4 Confirmation of Minutes

Resolution number HWSP/2014/5 MOVED by Member DA Collings, seconded by Member JR Spiller: That the Howick Local Board Swimming Pool Fencing Exemptions Committee: a) confirm the ordinary minutes of its meeting, held on Tuesday, 25 March 2014, as a true and correct record with the following amendments: “7.c) That the Howick Local Board Swimming Pool Fencing Exemptions Committee DECLINES the application by John & Grace Ng – 17 Andrea Place, Sunnyhills, Auckland for special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 as the granting of an exemption would significantly increase the danger to young children and the requirements of the Fencing Of Swimming Pools Act 1987 could be met by the completion of the proposed fence and the installation of a self-locking gate. 8.c) That the Howick Local Board Swimming Pool Fencing Exemptions Committee DECLINES the application by Brenda White – 67 Santa Anna Drive, Dannemora, Auckland for special exemption under Section 6 of the Fencing of Swimming Pools Act 1987, as the granting of an exemption would significantly increase the danger to young children and the requirements of the Fencing Of Swimming Pools Act 1987 could be met by the installation of a fence with two self-locking gates. 9.c) That the Howick Local Board Swimming Pool Committee DECLINES the application by Joshua and Andrea Mainwaring, 372 Redoubt Road, Totara Park, Auckland for special exemption under Section 6 of the Fencing of Swimming Pools Act 1987, as the granting of an exemption would significantly increase the danger to young children and the current situation does not meet the requirements of the Fencing Of Swimming Pools Act 1987. |

Resolution number HWSP/2014/6 MOVED by Member DA Collings, seconded by Member G Boles: That the Howick Local Board Swimming Pool Fencing Exemptions Committee: a) receives the report. b) declines to receive the resubmitted applications by: i) John & Grace Ng – 17Andrea Place, Sunnyhills ii) Brenda White – 67 Santa Ana Drive, Dannemora as these applications were received, heard and a decision made at the hearing on 25th March 2014. c) receives the applications by: i) Halcyon Days & Pigeon Mountain Trust – 37 Seymour Road, Mellons Bay ii) Richard & Louise Griffiths – 52 Mission Heights Drive, Flat Bush iii) Mark Morgan – 130 Mellons Bay Road, Mellons Bay d) determines each application, by way of resolution, to: i) grant the application for special exemption as sought, or ii) grant the application subject to conditions, or iii) decline the application for special exemption sought

Resolution number HWSP/2014/7 MOVED by Member G Boles, seconded by Member DA Collings: a) That the Howick Local Board Swimming Pool Fencing Exemptions Committee receives the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by Halcyon Days & Pigeon Mountain Trust – 37 Seymour Road, Mellons Bay. b) That the Howick Local Board Swimming Pool Fencing Exemptions Committee notes members were in attendance at a site visit which took place on Tuesday 29th July 2014 at the applicant’s residence with Auckland Council Officer, Vanessa Leddra, also in attendance. c) That the Howick Local Board Swimming Pool Fencing Exemptions Committee DECLINES the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by Halcyon Days & Pigeon Mountain Trust – 37 Seymour Road, Mellons Bay, as the granting of an exemption would significantly increase the danger to young children and the requirements of the Fencing of Swimming Pools Act 1987 could be met by the installation of a fence, installation of automatic closing mechanism on the bifold doors, or the installation of hinged doors with self closing mechanisms or any other compliant means. |

Resolution number HWSP/2014/8 MOVED by Member DA Collings, seconded by Member JR Donald: a) That the Howick Local Board Swimming Pool Fencing Exemptions Committee receives the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by Richard and Louise Griffiths – 52 Mission Heights Drive, Flat Bush. b) That the Howick Local Board Swimming Pool Fencing Exemptions Committee DECLINES the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by Richard and Louise Griffiths – 52 Mission Heights Drive, Flat Bush, due to lack of a site plan and adequate information being provided in order for the Howick Local Board Swimming Pool Fencing Exemptions Committee to make an informed decision. Any subsequent application by the applicants will be at no additional cost within 3 months from the date of this decision. |

Resolution number HWSP/2014/9 MOVED by Member G Boles, seconded by Member JR Donald: a) That the Howick Local Board Swimming Pool Fencing Exemptions Committee receives the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by Mark Morgan – 130 Mellons Bay Road, Mellons Bay. b) That the Howick Local Board Swimming Pool Fencing Exemptions Committee notes members were in attendance at a site visit which took place on Tuesday 29th July 2014 at the applicant’s residence with Auckland Council Officer, Vanessa Leddra, also in attendance. c) That the Howick Local Board Swimming Pool Fencing Exemptions Committee DECLINES the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by Mark Morgan – 130 Mellons Bay Road, Mellons Bay, as the granting of an exemption would significantly increase the danger to young children due to the close proximity of the spa pool to surrounding walls and boundary hedge. |
