That the Maungakiekie-Tāmaki Local Board:

a)         thanks Tanya Mead, Policy Analyst, Antonia Butler, Principle Policy Analyst, Peter Loud, Senior Community Facilities Advisor and David Mose, Team Leader Community Leasing for their attendance to speak to this item

b)      receives the Feasibility Study dated June 2015 for the Space above the Maungakiekie-Tāmaki Local Board offices

c)      agrees in principle to progress with Masterplan C subject to:

i)       funding being available

ii)      agreement from the CAB Panmure to relocate

iii)     an implementation plan being developed for the leased space and transition

d)      requests officers provide the board with a report on potential funding and staging options noting that these will be impacted on by the yet to be adopted Local Board Capital Fund allocation.

Renewal and Variation of Community Lease, Maybury Reserve, 74A Maybury Street, Glen Innes

That the Maungakiekie-Tāmaki Local Board:

a)         thanks David Mose, Team Leader Community Leasing, for his attendance to speak to this item

b)         approves the renewal and variation of the community lease, to the Adult Literacy Tāmaki Auckland Incorporated at Maybury Reserve, 74A Maybury Street, Glen Innes on the following terms and conditions:

i)       Term - 5 years commencing on 1 October 2014 until a final expiry on 30 September 2019.

ii)      Rent - $500.00 plus GST per annum

c)         approves the amendment to the lease document to record the lease holder’s name as Adult Literacy Tāmaki Auckland Incorporated.

d)         all other terms and conditions in accordance with the current lease agreement

e)         note that Watercare’s proposed Glendowie Branch Sewer works may impact on this leased area, and request that officers work with Watercare and Adult Literacy Tāmaki Auckland Incorporated to ensure all parties are well informed and any impacts are addressed to the satisfaction of the Maungakiekie-Tāmaki Local Board and the board meets its obligations under the terms of the lease.

a)         thanks David Mose, Team Leader Community Leasing, for his attendance to speak to this item

b)         approves the renewal of the community lease to the One Tree Hill Community Kindergarten Incorporated at 21-27 Massey Avenue, Massey Reserve, Greenlane on the following terms and conditions:

i)       Term - 5 years commencing on 1 August  2013 to 31 July 2018

ii)      Rent - $250.00 plus GST per annum

c)         approves the variation to the lease to include the One Tree Hill Community Kindergarten Incorporated Community Outcomes Plan as part of the lease agreement

d)         all other terms and conditions in accordance with the current lease agreement.

b)        retain the following alcohol bans as recommended to be retained, pursuant to the Auckland Council Alcohol Control Bylaw 2014, with a commencement date of 31 October 2015, and with times stated as follows:

i.                   Retains the ban at 37a Fenchurch Street (including associated car park) as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

ii.                  Retains the ban at Alcock Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xii.               Retains the ban at Eastview Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

xiii.              Retains the ban over those parts of the Ellerslie SH1 footbridge which exist in the Maungakiekie-Tāmaki Local Board area and extend this to incorporate the new section of the Ellerslie Rail Station which extends onto Kalmia Street as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and request that officers provide further advice as to the hours of the ban for those sections of the Ellerslie SH1 footbridge that exist in the Orakei Local Board area.

xiv.              Retains the ban at Elstree North Reserve (including associated car park) as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xv.               Retains the ban at Elstree Reserve (including associated car parks) as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

xvi.              Retains the ban at Fergusson Domain and Paihia Reserve, Oranga (and surrounding streets) as per the board’s proposal and extend this to include 52 Waitangi Road as this has recently been added to Fergusson Domain, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

xvii.             Retains the ban at Flat Rock Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

xviii.           Retains the ban at Glen Innes shopping / business area as per the board’s proposal and extend it to include Taniwha Street, the portion of the Glen Innes Train Station within the local board boundary; and the remaining area of the Ruapotaka Reserve around and including the library, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week, noting that:

1.       the ban at Ruapotaka Reserve (including associated car park) is now included in the Glen Innes Town Centre ban.

2.       the ban at Taniwha St railway underpass which is in the Maungakiekie-Tāmaki Local Board area is incorporated in the Glen Innes Town Centre ban and request that officers forward evidence to the Orakei Local Board to make a decision on the part of the underpass which exists in the Orakei Local Board area.

3.       the existing alcohol ban at Pilkington Road/Apirana Avenue Reserve is now included in the Glen Innes Town Centre ban.

xix.              Retains the ban at Hamlin Park (including car park) as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xx.               Retains the ban at Harrison Reserve as per the board’s proposal, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxi.              Retains the ban at Hillside Corner Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

xxii.             Retains the ban at Hobson Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxiv.           Retains the ban at Hornes Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxv.             Retains the ban at Ian Shaw Park as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

xxvi.           Retains the ban at Jellicoe Park (including associated car park) and extend this to cover the angled car parking and associated footpath and build-outs on Quadrant Road, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxvii.          Retains the ban at Joe Wolfe Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxviii.         Retains the ban at Johnson Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxix.           Retains the ban at Jolson Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

xxx.             Retains the ban at Jordan Park (including associated car park) as per the board’s proposal and extend to include those parts of the road reserve which are adjacent to the existing ban and function as part of the reserve, and  remove those sections on the northern edge which are not currently owned by council, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxxi.           Retains the ban at Kotuku Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

xxxii.          Retains the ban at Leybourne Circle Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxxiii.         Retains the existing ban at Lavas Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxxiv.         Retains the ban at Longford Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxxv.          Retains the ban at Martin Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxxvi.         Retains the existing ban at Mauinaina West Reserve (including associated car park) as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xxxvii.       Retains the ban at Maybury Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

xxxviii.      Retains the ban at McManus Park as per the board’s proposal and extend to include the shared driveway, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

xxxix.         Retains the ban at Mt Wellington War Memorial Reserve (including associated car park) as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xl.                 Retains the ban at Onehunga Bay Reserve (including associated car park) and extend it to include both pedestrian bridges which span State Highway 20 and excluding the area surrounding the Manukau Cruising Club as this is now incorporated into the Onehunga Foreshore Restoration Reserve and shared use path ban, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xli.               Retains the ban at Onehunga shopping / business area as per the board’s proposal and extend to include 101 Church Street, Onehunga and the entirety of the Waller Street car park and the entirety of St Peters Church, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week, noting that:

1.       the ban at Migrant Support Services Inc (101 Church Street) has been included in the Onehunga Town Centre ban.

xlii.              Retains the ban at Panmure Basin (including associated car park) as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xliii.             Retains the ban at Panmure shopping / business area as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

xliv.             Retains the ban at Panmure Wharf Reserve (including wharf and associated car park) as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xlv.              Retains the ban at Riverside Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xlvi.             Retains the ban at Rockfield Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xlvii.           Retains the ban at Rowe Reserve (including associated car park) and extend to include the adjacent reserve space which runs between Rowe Street and Spring Street, as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xlviii.          Retains the ban at Station Road Pleasance as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

xlix.             Retains the ban across those parts of the Sultan Street SH1 underpass which exist in the Maungakiekie-Tāmaki Local Board area as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week and that we request that officers forward the evidence on Sultan Street SH1 underpass to Orakei Local Board to enable them to make a decision on this ban.

l.                   Retains the ban at Taiere Reserve as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

li.                           Retains the ban at Talbot Park as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

lii.                 Retains the ban at Taniwha Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

liii.               Retains the ban at Taurima Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

lx.                 Retains the ban at Waipuna Recreation Area as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

lxi.               Retains the ban at West Tāmaki Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week.

lxii.              Retains the ban at Wimbledon Reserve as per the board’s proposal as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week.

c)         allow the following alcohol bans recommended to lapse, to do so on 31 October 2015 given the panel’s determination that they did not meet the new evidentiary threshold required to make an alcohol ban under the Local Government Act 2002:

i.                    Allows the existing alcohol ban at the Panmure Train Station to lapse as insufficient evidence has been received to enable the board to retain this ban.

ii.                  Allows the existing alcohol ban at Allenby Reserve (including associated car park) to lapse as insufficient evidence has been received to enable the board to retain this ban.

iii.                 Allows the existing alcohol ban at Almond Reserve (including associated car park) to lapse as insufficient evidence has been received to enable the board to retain this ban.

iv.                 Allows the existing alcohol ban at Anns Creek Reserve to lapse as insufficient evidence has been received to enable the board to retain this ban.

         i.          the Manukau Foreshore East Cycleway is now part of the Waikaraka Walkway/Cycleway ban

         ii.         the Manukau Foreshore East Walkway is now part of the Waikaraka Walkway/Cycleway ban

         iii.        the Manukau Foreshore West Walkway is now part of the Waikaraka Walkway/Cycleway ban

e)      creates a new ban over the area of the new Onehunga Foreshore Restoration Reserve and Orpheus Drive shared use path and incorporating the existing Orpheus Drive Reserve and the portion of the Onehunga Bay Reserve surrounding the Manukau Cruising Club as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 10pm-7am during daylight savings and 7pm-7am outside daylight savings, seven days a week, noting that:

i.        the ban at Orpheus Drive Reserve is now included in the Onehunga Foreshore Restoration and Orpheus Drive shared use path ban

f)       creates a new ban called the Point England Reserve and Esplanade Walkway that combines the existing Point England Reserve and Point England Esplanade Walkway bans as the panel is of the opinion that sufficient evidence of a high level of harm or disorder associated with alcohol at this location exists, and sets the hours of this ban to 24 hours, 7 days a week, noting that:

i.          the existing ban at Point England Reserve is now included in the Point England Reserve and Esplanade Walkway ban

ii.         the existing ban at Pt England Esplanade walkway (including associated car park) is now included in the Point England Reserve and Esplanade Walkway ban

g)      confirms that the decisions in b) to f) are in accordance with relevant requirements of the Local Government Act 2002 and Auckland Council Alcohol Control Bylaw 2014

h)      requests that the Orākei Local Board make a 24 hours, 7 days a week alcohol ban for the area of the Glen Innes Train Station in the Orākei Local Board area (map 6, Attachment C, page 189 of the agenda)

i)       makes the Ellerslie State Highway 1 footbridge alcohol ban to be 24 hours, 7 days a week (Map 2, page 185 of the agenda)

j)       requests the Puketāpapa Local Board make a 10pm to 7am daylight saving and 7pm to 7am outside daylight saving alcohol ban for the area of the Onehunga Foreshore Restoration Reserve alcohol ban in the Puketāpapa Local Board area (map 50, Attachment C, page 233 of the agenda)

k)      requests that the Regulatory and Bylaws Committee make a 24 hours, 7 days a week alcohol ban for that part of the access road to Ōtāhuhu (Mount Richmond) adjoining McManus Park (map 12, Attachment C, page 195 of the agenda)

l)       delegates approval for minor edits or amendments to correct any identified errors or typographical edits to the chairperson of the Maungakiekie-Tāmaki Local Board.

Re-establishment of the Central Facility Partnerships Committee

That the Maungakiekie-Tāmaki Local Board:

a)         supports the re-establishment of the Central Facility Partnerships Committee to provide governance and monitoring of the existing projects to their completion

b)         agrees to the Terms of Reference for the re-established Central Facility Partnerships Committee attached as Attachment A to the report (page 267 of the agenda) and recommends them to the re-established Central Facility Partnerships Committee for final approval

c)         requests the Governing Body to provide such delegated authority as is required for the committee to fulfil its governance functions

d)         requests advice from the Sport and Recreation Partnerships’ Manager as to:

·   which approved Central Facility Partnerships feasibility studies will support the priorities in all relevant facility based network plans, and

·   when the draft Sports Facilities Network Plan will be reported to the Parks, Sport and Recreation Committee

e)         appoints Deputy Chairperson CL Makoare, and Board Member JB Clark as alternate, to the Central Facility Partnerships Committee

f)          subject to support from the five isthmus boards, at a minimum, requests Local Board Services’ staff to set up an initial committee meeting to appoint a chair and deputy and approve the revised Terms of Reference.

Urgent Decisions by the Maungakiekie-Tāmaki Local Board

That the Maungakiekie-Tāmaki Local Board note the following decision made under urgency:

a)      That the Maungakiekie-Tāmaki Local Board direct officers to negotiate a management contract with the Maungarei Christian Community Trust for the Riverside Community Centre with the following terms and conditions:

i.        To commence upon signing (noting that until this point they are still subject to the conditions of the old management contract) and to expire at midnight 31st March 2016.

ii.       At the revised figure of $54,701 for this period (1 July 2015 to 31 March 2016) to be paid in one payment of $36,500 upon the signing of the agreement, with the balance of $18,201 at the beginning of January 2016.

iii.      Standard terms and conditions agreed to between the parties.

b)      That the Maungakiekie-Tāmaki Local Board direct officers to immediately commence work to understand and address the long term sustainability and future direction of Riverside on the following timeframes:

i.        An outline of next steps needs to be agreed with the portfolio holder and chair within two weeks of the date of this decision.

ii.       A workshop with the board, outlining future options be for the end of the 2015 calendar year.

iii.      A report which enables the board to decide on which option to pursued in time for the February 2016 meeting of the local board.

That the Maungakiekie-Tāmaki Local Board:

a)        opposes the allocation of petroleum exploration permits in the proposed area for the following reasons:

i.        A blowout at an offshore exploratory drilling operations is of low likelihood but very high consequence in terms of the environmental risks.  This is of significant concern to the community.

ii.       Maui’s dolphins use echolocation to navigate, communicate and find their food.  High frequency ultrasonic clicks reflect back to the dolphin any objects found in the water.  Seismic surveying has the potential to disrupt these behaviours.

iii.      Maui’s dolphins are found along the length of the Auckland’s west coast.  They are on the verge of extinction and it is estimated that there are only 55 dolphins remaining.  The board cannot see how anything but full prudence will save this sub-species from extinction over the long number of years it will require to rebuild its population to a viable size.

b)        notes that in the Maungakiekie-Tāmaki Local board plan 2014 has as one of its outcomes, a healthy natural environment enjoyed by our communities. The board through Auckland Council has worked hard to restore the mauri of its waterways as this is something the community feels strongly about.  The board have undertaken a number of measures such as tetratraps installation, ecological restoration, working with industry to prevent pollution, sustainable water use and household stormwater management

c)        notes that in 2014 the Government’s response to Auckland Council’s concerns about the area and the Maui’s dolphins stated that there were other measures in place to protect the dolphins environment, although a thorough evaluation is yet to establish their effectiveness.
