, seconded by Member MJ Watson: That the Albert-Eden Local Board Swimming Pool Fencing Exemptions Committee: a) receives the application from Paul Rouse, 7 Verona Avenue, Mt Albert. b) deems that this application for special exemption under section 6 of the Fencing of Swimming Pools Act 1987 be GRANTED to the following: i. the spa pool meeting the conditions A to K of NZS-8500: 2006 3.10 ii. the safety sticker supplied by Auckland Council officers being placed visibly on top of the spa pool cover. c) deems that this exemption is personal to the applicant (Paul Rouse), so that on a sale of the property a new owner will need to apply for a new exemption. d) notes that with regard to the particular characteristics of the property and the pool, the granting of an exemption does not significantly increase the danger to young children. e) notes that this exemption is subject to the spa pool being locked at all times when not in use. f) notes that the members of the Albert-Eden Local Board Swimming Pool Fencing Exemptions Committee completed a site visit at this property on Wednesday, 18 June 2014. |

Resolution number AEH/2014/14 MOVED by Chairperson RAJ Langton, seconded by Member GD Easte: That the Albert-Eden Local Board Swimming Pool Fencing Exemptions Committee: a) receives the application from Grant & Sheridan Alexander, 17a Stilwell Road, Mt Albert. b) deems that this application for special exemption under section 6 of the Fencing of Swimming Pools Act 1987 be GRANTED conditional to the following: i. that each of the outward swinging doors are fitted with a self- latching mechanism and locking device to ensure they are secured when not in use ii. a self-latching mechanism and a locking device must be installed on each outward swinging door and be positioned over 1.5 metres above the ground iii. the safety sticker supplied by Auckland Council officers being placed visibly on one of the doors iv. the pool meeting the conditions of standards NZS-8500: 2006. c) deems that this exemption is personal to the applicants (Grant & Sheridan Alexander), so that on a sale of the property a new owner will need to apply for a new exemption. d) notes that this exemption requires the applicant to maintain the door-latching and locking mechanisms as per these conditions at all times. e) notes that with regard to the particular characteristics of the property and the pool, the granting of an exemption does not significantly increase the danger to young children. f) notes that the members of the Albert-Eden Local Board Swimming Pool Fencing Exemptions Committee completed a site visit at this property on Wednesday, 18 June 2014. |

Resolution number AEH/2014/16 MOVED by Chairperson RAJ Langton, seconded by Member GD Easte: That the Albert-Eden Local Board Swimming Pool Fencing Exemptions Committee: a) receives the application from Nigel Pengelly, 55 Fourth Avenue, Kingsland. b) deems that this application for special exemption under section 6 of the Fencing of Swimming Pools Act 1987 be GRANTED conditional to the following: i. the spa pool being moved to ensure it is at least 1.0 metre distance away from the side steps closest to the house and 1.2 metres from the adjacent side steps ii. the spa pool meeting the conditions A to K of NZS-8500: 2006 3.10 ii. the safety sticker supplied by Auckland Council officers being placed visibly on top of the spa pool cover. c) deems that this exemption is personal to the applicant (Nigel Pengelly), so that on a sale of the property a new owner will need to apply for a new exemption. d) notes that with regard to the particular characteristics of the property and the pool, the granting of an exemption does not significantly increase the danger to young children. e) notes that this exemption is subject to the spa pool being locked at all times when not in use. f) notes that the members of the Albert-Eden Local Board Swimming Pool Fencing Exemptions Committee completed a site visit at this property on Wednesday, 18 June 2014. |
