Sarah Gloyer and Andy Spence presented a petition of 367 online and 56 hard copy signatures to the board with the following prayer:
“a) We are asking the Local board not ratify the decisions of the Hearings Panel in respect to the dog by-law changes but rather to:
b) Defer consideration of any rule change mindful that it will delay the time/season rule for this summer and,
c) Commit to a further consultation process which is undertaken within the community (rather than through Auckland Council standard process) but which includes an opportunity for local recreation / trail users, Forest and Bird, biodiversity and Council staff to come together to reach an agreement about maintaining as much off lead trail as is reasonable while providing protection for wildlife and,
d) Use that consultation process as an educational opportunity in terms of raising awareness about sites of significance requiring protection, inviting buy-in from users about how to ensure compliance with agreed on-leash areas and increase community understanding about why some popular areas on trails may, by law, be subject to on-leash requirements.”

Resolution number WHK/2015/128 MOVED by Chairperson PA Walden, seconded by Deputy Chairperson BM Treadwell: That the Waiheke Local Board: a) Approves the recommendations contained in this report. b) Adopts the amendments to the Auckland Council policy on Dogs 2012 as contained in attachment A pursuant to section 10 of the dog control act 1996 with a commencement date of 24 October 2015 noting that the provisions in submission topic 5 will be reviewed within 12 months. c) Requests the governing body to give effect to the amendments in (b) by making any necessary amendments to the Auckland Council Policy on Dogs 2012 pursuant to section 10 of the Dog Control Act 1996 and Auckland Council Dog Management Bylaw 2012 in accordance with section 10(6) of the Dog Control Act 1996. d) Authorises the Manager Social Policy and Bylaws in consultation with the chair of the local board hearing panel to make any minor edits to (a) and (b) to correct any identified errors or typographical edits. e) Notes additionally, that in the good faith represented by interested parties at the board meeting today including the commitment to collaborate, to gain awareness and understanding about the challenges facing the wildlife and biodiversity around Waiheke including why some popular areas of trails may, by law, be subject to on-leash and or prohibition requirements and with the view to providing as much off lead trail as is reasonable while providing protection for wildlife and habitat that the board commit to a full review of the table 5 provisions within twelve months. f) Requests that as a part of this work stream the Local Board office will facilitate meetings with local recreation/trail users, the Hauraki Gulf Islands Branch of the Royal Forest and Bird Protection Society and other parties, separately and collectively. g) Requests that Council immediately pursues and brings together further expert scientific advice from the Department of Conservation and relevant Council departments in order to add to the analysis and inform the process. h) Requests that a process of good faith be applied such that both the aspirations of dog owners recreationally and the environmental management and risk factors are fairly weighed and balanced in order to achieve an outcome that provides for as much off lead access to trails as is reasonable while providing protection for wildlife, the objectives of legislation including the Dog Control Act, and other relevant Acts. i) Thanks all submitters and advocates for their participation. |

Resolution number WHK/2015/129 MOVED by Chairperson PA Walden, seconded by Member JP Meeuwsen: That the Waiheke Local Board: a) Welcomes the opportunity to submit on the draft Auckland Stormwater Network Discharge Consent Application. b) Supports the general outcomes-based approach, providing that water quality targets and standards are set at a level which ensures significant improvements in biodiversity, maintains or restores the life supporting capacity of streams and coastal environments and their recreation and amenity values. c) Notes that: i) Stormwater management is one of the most significant environmental issues on Waiheke Island and the surrounding Hauraki Gulf islands, particularly through the impact on freshwater and coastal ecosystems of sediment and contaminant run off from private land and roads ii) The municipal stormwater infrastructure on Waiheke Island is limited in extent and the roading network is de facto the primary ‘public’ storm water management infrastructure. Therefore the Network Discharge Consent, if only applied to municipal stormwater infrastructure, will only address part of the issues on Waiheke unless it is extended to include Auckland Transport’s responsibilities for managing the road corridor. iii) The Waiheke roading network dates back to the 1940’s, and from that time stormwater management has been carried out in a piecemeal and fragmented way, with heavy reliance on kerb and channel and piped solutions and little or no attention given to water sensitive design principles. iv) The Network Discharge Consent does not adequately address the cumulative effects of sediment run off and overflows from private property into Waiheke’s streams and coastal waters, both directly and via the roading network and/or municipal stormwater network. There should be a requirement for AT to manage these effects when they occur via the roading network. d) Supports a community partnership approach to integrated catchment management, including stormwater management, as is currently being demonstrated in the Little Oneroa Stream project. e) Would support efforts by Council’s Infrastructure and Environmental Services unit, through its stormwater team, to extend a community partnership approach to catchment management across the rest of Waiheke Island. f) Requests that: i) The management of stormwater in the road corridor and on private land are included, either formally or by other means, in any solutions aimed at better managing the future effects of stormwater on Waiheke Island, including in the Network Discharge Consent. ii) The management of the adverse effects of stormwater runoff from publicly owned and managed infrastructure on Waiheke Island should include requirements to retrofit water sensitive design solutions when significant works are carried out on the roading network or other stormwater projects and to manage the cumulative effects of sediment run off via the roading network from permitted or consented activities on private land. The promotion and encouragement of best practice across all land and infrastructure types should form part of the Network Discharge Consent application and/or as part of any resource consent conditions. iii) In order to address stormwater issues on Waiheke as per the above, the Network Discharge Consent should acknowledge the need for integrated catchment management plans for Waiheke Island which include all aspects of stormwater management and address issues of contamination of all freshwater and coastal ecosystems across the island, as proposed in the approved Waiheke Local Board Plan. |

Resolution number WHK/2015/130 MOVED by Chairperson PA Walden, seconded by Member JP Meeuwsen: That the Waiheke Local Board: a) Approves to $17,000 from the 2015/16 Christmas Events budget to plan and deliver the 2015 Waiheke Christmas Weekend. b) Notes the council delivery team will manage the event delivery and operational budget for the Waiheke Christmas Weekend, including: · Carols by the Sea (with support from Waiheke Youth Voice); and · Waiheke Christmas Parade (with support from an on island event coordinator and Waiheke Youth Voice). c) Delegates authority to the local board Youth Portfolio Holder to approve the final programme for the 2015 Waiheke Christmas Weekend in line with the agreed outcomes of the board in collaboration with Waiheke Youth Voice and council’s event delivery team. |

Resolution number WHK/2015/131 MOVED by Chairperson PA Walden, seconded by Member RE Ballard: That the Waiheke Local Board: a) Grants approval for a Licence to Occupy and Manage the “Old Library Space” portion of the premises at 2 Korora Road, Waiheke on the following terms and conditions: i) Term - one year commencing 25 May 2015 ii) License fee - $1.00 per annum, plus GST if demanded iii) Maintenance fee - $25 per square metre per annum b) Notes that all other terms and conditions are in accordance with Auckland Council’s Community Occupancy Guidelines 2012. |
