Review of dog access rules

 

Resolution number WHK/2015/90

MOVED by Chairperson PA Walden, seconded by Deputy Chairperson BM Treadwell:  

That the Waiheke Local Board:

a)      Adopts the following options in relation to the dog access rules reviewed:

apply region-wide prohibition of dogs on sports fields and use temporary change to dog access provisions to allow continued use by dog obedience club.

Anzac Reserve

replace current off-leash rule with an on-leash rule (and a temporary ban every Saturday during market day).

Clarification of confusing and ambiguous dog access rules - dog exercise areas

reclassify the three dog exercise areas as under control off-leash areas.

Clarification of confusing and ambiguous dog access rules – safe swimming areas, picnic and fitness apparatus areas

revoke the general picnic area, fitness apparatus and swimming area rules.

Clarification of confusing and ambiguous dog access rules – significant ecological areas

extend the on leash rule for Blackpool beach from headland to headland.

 

b)      Notes the Statement of Proposal consultation is based mainly on time and          season rules on beaches, however the board wishes to focus on wildlife          concerns and any feedback officers are able to obtain either from public          consultation or research may be taken into consideration when finalising          dog access rules.

c)      Requests the Environmental Services team carry out further research and report back on Sites of ecological significance, blue penguin and all other rare and endangered bird distribution including dotterel, banded rail, godwit distribution on Waiheke to inform dog access rule decision-making.

d)        Requests the Environmental Services team carry out investigations and report back on public open space where protected wildlife may be present which may be vulnerable to dogs, in particular the Te Ara Hura (Round Waikeke Walkway) route.

e)      Subject to any amendments to reflect the local board decision in (a):

i)       adopts the statement of proposal titled ‘Statement of Proposal Amendments to Auckland Council Policy on Dogs 2012 – Waiheke Local Board Area May 2015’ in Attachment A for public consultation using the special consultative procedure.

ii)      Confirms that the proposed amendments contained in the Statement of Proposal:

·      are consistent with the policy, principles and criteria for making dog access rules contained in the Auckland Council Policy on Dogs 2012

·      are not inconsistent with any decision in relation to region-wide dog access rules contained in the Auckland Council Policy on Dogs 2012

·      are in accordance with relevant legislative requirements in particular the Local Government Act 2002 and Dog Control Act 1996.

iii)     Authorises the Manager Social Policy and Bylaws to make any minor edits or amendments to the Statement of Proposal to correct any identified errors or typographical edits.

iv)     Authorises the Manager Social Policy and Bylaws, in consultation with the local board chair, to make any amendments to the Statement of Proposal to reflect decisions made by the local board.

v)      Appoints Member B M Treadwell (as chair), Chair Person P A Walden and Member S D Brown as a panel to receive, hear and deliberate on submissions and other relevant information and recommend changes to the Board.

vi)     Delegates to the Chairperson the ability to make changes to the panel appointed under v) where this becomes necessary because of the withdrawal or unavailability of any of those persons.

f)       Delegates to the Chair and Member S D Brown the authority to approve any final changes to the options to be included in the statement of proposal particularly          in relation to areas of wildlife in response to input from the biodiversity team.

Waiheke Local Board Performance Report for 9 months ending 31 March 2015

That the Waiheke Local Board:

a)      Receives the Performance Report for the Waiheke Local Board for the period           ended 31 March 2015.

b)      Notes the following 2014/2015 Local Board events budgets totalling $18,500 opex is surplus to requirements:

·  Christmas event - $4,000 remaining;

·  Discretionary events - $12,000 remaining;

·  Local civic events - $2,500 remaining;

c)      Reallocates the above $18,500 to the 2014/2015 SLIPs discretionary opex           budget for consideration for reallocation to projects listed below as per the           boards 23 April 2015 resolution WHK/2015/80 (13e):

·  Putiki Bay Action Plan – Contribution to boat removal costs

·  Onetangi Sports Park Reserve Management Plan

·  Esplanade Survey

·  Marine Survey top up

·  Waiheke Recreation Trust – grant to progress operational works

Urgent Decision Report - Submission to the Select Committee regarding the proposed Marine reserve on Waiheke Island

That the Waiheke Local Board:

a)      Notes the decision made under the Urgent Decision Process on 17 April 2015 to approve the Local Board’s submission on Petition 2011/100 to the Local Government and Environment Select Committee relating to the establishment of marine reserves along parts of the northern coast of Waiheke Island.
