Introducing an alcohol ban in the Manukau Metropolitan Town Centre
File No.: CP2015/25284
Purpose
1. To consider a request from the Ōtara - Papatoetoe Local Board to make a 24 hour 7 day a week alcohol ban on that part of the Manukau Metropolitan Centre that lies within the Manurewa Local Board area.
Executive Summary
2. Local boards have the delegated authority to make alcohol bans within their local board area pursuant to the Auckland Council Alcohol Control Bylaw 2014.
3. Under the legacy Manukau City Council Liquor Control Bylaw 2008, there was a 24 hour, 7 day a week alcohol ban in place in Manukau City Town Centre.
4. That alcohol ban expired on 31 October 2015.
5. The Ōtara - Papatoetoe Local Board considered the evidence of alcohol related crime and disorder and decided there was sufficient evidence to create the Manukau Metropolitan Centre 24 hour 7 day a week alcohol ban to include the business park at 613 – 615 Great South Road and the Manukau City Town Centre.
6. The Manukau Metropolitan Centre lies across both the Ōtara - Papatoetoe Local Board area and the Manurewa Local Board. The Ōtara - Papatoetoe Local Board has requested the Manurewa Local Board make a 24 hour 7 day a week alcohol ban on that part of the Manukau Metropolitan Centre that lies within the Manurewa Local Board area (resolution number OP/2015/171).
7. The request from the Ōtara - Papatoetoe Local Board has been made to address alcohol related issues occurring in both local board areas at all times of the day and night. This includes vandalism, intimidation, drunkenness, violence and offensive behaviour and alcohol related litter.
8. A map of the alcohol ban area requested is shown in Attachment A and shaded blue.
9. Staff have identified two feasible options for the local board to consider
· Option 1 – Make a 24 hour 7 day a week alcohol ban on that part of the Manukau Metropolitan Centre that lies in the Manurewa Local Board area
· Option 2 - Consider that there is insufficient evidence to make an alcohol ban on that part of the Manukau Metropolitan Centre that lies in the Manurewa Local Board area.
10. Council staff recommend Option 1 as it would help address alcohol related crime and disorder in all parts of the Manukau Metropolitan Centre, is consistent with the alcohol ban that was in place in the old Manukau City Town Centre and is consistent with the majority of the rest of the Manukau Metropolitan Centre.
11. The decision required from the Manurewa Local Board is whether or not to make an alcohol ban on its portion of the Manukau Metropolitan Centre.
That the Manurewa Local Board: Either a) make a 24 hour 7 day a week alcohol ban pursuant to the Auckland Council Alcohol Control Bylaw 2014 on that part of the Manukau Metropolitan Centre that lies in the Manurewa Local Board area and as shown in Attachment A. b) confirm that the decisions in (a) are in accordance with relevant requirements of the Local Government Act 2002 and Auckland Council Alcohol Control Bylaw 2014 Or c) consider that there is insufficient evidence to make an alcohol ban pursuant to the Auckland Council Alcohol Control Bylaw 2014 on that part of the Manukau Metropolitan Centre that lies in the Manurewa Local Board area. |
Background
12. The Manukau Metropolitan Centre lies within both the Ōtara - Papatoetoe Local Board area and the Manurewa Local Board area. The majority of the centre lies within the Ōtara - Papatoetoe Local Board area.
13. Previously a 24 hour 7 day a week alcohol ban existed on the whole of the Manukau City Town Centre. That alcohol ban expired on 31 October 2015.
14. The former Manukau City Council extended this alcohol ban to 24 hours, seven days a week in 2004 due to on-going concerns by the community, local business and police about the negative effects associated with the consumption of alcohol in the area, including offensive behaviour, drunkenness and violence.
15. Recent changes to legislation required a review of all alcohol bans against a new, higher threshold. Staff undertook a review of all of Auckland Councils alcohol bans between December 2014 and October 2015.
16. Data from the New Zealand Police indicated the levels of alcohol-related crime or disorder in the town centre supports the retention of the alcohol ban.
17. The initial advice from Council staff to the Ōtara - Papatoetoe Local Board was to amend the geographical area to include the business park at 613 – 615 Great South Road and retain the alcohol ban at Manukau City Town Centre.
18. The views of the community were sought by local boards in the recent review of permanent alcohol bans prior to 31 October 2015. The Manurewa Local Board received over 150 submissions. The public were generally supportive of alcohol bans as a means of addressing alcohol related crime and disorder.
19. Submissions received by the Ōtara - Papatoetoe Local Board also supported the use of alcohol bans and submissions received by the Ōtara - Papatoetoe Local Board relating specifically to the Manukau Metropolitan Centre can be found in Attachment B.
20. Evidence of alcohol-related crime or disorder includes issues that occurred at all times of day and night. This includes vandalism, intimidation, drunkenness, violence, offensive behaviour and alcohol related litter.
21. Community focussed solutions suggested by residents included better lighting, more police patrols, installing security cameras and more rubbish bins.
22. Evidence of alcohol-related crime and disorder was also provided by the police who supported the making of a 24 hour, 7 day a week alcohol ban.
23. The Ōtara - Papatoetoe Local resolved to make a 24 hour 7 day a week alcohol ban on that part of the Manukau Metropolitan Centre that lies within its local board area, including the business park at 613 – 615 Great South Road.
24. The local board also resolved to request the Manurewa Local Board to make the same alcohol ban on its part of the Manukau Metropolitan Centre to address alcohol related crime and disorder on the whole area, and for consistency in terms of police enforcement and public awareness (resolution number OP/2015/171) – see Attachment C.
Comment
25. The Auckland Council Alcohol Control Bylaw 2014 delegates to local boards the ability to make alcohol bans in its local board area.
26. In making decisions on an alcohol ban a local board must be satisfied that it complies with a range of statutory and bylaw requirements. This includes the following requirements outlined in Clause 7(2) of the Alcohol Control Bylaw 2014 (Attachment C):
· evidence that the alcohol ban area has experienced a high level of crime or disorder that can be shown to have been caused or made worse by alcohol consumption in the area
· that the alcohol ban is appropriate and proportionate in the light of the evidence and can be justified as a reasonable limitation on people's rights and freedoms
· consideration of community-focused solutions as an alternative to or to complement an alcohol ban area
· consideration of the views of the police, and owners, occupiers, or persons that council has reason to believe are representative of the interests of owners or occupiers, of premises within the area to which the alcohol ban will apply
· consideration to using one of the following times for consistency:
§ 24 hours, 7 days a week (at all times alcohol ban);
§ 7.00pm to 7.00am daily (evening alcohol ban)
§ 10.00pm to 7.00am daylight saving and 7.00pm to 7.00am outside daylight saving (night time alcohol ban)
§ 7.00pm on the day before to 7.00am on the day after any weekend, public holiday or Christmas/New Year holiday period (weekend and holiday alcohol ban).
27. The area which Ōtara - Papatoetoe Local Board request the Manurewa Local Board to make a 24 hour 7 day a week alcohol ban is to the south of the South –western Motorway between Lambie Drive, Lambie Drive off ramp, Wiri Station Road and Druces Road (See Attachment A).
28. The Ōtara - Papatoetoe Local Board made a 24 hour 7 day a week alcohol ban on all parts of the Manukau Metropolitan Centre that fall within its local board area.
29. There is currently no alcohol ban on that part of the Manukau Metropolitan Centre that lies in the Manurewa Local Board area.
Options open to the Manurewa Local Board
30. The following reasonably practicable options have been identified and analysed by staff.
Option 1 (Recommended option)
31. Make a 24 hour, 7 day a week (at all times) alcohol ban
32. Council staff recommend this option as it would:
· be consistent with the alcohol ban in the majority of the rest of the town centre
· help address alcohol related crime and disorder in all parts of the town centre
· enable a consistent enforcement regime across the whole of the town centre
· ensure consistent messaging to both residents and visitors
33. Council staff do not consider introducing a 24 hour, 7 day a week (at all times alcohol ban) on that part of the Manukau Metropolitan Centre that lies within the Manurewa Local Board area would be an unreasonable limitation on people's rights and freedoms to possess or consume alcohol.
Option 2
34. Do not make an alcohol ban.
35. As there is currently no alcohol ban on that part of the Manukau Metropolitan Centre that lies within the Manurewa Local Board area it will mean no change from the status quo. However this would be a change from the previous status of the area prior to the lapsing of the legacy bans on 31 October 2015.
36. This option would:
· mean that people located near the south eastern corner of the town centre by Buckland Road would be able to consume alcohol but that people located in any other part of Manukau Metropolitan Centre would be prohibited from doing so
· be inconsistent with the alcohol ban on the rest of the Manukau Metropolitan Centre
· result in a fragmented enforcement regime across the whole of the Manukau Metropolitan Centre
· result in confusing and conflicting messaging to both residents and visitors and
· not help address alcohol related crime and disorder on all parts of the Manukau Metropolitan Centre.
Staff recommendation to Manurewa Local Board
37. Staff recommend the Manurewa Local Board adopt a 24 hour 7 day a week alcohol ban on that part of the Manukau Metropolitan Centre that lies within its local board area.
38. This would help address alcohol related crime and disorder in all parts of the Manukau Metropolitan Centre, be consistent with the alcohol ban in the majority of the rest of the Manukau Metropolitan Centre, ease enforcement, and present a consistent message to both residents and visitors.
Consideration

Local board views and implications of making an alcohol ban
39. The Ōtara - Papatoetoe Local Board consider a 24 hour, 7 day a week alcohol ban on the whole the Manukau Metropolitan Centre is justified, and has requested the Manurewa Local Board adopt the same alcohol ban on its portion of the Manukau Metropolitan Centre.
40. This would help to address alcohol related crime and disorder on all parts of the Manukau Metropolitan Centre, ease enforcement, and present a consistent message to both residents and visitors.
Māori impact statement
41. Managing alcohol related harm associated with people consuming alcohol in public places increases opportunities for health and wellbeing, which is consistent with the outcomes of the Māori Plan for Tāmaki Makaurau.
42. Feedback from mana whenua representatives at a hui held in March 2015 supported alcohol bans in principle, and a suggestion that non-regulatory approaches should be considered to help reduce alcohol related harm.
Implementation
43. If the Manurewa Local Board decide to make an alcohol ban its portion of Manukau Metropolitan Centre new signage will be erected, and council’s website will be updated.
44. No action is required if the Manurewa Local Board decide not to make an alcohol ban.

Governance Forward Work Calendar

Purpose
1. To present the Manurewa Local Board 12 month governance forward work calendar.
Executive Summary
2. This report introduces the governance forward work calendar: a schedule of items that will come before local boards at business meetings and workshops over the next 12 months. The governance forward work calendar for the Manurewa local board is included in Attachment A.
3. The calendar aims to support local boards’ governance role by:
· ensuring advice on agendas and workshop material is driven by local board priorities
· clarifying what advice is required and when
· clarifying the rationale for reports.
4. The calendar will be updated every month, be included on the agenda for business meetings and distributed to relevant Council staff. It is recognised that at times items will arise that are not programmed. Board members are welcome to discuss changes to the calendar.

Comments
5. Council’s Quality Advice Programme aims to improve the focus, analysis, presentation and timeliness of staff advice to elected representatives. An initiative under this is to develop forward work calendars for governing body committees and local boards. These provide elected members with better visibility of the types of governance tasks they are being asked to undertake and when they are scheduled.
6. Although the document is new, there are no new projects in the governance forward work calendar. The calendar brings together in one schedule reporting on all of the board’s projects and activities previously approved in the local board plan, long-term plan, departmental work programmes and through other board decisions. It includes governing body policies and initiatives that call for a local board response.
7. This initiative is intended to support the boards’ governance role. It will also help staff to support local boards, as an additional tool to manage workloads and track activities across council departments, and it will allow greater transparency for the public.
8. The calendar is arranged in three columns, “Topic”, “Purpose” and “Governance Role”:
· Topic describes the items and may indicate how they fit in with broader processes such as the annual plan
· Purpose indicates the aim of the item, such as formally approving plans or projects, hearing submissions or receiving progress updates
· Governance role is a higher-level categorisation of the work local boards do. Examples of the seven governance categories are tabled on the following page.

Members Communicating Feedback and Views The Chair requested from members their preferred method of providing feedback to her emails seeking members’ views on local board matters such as: submissions to the Governing Body, invitations to represent the Board, advice on process preference for decision making. 2. Draft Local Government Election Year Policy for Elected Members The board requested clarification on paragraph 35 bullet point 3 as follows: i) what does this mean when someone is speaking on behalf of council or the board? |

3. Nathan Homestead and David Nathan Park Business Planning Project – action planning
Trish Kirkland-Smith (Manager Business Strategy & Relationships, Arts and Culture) and Echo Janman (A&C Facility Manager (Nathan/Studio One), Arts and Culture): a) gave an update on the Draft David Nathan Park and Homestead Business Plan - vision, mission and objectives; b) sought guidance from members on the potential renewals and capital works for FY17 onwards; and c) familiarised the local board with the proposed business plan actions.
Trish explained that some improvements have already been undertaken through the property maintenance budget. Echo believed the best approach was to maximise the spend with the biggest impact for the customer.
A report will be coming to the board for a formal decision in March 2016.
The board gave the following feedback in relation to Nathan Homestead building and theatre: i) disabled access to some parts of the facility is challenging – would like to see lower hand-basins and hand dryers for children to be able to easily use ii) parking could potentially be a problem on-site going forward especially if the facility became more popular iii) strip out the theatre to allow it to be more of a multi-use space.
