Work programme for rezoning and precincts

Purpose
1. To provide an update on the next phase of mediation and hearings and seek the committee’s endorsement of a proposed work programme for rezoning and precinct submissions. The report also recommends that the relevant planning managers within the Plans and Places department are delegated the authority to agree to changes to precincts in the Proposed Auckland Unitary Plan (Unitary Plan) that are consistent with the current objectives and policies in the Unitary Plan.
Executive Summary
2. The Unitary Plan hearings process commenced last September. Initial mediations and hearings focused on the Regional Policy Statement chapter of the Unitary Plan, and were followed by mediation and hearings on the Regional Coastal Plan chapter and other regional plan and district plan topics. Forty-four hearings have now been completed and an additional 12 hearings on topics that have relevance across Auckland are due to be completed by early November.
3. The final phase of mediation and hearings commences in November 2015 and is programmed to be completed by the end of April 2016. This final phase will deal with submissions on designations, the Rural Urban Boundary, rezoning, precincts and the Special/Historic Character/Pre-1944 overlay. A large proportion of the submissions on these topics are by individuals with an interest in the specific provisions of the Unitary Plan that related to their property. Analysis of the submission on these topics is currently underway.
4. This report sets out a proposed work programme for the committee. The programme has been developed to ensure the council is able to confirm its position in response to the submissions on these topics at mediation and the hearings. Given the sheer volume of submission points on detailed site/area-specific provisions in the Unitary Plan (i.e. precincts), the report also recommends that the relevant council planning managers are delegated the authority to agree to changes to precincts where those changes are consistent with the current objectives and policies in the Unitary Plan. There are approximately 5,700 submission points relating to 121 existing precincts and 552 submission points relating to 168 new precincts.
That the Unitary Plan Committee: a) endorses the work programme set out in Attachment 1 to the agenda report. b) delegates to the General Manager - Plans and Places, Unitary Plan Manager and the three Area Planning Unit Managers, the authority to agree to changes to precincts in the Proposed Auckland Unitary Plan where those changes are consistent with the current objectives and policies in the Proposed Auckland Unitary Plan. c) requests that the Unitary Plan Manager reports the key changes agreed to under recommendation b) to the Unitary Plan Committee in March/April 2016. |
Comments
5. Attachment A sets out a proposed work programme for the committee. The programme has been developed to ensure the council is able to confirm its position in response to the submissions at mediation and the hearings. The programme also recognises the challenges a number of the planning teams face dealing with rezoning and precinct submissions in parallel with one another, while also preparing for hearings on the Rural Urban Boundary.
6. In summary, the programme involves a series of reports being presented to the committee in relation to four broad groups of topics:

Group 1 – Auckland-wide specific zones and precincts
7. The Independent Hearings Panel has split the rezoning and precinct submissions into two major hearing topics: Auckland-wide (Topic 080) and Geographic (Topic 081). The Auckland-wide topic includes submissions on Public Open Space zones and precincts, Coastal zones and precincts and a range of Special Purpose zones and precincts (e.g. Tertiary Education zone and Retirement Village zone). Mediation for these topics is currently scheduled for November and the hearings in February next year.
8. Many of the submissions on these topics are considered to be relatively straight-forward and uncontroversial, however some of the submissions on the zoning or precincts relating to major recreation facilities (e.g. stadiums), schools, tertiary education facilities and public open space relate to matters of considerable public interest. The work programme for the committee has been developed to ensure that these topics are discussed with the committee prior to mediation.
Group 2 – Rezoning Central and West
9. There are several thousand submission points that relate to zoning in Central and West Auckland. These broad areas have been broken into smaller geographic areas to enable the submissions to be carefully analysed against the zoning principles confirmed by the Auckland Development Committee in May 2015. A series of maps showing the current zoning in the Unitary Plan and proposed rezonings will be presented to the committee for review and endorsement.
Group 3 – Rezoning South and North and Precincts Central and West
10. As with Group 2, there are several thousand submission points relating to zoning in South and North Auckland. Again, these broad areas have been broken into small geographic areas to assist with the analysis of submissions, and a series of maps will be presented to the committee for review and endorsement.
11. With respect to the precincts in this group, six existing precincts and one new precinct are considered to be of high public interest. These precincts will be reported to the committee with recommendations for any changes.
Group 4 – Precincts North and South
12. Thirteen existing and eight new precincts are considered to be of high public interest in this broad geographic area and are proposed to be reported to the committee.
Delegations
13. There are approximately 5,700 submission points relating to 121 existing precincts and 552 submission points relating to 168 new precincts. Given the sheer scale of the task involved in confirming the council’s position in response to the precinct submissions, it is recommended that the relevant planning managers within the Plans and Places Department are delegated the authority to agree to changes to precincts where those changes are consistent with the current objectives and policies in the Unitary Plan.
14. Any delegations agreed to by the committee would be exercised with considerable caution and a record of all key changes reported to the committee early in the New Year.
Consideration
Local Board views and implications
15. The views of local boards are able to be represented by the invitation extended to all local board chairs to attend the Unitary Plan Committee.
Māori impact statement
16. The recommendations made in this report are not considered to have any specific impact on Māori.
Implementation
17. The recommendations made in this report can be implemented within the existing Plans and Places department budget.
