Removal of the rural urban boundary on Waiheke

 

Resolution number WHK/2016/168

MOVED by Member JP Meeuwsen, seconded by Member S Brown:  

That the Waiheke Local Board:

a)      note the recommendation in the Unitary Plan hearings panel report:

A small number of submitters requested changes to the Rural Urban Boundary on Waiheke Island. As noted above the Panel recommends the Rural Urban Boundary be located in the district plan and the district plan in the recommended Plan does not cover Waiheke Island or the other Hauraki Gulf Islands. Within this context the Panel considers any changes to the Rural Urban Boundary on Waiheke Island are best left to a district plan review for the Hauraki Gulf Islands, at which time such possible changes can be considered in the wider context of other district plan             issues. The Panel therefore has not recommended changes to the Rural Urban Boundary on Waiheke Island.”

b)      note the advice of the Council Planning department to the Governing Body Item 6.6, Para A.II. dated 10 August 2016 that:

            “As a consequence there is no longer a Rural Urban Boundary at Waiheke because the Hauraki Gulf Islands District Plan does not form part of the PAUP at this stage. Therefore the Panel has no jurisdiction to apply a Rural Urban Boundary at Waiheke.”

 

c)         note the advice of the Council Planning department to the Governing Body Item 6.6, Para A.III.e dated 10 August 2016 that:

“Proposals to expand the existing urban area on Waiheke would be subject to either a non-complying resource consent or a private plan change request, which along with the objective and policies of the Hauraki Gulf Islands will be sufficient to guide decision making.”

d)        note the officers view that the rural urban boundary has in effect been deleted.

e)         note that in its view, given the very clear reasons of the independent hearing panel (2.5, page 15, RUB rezoning and precincts) it is the view of the local board that the rural urban boundary remains unchanged and must continue to be reflected on the planning maps for Waiheke Island.

f)          delegate to the Chairperson and member Meeuwsen to discuss the assertion of the Auckland council officers as it relates to the Rural Urban boundary on Waiheke Island with interested parties including the Environmental Defense Society, Waiheke Island Community Planning Group, Hauraki Gulf Enhancement Society and the Royal Forest and Bird Protection Society.

g)        delegate to the Chairperson and member Meeuwsen to determine whether any of those parties share the boards concerns and have the capacity to seek professional advice as to the appropriateness of the officers interpretation.

h)        delegate the Chairperson and member Meeuwsen to allocate budget out of the community discretionary grants budget line of up to the value of $5000 to be granted to one of the above mentioned organisations.

i)          report back to the business meeting on Thursday 25 August.
