	Resolution number ORSP/2014/24 MOVED by Member CH Cooke, seconded by Member TG Churton: That the Orakei Local Board Swimming Pool Fencing Exemption Committee receives the Swimming Pool Fencing Exemption – Special Exemption (Section 6) Fencing of Swimming Pools Act 1987 report. CARRIED Each application was discussed and received separately.

1/159 Kohimarama Road, Kohimarama

Resolution number ORSP/2014/25 MOVED by Member CRJ Davis, seconded by Member CH Cooke: a) That the Orākei Local Board Swimming Pool Fencing Exemptions Committee receives the application from Malden Holdings Ltd, 1/159 Kohimarama Road, Kohimarama. b)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee deems that this application for special exemption under section 6 of the Fencing of Swimming Pools Act 1987 be GRANTED to the property subject to a new door being installed which is self-closing and self-latching at all times opening inwards towards the pool as an alternative solution under NZS8500:2006 (3.10). c)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee notes that with regard to the particular characteristics of the property and the pool, the granting of an exemption with the condition does not significantly increase the danger to young children. Resolution number ORSP/2014/26 MOVED by Member CRJ Davis, seconded by Member TG Churton: a) That the Orākei Local Board Swimming Pool Fencing Exemptions Committee receives the application from Tony and Lynda Rae, 6 Waimare Street, St Heliers. b)         That as the Orākei Local Board Swimming Pool Committee was unable             to gain access to the property to view the pool, consideration of the             application for special exemption be DEFERRED, and in the interim the             spa pool is to remain empty. CARRIED

	Resolution number ORSP/2014/27 MOVED by Member CRJ Davis, seconded by Member CC Parkinson: a) That as the Orākei Local Board Swimming Pool Fencing Exemptions Committee receives the application from Alistair and Robyn Matthewson, 9A Waiata Avenue, Remuera. b)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee deems that this application for special exemption under section 6 of the Fencing of Swimming Pools Act 1987 be GRANTED to the property on condition that the current lock on the bi-fold door is maintained and the door is to remain shut unless opened under adult supervision and the Council supplied warning sticker is to be placed on the door. c)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee notes that with regard to the particular characteristics of the property and the pool, the granting of an exemption with the conditions does not significantly increase the danger to young children. Resolution number ORSP/2014/28 MOVED by Member CRJ Davis, seconded by Member TG Churton: a) That the Orākei Local Board Swimming Pool Fencing Exemptions Committee receives the application from Aaron and Kate Young, 10 Melanesia Road, Kohimarama. b)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee deems that this application for special exemption under section 6 of the Fencing of Swimming Pools Act 1987 be GRANTED to the owner of the property (Aaron and Kate Young), so that on a sale of the property a new owner will need to apply for a new exemption. c)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee notes that with regard to the particular characteristics of the property and the pool, the granting of an exemption does not significantly increase the danger to young children. d)         That the Orākei Local Board Swimming Pool Fencing Exemptions             Committee notes that this exemption is subject to ongoing compliance             with clauses (a)-(k) of NZS8500-2006 (3.10). Resolution number ORSP/2014/29 MOVED by Member CRJ Davis, seconded by Member CC Parkinson: a) That the Orākei Local Board Swimming Pool Fencing Exemptions Committee receives the application from Nigel Loy, 31 Seaview Road, Remuera. b)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee deems that this application for special exemption under section 6 of the Fencing of Swimming Pools Act 1987 be GRANTED to the owner of the property (Nigel Loy), so that on a sale of the property a new owner will need to apply for a new exemption. c)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee notes that with regard to the particular characteristics of the property and the pool, the granting of an exemption does not significantly increase the danger to young children. d)         That the Orākei Local Board Swimming Pool Fencing Exemptions             Committee notes that this exemption is subject to ongoing compliance             with clauses (a)-(k) of NZS8500-2006 (3.10). Resolution number ORSP/2014/30 MOVED by Member CRJ Davis, seconded by Member TG Churton: a) That the Orākei Local Board Swimming Pool Fencing Exemptions Committee receives the application from Terry Klink, 33 Stirling Street, Remuera. b)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee deems that this application for special exemption under section 6 of the Fencing of Swimming Pools Act 1987 be DECLINED on the basis that the current door alarm does not meet the requirements of UL2017. c) That a re-application can be made without a filing fee if an alarm is installed in relation to the bi-fold doors on the north western end of the downstairs part of the building. Resolution number ORSP/2014/31 MOVED by Member CRJ Davis, seconded by Member CH Cooke: a) That the Orākei Local Board Swimming Pool Fencing Exemptions Committee receives the application from Symon Nausbaum, 103 Lucerne Road, Remuera. b)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee deems that this application for special exemption under section 6 of the Fencing of Swimming Pools Act 1987 be GRANTED to the owner of the property (Symon Nausbaum), so that on a sale of the property a new owner will need to apply for a new exemption. c)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee notes that with regard to the particular characteristics of the property and the pool, the granting of an exemption does not significantly increase the danger to young children. d)         That the Orākei Local Board Swimming Pool Fencing Exemptions             Committee notes that this exemption is subject to compliance with             clauses (a)-(k) of NZS8500-2006 (3.10). Resolution number ORSP/2014/32 MOVED by Member CRJ Davis, seconded by Member CC Parkinson: a) That the Orākei Local Board Swimming Pool Fencing Exemptions Committee receives the application from Libby Ellis, 128 Meadowbank Road, Meadowbank. b)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee deems that this application for special exemption under section 6 of the Fencing of Swimming Pools Act 1987 be DECLINED as it does not meet the requirements of clauses (a)-(k) of NZS8500-2006 (3.10). CARRIED Members of the Orakei Local Board Swimming Pool Fencing Exemptions Committee completed a site visit at this property on Friday, 13 June 2014.

Resolution number ORSP/2014/33 MOVED by Member CRJ Davis, seconded by Member CC Parkinson: a) That the Orākei Local Board Swimming Pool Fencing Exemptions Committee receives the application from Melanie Eady, 185 Portland Road, Remuera. b)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee deems that this application for special exemption under section 6 of the Fencing of Swimming Pools Act 1987 be GRANTED to the owner of the property (Melanie Eady), so that on a sale of the property a new owner will need to apply for a new exemption. c)         That the Orākei Local Board Swimming Pool Fencing Exemptions Committee notes that with regard to the particular characteristics of the property and the pool, the granting of an exemption does not significantly increase the danger to young children. d)         That the Orākei Local Board Swimming Pool Fencing Exemptions             Committee notes that this exemption is subject to ongoing compliance             with clauses (a)-(k) of NZS8500-2006 (3.10).
