That the Maungakiekie-Tāmaki Local Board Alcohol Ban Hearing Panel:

a)      receives the report and associated submissions to the Maungakiekie-Tāmaki Local Board’s review of alcohol bans

b)     recommends to the Maungakiekie-Tāmaki Local Board that it:

               i.        Allows the existing alcohol ban at the Panmure Train Station to lapse as insufficient evidence has been received to enable the board to retain this ban

              ii.        Retains the ban at 37a Fenchurch Street (including associated car park) as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

            iii.        Retains the ban at Alcock Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

            iv.        Allows the existing alcohol ban at Allenby Reserve (including associated car park) to lapse as insufficient evidence has been received to enable the board to retain this ban

              v.        Allows the existing alcohol ban at Almond Reserve (including associated car park) to lapse as insufficient evidence has been received to enable the board to retain this ban

            vi.        Allows the existing alcohol ban at Anns Creek Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

 

           vii.        Retains the ban at Apirana Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

          viii.        Allows the existing alcohol ban at Bassant Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

            ix.        Retains the ban at Bertrand Reserve and extend it to cover the car park at Allright Place as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

              x.        Retain the ban at Bill McKinlay Park (including associated car park) as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

            xi.        Allows the existing alcohol ban at Boundary Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

           xii.        Allows the existing alcohol ban at Bowden Foreshore Reserve 1 to lapse as insufficient evidence has been received to enable the board to retain this ban

          xiii.        Retains the ban at Buchanan Park as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

          xiv.        Allows the existing alcohol ban at Bycroft Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

           xv.        Retains the ban at Captain Springs Reserve (including associated car park) as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

          xvi.        Allows the existing alcohol ban at Cebalo Recreation Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

        xvii.        Retains the ban at Church Street Corner Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

 

       xviii.        Retains the ban at Church Street Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

          xix.        Allows the existing alcohol ban at Commissariat Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

           xx.        Allows the existing alcohol ban at Commissariat Road Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

          xxi.        Retains the ban at Court Crescent Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

        xxii.        Allows the existing alcohol ban at Domain Reserve (including associated car park) to lapse as insufficient evidence has been received to enable the board to retain this ban

       xxiii.        Retains the ban at Dunkirk Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

       xxiv.        Retains the ban at Eastview Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

        xxv.        Retains the ban over those parts of the Ellerslie SH1 footbridge which exist in the Maungakiekie-Tāmaki Local Board area and extend this to incorporate the new section of the Ellerslie Rail Station which extends onto Kalmia Street as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and request that officers provide further advice as to the hours of the ban for those sections of the Ellerslie SH1 footbridge that exist in the Orakei Local Board area.

       xxvi.        Retains the ban at Elstree North Reserve (including associated car park) as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

 

      xxvii.        Retains the ban at Elstree Reserve (including associated car parks) as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

    xxviii.        Allows the existing alcohol ban at Esplanade Reserve opposite Sylvia Park Road (beside 781 Great South Rd) to lapse as insufficient evidence has been received to enable the board to retain this ban

       xxix.        Allows the existing alcohol ban at Esplanade Reserves (and reserves near the railway lines near Annes Creek) to lapse as insufficient evidence has been received to enable the board to retain this ban

        xxx.        Retains the ban at Fergusson Domain and Paihia Reserve, Oranga (and surrounding streets) as per the board’s proposal and extend this to include 52 Waitangi Road as this has recently been added to Ferguson Domain, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

       xxxi.        Allows the existing alcohol ban at Finn Place Esplanade Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

      xxxii.        Retains the ban at Flat Rock Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

    xxxiii.        Allows the existing alcohol ban at Fong Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

    xxxiv.        Allows the existing alcohol ban at George Bourke Historic Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

      xxxv.        Retains the ban at Glen Innes shopping / business area as per the board’s proposal and extend it to include Taniwha Street, the portion of the Glen Innes Train Station within the local board boundary; and the remaining area of the Ruapotaka Reserve around and including the library, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

    xxxvi.        Allows the existing alcohol ban at Gloucester Park North (including car park) to lapse as insufficient evidence has been received to enable the board to retain this ban

   xxxvii.        Allows the existing alcohol ban at Gloucester Park South (including associated car park) to lapse as insufficient evidence has been received to enable the board to retain this ban

 

  xxxviii.        Notes that the Greenlane SH1 footbridge is within the Orakei Local Board area and request that officers forward all evidence to Orakei Local Board in order for them to make a determination on this ban

    xxxix.        Retains the ban at Hamlin Park (including car park) as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

            xl.        Retains the ban at Harrison Reserve as per the board’s proposal, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

           xli.        Allows the existing alcohol ban at Highway House (including associated car park) to lapse as insufficient evidence has been received to enable the board to retain this ban

           xlii.        Retains the ban at Hillside Corner Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

        xliii.        Retains the ban at Hobson Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

        xliv.        Retains the ban at Hochstetter Pond as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

          xlv.        Retains the ban at Hornes Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

        xlvi.        Allows the existing alcohol ban at Horsham Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

       xlvii.        Retains the ban at Ian Shaw Park as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

      xlviii.        Allows the existing alcohol ban at Ireland Road Tree Grove to lapse as insufficient evidence has been received to enable the board to retain this ban

        xlix.        Retains the ban at Jellicoe Park (including associated car park) and extend this to cover the angled car parking and associated footpath and build-outs on Quadrant Road, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

               l.        Retains the ban at Joe Wolfe Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

              li.        Retains the ban at Johnson Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

            lii.        Retains the ban at Jolson Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

           liii.        Retains the ban at Jordan Park (including associated car park) as per the board’s proposal and extend to include those parts of the road reserve which are adjacent to the existing ban and function as part of the reserve, and  remove those sections on the northern edge which are not currently owned by council, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

           liv.        Allows the existing alcohol ban at Konini Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

            lv.        Retains the ban at Kotuku Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

           lvi.        Retains the ban at Leybourne Circle Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

 

          lvii.        Retains the existing ban at Lavas Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

        lviii.        Retains the ban at Longford Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

           lix.        Allows the existing alcohol ban at Malone Road Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

            lx.        Creates a new ban over the area called the Waikaraka Walkway/Cycleway which will be a composite of the existing Manukau Foreshore East Cycleway, Manukau Foreshore East Walkway, Manukau Foreshore West Walkway bans, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

           lxi.        Notes that the Manukau Foreshore East Cycleway is now part of the Waikaraka Walkway/Cycleway ban.

          lxii.        Notes that the Manukau Foreshore East Walkway is now part of the Waikaraka Walkway/Cycleway ban

        lxiii.        Notes that the Manukau Foreshore West Walkway is now part of the Waikaraka Walkway/Cycleway ban

        lxiv.        Allows the existing alcohol ban at Marei Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

        lxvi.        Retains the ban at Martin Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

       lxvii.        Allows the existing alcohol ban at Massey Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

      lxviii.        Allows the existing alcohol ban at Mataroa Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

        lxix.        Allows the existing alcohol ban at Mauinaina Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

          lxx.        Retains the existing ban at Mauinaina West Reserve (including associated car park) as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

        lxxi.        Retains the ban at Maybury Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

       lxxii.        Retains the ban at McManus Park as per the board’s proposal and extend to include the shared driveway, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

      lxxiii.        Allows the existing alcohol ban at McNab Street SH1 underpass to lapse as insufficient evidence has been received to enable the board to retain this ban

      lxxiv.        Allows the existing alcohol ban at Miami Parade Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

       lxxv.        Notes that the ban at Migrant Support Services Inc (101 Church Street) has been included in the Onehunga Town Centre ban

      lxxvi.        Retains the ban at Mt Wellington War Memorial Reserve (including associated car park) as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

    lxxvii.        Allows the existing alcohol ban at Niall Burgess Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

   lxxviii.        Allows the existing alcohol ban at Olive Road Pleasance to lapse as insufficient evidence has been received to enable the board to retain this ban

      lxxix.        Retains the ban at Onehunga Bay Reserve (including associated car park) and extend it to include both pedestrian bridges which span State Highway 20 and excluding the area surrounding the Manukau Cruising Club as this is now incorporated into the Onehunga Foreshore Restoration Reserve and shared use path ban, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

 

       lxxx.        Retains the ban at Onehunga shopping / business area as per the board’s proposal and extend to include 101 Church Street, Onehunga and the entirety of the Waller Street car park and the entirety of St Peters Church, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

      lxxxi.        Creates a new ban over the area of the new Onehunga Foreshore Restoration Reserve and Orpheus Drive shared use path and incorporating the existing Orpheus Drive Reserve and the portion of the Onehunga Bay Reserve surrounding the Manukau Cruising Club as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

    lxxxii.        Notes that the ban at Orpheus Drive Reserve is now included in the Onehunga Foreshore Restoration and Orpheus Drive shared use path ban

   lxxxiii.        Allows the existing alcohol ban at Paddington Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

   lxxxiv.        Allows the existing alcohol ban at Paisley Place Recreation Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

    lxxxv.        Retains the ban at Panmure Basin (including associated car park) as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

   lxxxvi.        Retains the ban at Panmure shopping / business area as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

  lxxxvii.        Retains the ban at Panmure Wharf Reserve (including wharf and associated car park) as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

lxxxviii.        Notes that the existing alcohol ban at Pilkington Road/Apirana Avenue Reserve is now included in the Glen Innes Town Centre ban

   lxxxix.        Requests that officers forward the evidence on Pleasance Reserve to Albert-Eden Local Board to enable them to make a decision on this ban

 

           xc.        Creates a new ban called the Point England Reserve and Esplanade Walkway that combines the existing Point England Reserve and Point England Esplanade Walkway bans as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week

          xci.        Notes that the existing ban at Point England Reserve is now included in the Point England Reserve and Esplanade Walkway ban

        xcii.        Allows the existing alcohol ban at Portman Road Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

       xciii.        Notes that the existing ban at Pt England Esplanade walkway (including associated car park) is now included in the Point England Reserve and Esplanade Walkway ban

       xciv.        Retains the ban at Riverside Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

        xcv.        Retains the ban at Rockfield Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

       xcvi.        Retains the ban at Rowe Reserve (including associated car park) and extend to include the adjacent reserve space which runs between Rowe Street and Spring Street, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

      xcvii.        Notes that the ban at Ruapotaka Reserve (including associated car park) is now included in the Glen Innes Town Centre ban

    xcviii.        Allows the existing alcohol ban at Savage Park (including associated car park) to lapse as insufficient evidence has been received to enable the board to retain this ban

           cii.        Allows the existing alcohol ban at Southdown Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

          ciii.        Allows the existing alcohol ban at St Johns Corner Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban

          civ.        Retains the ban at Station Road Pleasance as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

       cxix.        Retains the ban at Vic Cowen Park (including associated car park) as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week

        cxx.        Retains the existing ban at Waikaraka Cemetery and extend it to include Waikaraka Park Road and Alfred Street south of Neilson Street as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week
