Members are reminded of the need to be vigilant to stand aside from decision making when a conflict arises between their role as a member and any private or other external interest they might have.
The Auckland Council Code of Conduct for Elected Members (the Code) requires elected members to fully acquaint themselves with, and strictly adhere to, the provisions of Auckland Council’s Conflicts of Interest Policy. The policy covers two classes of conflict of interest:
i) A financial conflict of interest, which is one where a decision or act of the local board could reasonably give rise to an expectation of financial gain or loss to an elected member; and
ii) A non-financial conflict interest, which does not have a direct personal financial component. It may arise, for example, from a personal relationship, or involvement with a non-profit organisation, or from conduct that indicates prejudice or predetermination.
The Office of the Auditor General has produced guidelines to help elected members understand the requirements of the Local Authority (Member’s Interest) Act 1968. The guidelines discuss both types of conflicts in more detail, and provide elected members with practical examples and advice around when they may (or may not) have a conflict of interest.
Copies of both the Auckland Council Code of Conduct for Elected Members and the Office of the Auditor General guidelines are available for inspection by members upon request.
Any questions relating to the Code or the guidelines may be directed to the Relationship Manager in the first instance.

Resolution number DT/2016/220 MOVED by Deputy Chairperson G Wood, seconded by Member M Sheehy: That the Devonport-Takapuna Local Board: a) requests from relevant council officers an exemption for the 2016-2017 summer tourist season from the Signage Bylaw 2015 in relation to the placement and location of sandwich boards for the following economically adversely affected businesses and organisations, noting that these entities have received an exemption under the previous North Shore City Council bylaw concerned with controlling such signage: i) Firefly, 22 Wynyard Street, Devonport; ii) Devonport Chocolates, 17 Wynyard Street, Devonport; iii) The Depot Artspace, 28 Clarence St, Devonport; and iv) Art By The Sea, 30 King Edward Parade, Devonport. b) requests from relevant council officers an exemption from the Signage Bylaw 2015 for Nord (1 Fleet Street, Devonport) in relation to the placement and location of sandwich boards, noting that its location off Victoria Street and relative isolation to other businesses makes it difficult to attract patronage. c) requests from relevant council officers an exemption from the Signage Bylaw 2015 for the Devonport Peninsula Trust in relation to the placement and location of signage for the purpose of promoting and conducting the Summer Fun programme on Windsor Reserve, Devonport, and on Bayswater Park, Belmont. d) works with relevant officers from Auckland Transport, Auckland Tourism, Events and Economic Development (ATEED), Auckland Council’s Bylaws and Compliance team, and the Devonport Business Association to investigate long-term solutions to address the unintended consequences created for businesses in Devonport as a result of the implementation of the Signage Bylaw 2015. e) receives

MOVED by Member M Cohen, seconded by Member J O'Connor: That the Devonport-Takapuna Local Board: a) opposes the decision to have a vehicle ban on Takarunga/Mt Victoria, Devonport at this time, and recommends a more appropriate, collaborative process of consultation and engagement with the community before a final decision is made.

Resolution number DT/2016/223 MOVED by Chairperson G Gillon, seconded by Member J O'Connor: That the Devonport-Takapuna Local Board: b) requests that the Maunga Authority connect with the local community and visitors as to why the maunga are important to Maori, and the need to progress opportunities together to better inform and educate the public in innovative and meaningful ways. c) requests that council staff report back to the board as to the status, effectiveness of and frequency of meetings of the Local Board Liaison committee and the Maunga Authority in the last term. d) requests that officers report back to the board as to how the local board can more effectively interact with the Maunga Authority, especially when the interests of the local board area are at stake. |

Resolution number DT/2016/225 MOVED by Deputy Chairperson G Wood, seconded by Member J McKenzie: That the Devonport-Takapuna Local Board: a) requests that, in order to assist the preparation of the Devonport-Takapuna Local Board Plan 2017-2020, officers report on the measures that are being taken to remove at source heavy metals, sedimentation particles and other rubbish from stormwater run-off that eventually flows onto North Shore beaches and Lake Pupuke, and how the efficiency of the removal methods are measured. b) requests that, in addition to the matters outlined in recommendation a) above, officers also report on whether the treatment of stormwater on site in new developments is having the desired impact of not increasing stormwater volumes. |

Resolution number DT/2016/226 MOVED by Member M Sheehy, seconded by Deputy Chairperson G Wood: That the Devonport-Takapuna Local Board: a) requests that, in order to assist the preparation of the Devonport-Takapuna Local Board Plan 2017-2020, officers report on progress made in achieving the key initiative in the “Open Space that Allows Us to Live” section at page 22 of the 2014 Local Board Plan listed as “Seek solutions for grooming Takapuna Beach”. b) requests that, in addition to the matters outlined in recommendation a) above, officers also report on the offer from the Department of Corrections that persons undergoing community sentences could, at minimal cost to ratepayers, help in raking up rubbish scattered by the tide and carrying the rubbish from the beach. c) receives the letter from the Takapuna Beach Business Association in support of council further investigating options regarding the cleaning of Takapuna Beach. |

Resolution number DT/2016/234 MOVED by Chairperson G Gillon, seconded by Member M Sheehy: That the Devonport-Takapuna Local Board: a) receives the report. b) agrees to fund $1,500 from its locally driven initiatives operational budget to cover catering and venue hire for the Greater Takapuna Reference Group meetings through to March 2017. c) agrees to community forum meetings taking place on the first Tuesday of each month, starting at 6pm. d) agrees that the first community forum meeting will take place on Tuesday 7 March 2017 at 6pm to avoid a clash with Waitangi Day weekend in February. e) delegates Members Sheehy and O’Connor the authority to provide local board feedback in relation to resource consent notification considerations in the Devonport-Takapuna Local Board area. |

Special Exemption (Section 6) Fencing of Swimming Pools Act 1987 |

Resolution number DT/2016/235 MOVED by Member J O'Connor, seconded by Member J McKenzie: That the Devonport-Takapuna Local Board: a) grants the application for special exemption as sought for 4 Flagstaff Terrace, Devonport, with the following conditions: i) that the existing exemption stand until 31 July 2017 on the condition self closing and self latching devices are fitted to the existing doors opening to the pool area; and ii) after this date the current exception is to be revoked and a fence is to be installed to isolate the vehicle access way from the pool area.
b) grants the application for special exemption as sought for 29 Jubilee Avenue, Devonport, with the following conditions: i) if board members are satisfied the retaining wall does not create a risk of a child drowning in the spa; and ii) that NZS 8500-2006 clauses a-k are met at all times.
c) grants the application for special exemption as sought for 227 Lake Road, Belmont, with the following conditions: i) that the existing pool gate that is fitted with a keypad is maintained in good condition at all times, noting that the back gate is considered to be low risk for entry by a child 5 years of age.
d) grants the application for special exemption as sought for 22 Audrey Road, Takapuna, with the following conditions: i) that the self-closing and self-latching device is maintained in good working condition at all times.
e) grants the application for special exemption as sought for 37 Tainui Road, Devonport, with the following conditions: i) that NZS 8500-2006 clauses a-k are met at all times; and ii) that the spa remain in the current location. |
