MOVED by Member DA Collings, seconded by Member G Boles:  

That the Howick Local Board Swimming Pool Fencing Exemptions Committee:

a)         confirm the ordinary minutes of its meeting, held on Tuesday, 29 July 2014, as a true and correct record.

Swimming Pool Fencing Exemption – Special Exemption (Section 6) Fencing of Swimming Pools Act 1987

 

Resolution number HWSP/2014/11

MOVED by Member DA Collings, seconded by Member JR Donald:  

That the Howick Local Board Swimming Pool Fencing Exemptions Committee:

a)      That the report be received.

b)      That the Local Board receive the applications by:

i)       PD & AM Goodwin – 269B Bleakhouse Road, Howick

ii)      Warren & Margaret Long – 509 Whitford Road, RD, Howick

iii)     MS & SA Downs – 5 Dell Way, Bucklands Beach

iv)     Murray Kee- 20A The Parade, Bucklands Beach

c)      That the Local Board determine each application, by way of resolution, to:

i)       grant the application for special exemption as sought, or

ii)      grant the application subject to conditions, or

iii)     decline the application for special exemption sought

MOVED by Member JR Donald, seconded by Member DA Collings:  

a)            That the Howick Local Board Swimming Pool Fencing Exemptions Committee receives the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by PD & AM Goodwin, 269B Bleakhouse Road, Howick

b)         That the Howick Local Board Swimming Pool Fencing Exemptions Committee notes members were in attendance at a site which took place on Tuesday 25th November 2014 at the applicant’s residence visit at 269B Bleakhouse Road, Howick with Auckland Council Officer, Vanessa Leddra, also in attendance.

c)         That the Howick Local Board Swimming Pool Fencing Exemptions Committee DECLINES the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by PD & AM Goodwin, 269B Bleakhouse Road, Howick, as the granting of an exemption would significantly increase the danger to young children and the requirements of the Fencing of Swimming Pools Act 1987 could be met by increasing the height of the pool fence to 1.2 metres including any gates .

That the Howick Local Board Swimming Pool Fencing Exemptions Committee refers this application back to Council Officers as it should be heard by the Franklin Local Board.

a)         That the Howick Local Board Swimming Pool Fencing Exemptions Committee receives the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by MS & SA Downs, 5 Dell Way, Bucklands Beach.

b)         That the Howick Local Board Swimming Pool Fencing Exemptions Committee notes members were in attendance at a site which took place on Tuesday 25th November 2014 at the applicant’s residence visit at 5 Dell Way, Bucklands  Beach with Auckland Council Officer, Vanessa Leddra, also in attendance.

c)         That the Howick Local Board Swimming Pool Fencing Exemptions Committee DECLINES the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by MS & SA Downs, 5 Dell Way, Bucklands Beach, as the granting of an exemption would significantly increase the danger to young children and the requirements of the Fencing of Swimming Pools Act 1987 could be met by increasing the height of the spa pool from the deck to 1.2 metres.

a)         That the Howick Local Board Swimming Pool Fencing Exemptions Committee receives the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by Murray Kee, 20A The Parade, Bucklands Beach.

b)         That the Howick Local Board Swimming Pool Fencing Exemptions Committee notes members were in attendance at a site which took place on Tuesday 25th November 2014 at the applicant’s residence visit at 20A The Parade, Bucklands Beach with Auckland Council Officer, Vanessa Leddra, also in attendance.

c)         That the Howick Local Board Swimming Pool Fencing Exemptions Committee DECLINES the application for a special exemption under Section 6 of the Fencing of Swimming Pools Act 1987 by Murray Kee, 20A The Parade, Bucklands Beach, as the granting of an exemption would significantly increase the danger to young children and the requirements of the Fencing of Swimming Pools Act 1987 could be met by increasing the height of the spa pool from the ground to 1.2 metres.
