Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

 

“An item that is not on the agenda for a meeting may be dealt with at that meeting if-

 

(a)        The local authority by resolution so decides; and

 

(b)        The presiding member explains at the meeting, at a time when it is open to the public,-

 

(i)         The reason why the item is not on the agenda; and

Burial ground

Te take mō te pūrongo / Purpose of the report

1.       To seek the Ngāti Whātua Ōrākei Reserves Board’s support in principle for the proposal to create a new burial ground on the Whenua Rangatira on a site adjacent to the old nursery to the north east of the dining room.

 

Ngā tūtohunga / Recommendation/s

That the Ngāti Whātua Ōrākei Reserves Board:

a)      approve in principle the proposal to create a burial ground on the site indicated in Figure 2 of the agenda report (adjacent to the old nursery to the north east of the dining room) subject to this site being supported by the Ngāti Whātua Ōrākei Trust and completion of the necessary statutory processes.

b)      note that a further report will be presented to the Ngāti Whātua Ōrākei Reserves Board regarding the details of statutory processes for creation of a burial ground, including stages and timing.

 

Horopaki / Context

2.       The existing burial ground in Ōkahu Bay is prone to flooding. This problem is becoming steadily worse, with more frequent and severe flood events. The site is also subject to tidal groundwater incursion. Flood risk modelling indicates that these problems will be exacerbated in future with the effects of climate change and sea level rise.

3.       The models shown in Figure 1 show the effect of sea level rise.  They do not take into consideration the impacts of climate change.  It is predicted that the adverse weather conditions that used to occur sporadically will occur more frequently.  This suggests that where flooding and storms were annual or freak events, they will now become more frequent and intense.  This is likely to result in further flooding on the current burial ground.  It is not guaranteed that the new pumps that have been installed in at the burial ground will be able to cater for these occurrences.

If there is a 1m sea level rise, this map below shows the impact on the burial ground.  The burial ground will be under water but the road will still be above water.

If there is a 2m sea level rise, this map below shows the impact on the burial ground.  It will be completely under water as will Tamaki Drive.

4.       The existing burial ground has space available however the environmental, cultural, health and safety impacts associated with the flooding conditions have necessitated the need for an alternative site for a burial ground.

5.       Ngāti Whātua Ōrākei therefore wishes to establish a burial ground on higher ground on the Whenua Rangatira.

6.       The preferred site has been selected by the Ngāti Whātua Ōrākei Taumata Kaumatua (Council of Elders).  The letter of support from the Chair of the Taumata Kaumatua is included as attachment A.

7.       Figure 2 shows the approximate site preferred for the burial ground.

8.       The need for a new burial ground is clear as the existing site has become untenable.

9.       It is appropriate that the location for a replacement be determined in the first instance by the Taumata Kaumatua of Ngāti Whātua Ōrākei.

10.     The site selected as the preferred choice of the Taumata Kaumatua is considered appropriate on the basis of its proximity to the marae, accessibility, and absence of flood risk.

11.     Establishment of a burial ground will involve a number of statutory processes. If the decision in principle is agreed, the Technical Officer will to determine the precise nature of the required processes and report back to the Board.

Ngā ritenga ā-pūtea / Financial implications

12.     There are no financial implications to this preliminary decision. There will be costs associated with the statutory processes and there may be a need to employ contract support to help manage the process.  As it is proposed that this site is intended to be managed primarily by Ngāti Whātua Ōrākei for whanau burials, it is appropriate that this is largely funded by Ngāti Whātua Ōrākei.  


 

Ngā koringa ā-muri / Next steps

13.     If approval in principle for the proposed new burial ground sited on part of the upper whenua adjacent to the old nursery to the north east of the dining hall is approved then the following steps will need to occur:

·        support for the location be obtained from the Ngāti Whātua Ōrākei Trust

·        a process and timeline establishment of the burial ground will reported to the reserves board for further consideration.  This will include a decision in relation public notification, communication messages, the role of the reserves board in hearing and deciding on the proposed new burial ground.

Quarterly report and general update

Te take mō te pūrongo / Purpose of the report

1.       To update the Ngāti Whātua Ōrākei Reserves Board (reserves board) on the operational and capital work programmes for the Whenua Rangatira and Pourewa Creek Recreation Reserve.

 

Ngā tūtohunga / Recommendation/s:

That the Ngāti Whātua Ōrākei Reserves Board:

a)      approve the payment of $35,000 for the Bastion Point 40th anniversary celebrations.

Financial summary

2.       An overview of the operational and capital expenditure as at 30 March 2017 is included below. 

3.       There is a year to date net operating surplus of $85,915.  This is due to costs associated with maintenance works carried out by Ventia not settling to the correct account.  This is expected to be rectified by year end.  It is also due to an outstanding payment of $35,000 for the Bastion Point 40th anniversary events.  This project has been discussed on several occasions (see previous resolutions below).  Formal approval for the remaining payment is requested in this report. 

·        Nov 2016: “request staff to explore external sponsorship opportunities for the 40th anniversary of Bastion Point.”

·        Feb 2018: “note that the previously reported over allocation of the 2017/18 operational budget has been addressed by reducing the unscheduled maintenance budget ($30,000) and adding a budget for events revenue ($2,639).”

4.       It is expected operating expenses will be on track/to budget by year end. 

5.       Expenditure of the capital works budget is behind plan.  Updates on all projects are included in this report.  The substantive capital works project is the Pourewa Nursery.  This is being led by Ngāti Whātua Ōrākei and funding will be transferred to Ngāti Whātua to offset expenses to date and cover remaining expenses for this project.  This payment is supported by the following resolutions previously passed by the reserves board:

·        August 2017 “contribute $245,000 of capital funds towards phase one of the Pourewa Creek Recreation Reserve Nursery Development Proposal…”

·        Nov 2017 -  “confirm budget for the nursery development at $245,000, to be funded from capital development carried forward and 2017-18 capital development budget”

·        Feb 2018 – “note that the capital budget of $245,000 allocated to the nursery development at Pourewa has been offset by reallocating all funds from the Pou stage II project ($200,000) and reallocating some funds ($45,000) from the Mahuhu ki te Rangi waka housing project”

Capital project update

Nursery

7.       At time of writing, work to prepare a resource consent application for the nursery is virtually complete. The only outstanding matter is to finalise the geotechnical / engineering analysis.  This work is due for completion in the second week of June, at which time the resource consent application will be submitted.

8.       Preparation of the resource consent has been delayed owing to difficulties accessing the site for survey purposes. It was originally hoped to have the resource consent submitted early in the year.

9.       The layout plan for the nursery development is given in Attachment A.

10.     Preparatory work on procurement is underway, so that contracts for physical works may be awarded immediately upon receipt of resource consent.

Kohimaramara Pou (Pou Marking - Stage I)

11.     As previously reported, on the 13 September 2017, whilst contractors were installing the base of the pou, the base collapsed.  The concrete was hand bucketed into the base shell however the base material did not have enough internal structural strength to deal with the lateral pressure of the concrete pour. 

12.     A dispute as to where liability for this lies is as yet unresolved.

13.     It appears that the original commissioned artwork (pou) is unrecoverable, so pending resolution of the liability dispute; the intention is to commission a fresh work.  Should the dispute prove irreconcilable, Ngāti Whātua Ōrākei will replace the artwork at original budget cost

Recreation Facilities at Ōkahu Bay

14.     The BBQ and picnic table proposed for Ōkahu Bay are consented.  The BBQ and picnic table assets are purchased and ready for delivery.   A quote has been received from a local, whanau based supplier, which is competitive and has been accepted. 

15.     There have been some delays in getting this supplier on board due to Council’s undertaking to sub-contract through Ventia (the primary full facilities contractor for the Ōrākei area) however project management staff are now working with the local supplier directly and the works are expected to be completed in the coming months (subject to weather).

18.     An update will be provided at the meeting.

Master plan

19.     Stage 1 (research) of the project is complete and three reports have been produced.  These are:

a)   User Research Report: Based on a series of interviews and quantitative analysis of survey data. The report identifies 4 key themes: The Psyche of Connection, The Physically Embodies Culture, Identity Grown from the Whenua, and Whanau vs. Manaakitanga. Within these themes are recommendations relating to organisational structures as well as physical development.

b)   Narrative Guide Report: Provides recommendations on developing and expressing the key cultural narratives of Ngāti Whātua Ōrākei in a coherent and consistent manner, and in physical (e.g. pou marking) as well as transactional (e.g. storytelling) means.

c)   Futures Research Report: Scopes likely and potential future contextual developments, such as new technologies, climate change and behavioural shifts (e.g. decentralisation) which may affect activities of the Hapu and development of the whenua.

20.     The findings of stage 1, together with landscape analysis, have been used to develop concept plans.  In the first instance the methodology has been used to develop plans for Pourewa. The next stage is to extend this work to cover the Whenua Rangatira.

21.     The Pourewa Concept Plan have been presented to, and endorsed by, the governing bodies of Ngāti Whātua Ōrākei.

22.     It is anticipated that work to complete the concept plan for the Whenua Rangatira will be complete by September 2018 (thus completing the master planning exercise).

23.     Following this, the intention is to review the statutory Reserve Management Plans to embody the designs of the masterplan.

Planting

24.     The Ōkahu Rakau are preparing for "Community Matariki Planting Day". This year we have chosen to plant the Hapimana gully. Since January 2017 Ōkahu Rakau has reviewed areas of the Whenua, where the contours of the land have changed due to years of compacting and water retention. There are certain areas where it is no longer safe to maintain the whenua via machines (tractor / ride on mowers). So these are the areas the Ōkahu Rakau team are now looking to plant to reduce the maintenance risks.

Maintenance program

 

25.     Currently the maintenance program is under review.  This is in light of the discussions about rationalising maintenance with Ventia and also the proposed increase in the funding and scope of works undertaken at Pourewa.

26.     A massive pest weed control effort has been underway using black composting sacks and blue bins.

27.     Pest animal control has increased.  The Ōkahu Rakau team are catching rats on a daily basis and were informed that a stout has been caught in the Kepa Bush recently.

28.     Dotterels are back nesting on the whenua.

29.     Wasps nests have also been found on the Whenua Rangatira and an exterminator has been bought into deal with these.

Flooding

 

30.     Over May we had a lot of bad weather which has caused flooding in the areas listed below. This is becoming more difficult to maintain each winter and will need to be addressed through future design.

·        Ōkahu Bay Domain (Watene Cres side of park)

·        Kitemoana Street (over flow from man hole by the bush track)

·        Whenua Rangatira (retaining water, boggy areas all over)

·        Michael Joseph Savage (retaining water, hill side is very slippery)

 

Sewage overflow

 

31.     On 24 May 2018, Ōkahu Rakau reported to Auckland Council a sewage spill / overflow on the Mission Bay stairs. It is believed to be due to the amount of rain during the week. 

Renewal of structures 

32.     A number of assets are in need of renewal.  Ōkahu Rakau are working with Auckland Council to see what can be addressed via renewals funding and what should wait until the master plan is complete. 

·        Chain fence on Hapimana street is broken and dilapidated due to age and neglect

·        White fence on Hapimana street

·        Bollards at Ōkahu and Whenua Rangatira are overdue for replacement

·        Fence on Kitemoana Street to be replaced which will to reduce dumping.

33.     Parking and buses are a concern on Hapimana street. There is a need for more off road parking areas (e.g. Hapimana berm) or reducing access to the top of Hapimana Street. Part of this area is outside of the Whenua Rangatira however options for addressing this will be considered through the master plan and discussed with the local board. 

Events

34.     There have been no public events facilitated on the Whenua Rangatira over the last quarter.

Health and Safety

35.     There are many PCBU’s (person conducting business or undertaking) operating on the Whenua Rangatira and Pourewa Creek Recreation Reserve. The PCBU carrying out the most activity is Ōkahu Rakau being a business of Ngāti Whātua Ōrākei.  Ventia provide some services and other businesses are occasionally employed to carry out work.  The following incidents have been recorded over the last few months from Ōkahu Rakau:

·        February 2018 – 1

·        March 2018 – 2

·        April 2018 – 2

36.     All were minor incidents with no medical treatment required.  First aid was administered where appropriate.

37.     An unauthorised party was held up at Michael Savage memorial, one of the attendees suffered a medical condition which led to his death. Police and the coroner attended to the incident and an Ōkahu Rakau staff member/member of the iwi assisted.

 

38.     No other incidents have been received and there have been no notifiable incidents.
