Draft Air Quality Bylaw and Statement of Proposal

 

The Relationship Manager, Local Board Services, was in attendance to support this item.

 

Resolution number UH/2017/17

MOVED by Member N Mayne, seconded by Member U Balouch:  

That the Upper Harbour Local Board:

a)      agree to provide the following feedback on the draft Air Quality Bylaw for Indoor Domestic Fires in writing by 3 April 2017, and/or by attending the local board hearings session on 19 April 2017:

          i)         support the use of a bylaw to re-establish the regulations for indoor domestic fires that were in the Auckland Council Regional Plan: Air, Land and Water 2010;

          ii)        support the definition of the urban zone, as outlined by the Unitary Plan and the Auckland Council District Plan: Hauraki Gulf Islands, to define the Auckland Urban Air Quality Area;

          iii)       support reinstatement of the former Regional Plan rules, as identified in the report to the Regulatory Committee on 9 February 2017 at Table 2; and

          iv)       support further investigation of regulatory measures around restricting the use of prohibited fuels in domestic burners.

Local board six-monthly update 1 July to 31 December 2016

That the Upper Harbour Local Board:

a)      receive the Panuku Development Auckland update for the six month period, 1 July to 31 December 2016;

b)      request an update about the Housing for Older People utilisation in the Windsor Park Village; and

c)      request an update at a workshop on the Airfields Development in Hobsonville Point.

That the Upper Harbour Local Board:

a)         exclude the public from the following part(s) of the proceedings of this meeting. The general subject of each matter to be considered while the public is excluded, the reason for passing this resolution in relation to each matter, and the specific grounds under section 48(1) of the Local Government Official Information and Meetings Act 1987 for the passing of this resolution follows. This resolution is made in reliance on section 48(1)(a) of the Local Government Official Information and Meetings Act 1987 and the particular interest or interests protected by section 6 or section 7 of that Act which would be prejudiced by the holding of the whole or relevant part of the proceedings of the meeting in public, as follows:

The public conduct of the part of the meeting would be likely to result in the disclosure of information for which good reason for withholding exists under section 7.

s7(2)(c)(ii) - The withholding of the information is necessary to protect information which is subject to an obligation of confidence or which any person has been or could be compelled to provide under the authority of any enactment, where the making available of the information would be likely to damage the public interest.

In particular, the tender process, including negotiations, are ongoing. The commercial details were received in a closed tender and are subject to an obligation of confidence until a decision has been made on the successful operator. Council intends to negotiate the exact terms and conditions of the contract up until the contract is entered into.

Project 17: Auckland Council maintenance contracts

 

The General Manager and Head of Contracts and Supplier Management, Community Facilities, were in attendance to support this item.

That the Upper Harbour Local Board:

a)      receive and endorse the principals included in the Project 17: Auckland Council maintenance contracts report as captured in:

i.    Standard and Enhanced Assets (Attachment C of the agenda);

ii.   Full Facilities Contract Service Specifications (Attachment D of the agenda); and

iii.  Supplier Specific Information (confidential Attachment E of the agenda).

b)      note that the local board will have the opportunity, in April and May, to discuss and refine local service level variations.
