Standing Order 7.7 provides for deputations. Those applying for deputations are required to give seven working days notice of subject matter and applications are approved by the Chairperson of the Manukau Harbour Forum. This means that details relating to deputations can be included in the published agenda. Total speaking time per deputation is ten minutes or as resolved by the meeting.

Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
“An item that is not on the agenda for a meeting may be dealt with at that meeting if-

(i) The reason why the item is not on the agenda; and
(ii) The reason why the discussion of the item cannot be delayed until a subsequent meeting.”
Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
“Where an item is not on the agenda for a meeting,-
(a) That item may be discussed at that meeting if-
(i) That item is a minor matter relating to the general business of the local authority; and
(ii) the presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

Re-establishment of Manukau Harbour Forum Joint Committee for the 2019-2022 term

Purpose of the report
1. To re-establish the Manukau Harbour Forum joint committee (the Forum) adopting a terms of reference and to note the resolutions from the nine-member local boards supporting the re-establishment of the Forum.

Executive summary
2. Nine local boards (Franklin, Mangere-Otahuhu, Manurewa, Maungakiekie-Tamaki, Otara-Papatoetoe, Papakura, Puketapapa, Whau, and Waitakere Ranges) together initially formed the Manukau Harbour Forum during the 2010-2013 term and has since been reconstituted each term.
3. The nine boards have again each resolved to re-establish the Forum for this 2019-2022 political term.
4. Being formally constituted as a joint committee enables the Forum to conduct more efficiently the local boards’ business relating to the Manukau Harbour, as the Forum can make decisions and provide officer direction, without seeking confirmation and/or ratification from the member boards.
5. Each member board has appointed one member plus an alternate to represent the board on the Forum.
6. This report proposes:
· The Terms of Reference (Attachment A) for the Forum, which set out the purpose and principles of the Forum and incorporates direction from the last Forum to establish a second Co-Chair role and invite the involvement of two Governing Body members, one of which was to be a Co-Chair. The updated Terms of Reference were reported to and agreed by the member boards earlier this month and have since had minor grammatical and layout changes only.
· The Forum sets its first business meeting and workshop date for 2020.
Recommendation/s That the Manukau Harbour Forum: a) note the resolutions from the nine-member local boards which re-establish the forum and advise of representation. b) adopt the terms of reference, which sets out the purpose and principles of the Manukau Harbour Forum as confirmed by the nine local member boards. c) agree to meet quarterly for business meetings and monthly for workshops for the 2019-2022 term.

Context
7. Nine local boards (Franklin, Mangere-Otahuhu, Manurewa, Maungakiekie-Tamaki, Otara-Papatoetoe, Papakura, Puketapapa, Whau, and Waitakere Ranges Local Boards) together formed the Manukau Harbour Forum with the view to form a means of collective local board advocacy on common issues affecting the Manukau Harbour and the adjacent foreshore.
8. The Manukau Harbour Forum was constituted formally as a joint committee of local boards under standing orders 2.8.1 and 2.8.2 (standing orders 2.8.1 and 2.8.2 enable a local board to appoint a joint committee with another local board or boards).
9. Being a joint committee enables the Forum to conduct business more efficiently, as a local board joint committee can make decisions and provide direction to officers without seeking confirmation and/or ratification from the individual member boards.
10. The Terms of Reference for the Manukau Harbour Forum are presented in Attachment A. They set out the purpose and principles of the Forum. Individual local boards were asked to endorse the Terms of Reference earlier this month. The Forum is strategic rather than operational and has no budgetary decision-making delegation.

Analysis and advice
Manukau Harbour Forum governance and management support review report (2019)
11. During the 2016/19 term of the forum a review was undertaken of the role of the forum in order to recommend a decision-making structure that will enable the objectives relating to the Manukau Harbour to be addressed effectively.
12. The review recommended the continuation of the forum whilst also identifying that the forum is failing to achieve its vision and must be strengthened and appropriately resourced to deliver on the vision. The failure was found to be a combination of factors, including:
· inadequate resourcing through the current funding model and inadequate staffing resource
· lack of understanding of the health of the catchment and harbour, and absence of long-term integrated strategic planning
· lack of clear rationale or resourcing for mana whenua involvement
· a local board-focused work programme that does not address larger scale strategic issues.
13. The forum endorsed the key recommendations of the review at its meeting on 30 August 2019. The forum also resolved to invite Governing Body involvement via two councillor representatives to be appointed to the forum when reconstituted following the 2019 local body elections, including one as co-chair, and retaining local board membership as is. (Resolution number MHFJC/2019/29).
14. At the request of the Forum staff have amended the Manukau Harbour Forum Terms of Reference (Attachment A) to include two Governing Body representatives once of which is to be identified as a Co-Chair.
15. The past Chair and Deputy Chair of the Forum presented the report to the Environment and Community Committee on 10 September 2019, which resolved (Resolution number ENV/2019/146) to refer the recommendations and review report:
· to a workshop of the relevant committee in the new term of council
· to the Auckland Plan Strategy and Research department for evaluation and advice in the new term of council.
Terms of reference
16. Each of the member boards have individually considered the revised terms of reference, which sets out the Forum’s purpose and principles (attachment A). This report recommends that the Forum adopt the Terms of reference.
Meeting frequency
17. It is recommended that the Forum meet quarterly for business meetings and for workshops. Meetings are initially proposed for a 12:00pm start on the third Friday of the month and workshops at 9.30am prior to these meetings.
18. Officer support for meetings and workshops will be provided to the Forum via Environmental Services and Local Board Services.
19. The recommendations contained in this report fall within the Forum’s delegated authority.

20. Whilst the Forum seeks to actively respond to Climate impact matters this report is a Governance focused report that has no direct impact in itself.

Council group impacts and views
21. The Manukau Harbour Forum requires officer support to achieve its objectives. A relationship manager, democracy advisor and a local board advisor along with staff from Infrastructure and Environmental Services will support the meetings and ensure that other Auckland Council officers respond to the committee’s resolutions in a timely and appropriate manner.
22. In August 2019 the Forum has referred the recommendations and report from the 2019 review of the forum to the Governing Body for their consideration, which could result in resourcing impacts for the organisation if these are progressed.

23. All of the Manukau Harbour Forum member boards have considered and endorsed the terms of reference. A copy of relevant resolutions from the nine member boards is attached to this report (attachment B).

Māori impact statement
24. The Manukau Harbour Forum recognise mana whenua interest in Manukau Harbour
25. The forum is committed to Te Tiriti o Waitangi/The Treaty of Waitangi, and it will work actively to ensure that it also acknowledges and recognises the interests of mana whenua through continued development of an open relationship with mana whenua.
26. While the forum did discuss a joint committee with mana whenua, or mana whenua representatives being appointed to the forum, it was agreed that this was inappropriate while treaty negotiations are pending. The forum anticipates receiving further advice and options as to how it interfaces with mana whenua as treaty settlement progresses.
27. Workshops of the Manukau Harbour Forum were held in 2015 to discuss the ongoing role of mana whenua in relation to the forum. Some minor changes were made to the forum’s Terms of Reference as a result of this to reflect the forum’s obligations under Te Tiriti o Waitangi/The Treaty of Waitangi, and its desire to work with mana whenua on an ongoing basis.

Financial implications
28. The forum has $70,000 allocated to it by members boards for the 2019/20 work programme. $48,000 has already been allocated as outlined below with the remaining balance to be given direction to by incoming members:
i) Delivery of a youth leadership sustainability wanānga ($15,000)
ii) Communications support ($10,000)
iii) Support for the Southern Auckland youth Environmentalists ($5,000)
iv) Enabling Seaweek volunteer action across the Manukau Harbour ($18,000).
29. Member boards will be asked to continue their funding support to the forum for the triennium.
30. Acquiring adequate resourcing and operational support for delivery of activities within the Manukau Harbour is an action for the forum.
31. To achieve the objectives of the Forum wider regional funding and project delivery from Auckland Council and Council Controlled Organisations will be required. Furthermore, support will likely be required through Central Government to fully achieve aspirations.

Risks and mitigations
32. There are no significant risks from reconstituting the forum. Any issues arising from the forum can be mitigated through operational management of the forum.

Next steps
33. Arrangements for the meetings of the forum will be made once the forum is reconstituted, and staff will progress the Governing Body’s consideration of the review recommendations.
34. A workshop is proposed to be held with Delegates, Alternates and key supporting staff in developing a three-year framework for the Forum.

Election of Manukau Harbour Forum co-Chairperson from local board delegates

Purpose of the report
1. In accordance with Schedule 7, clause 21(5)(b) of the Local Government Act 2002, the Relationship Manager, on behalf of the Chief Executive, will call for nominations for the election of a co-Chairperson of the Manukau Harbour Forum (the Forum) from local board member delegates.

Executive summary
2. As a Joint Committee the Forum must elect a member to the position of Chairperson at the first meeting following a triennial general election of members. The Terms of Reference of the Forum note that there are co-chair roles for the Forum with one being appointed by the local board delegates and one by the Governing Body. This first meeting will enable the election of the local board appointed co-Chairperson of the Forum.
3. The election must be in accordance with Schedule 7, clause 25 of the Act. Note that no member has a casting vote.
4. The Forum will need to determine (by resolution) what method they will apply to elect the co-Chairperson – System A or System B.
Schedule 7, Part 1, Clause 25 of the Local Government Act 2002 states that:
25 Voting systems for certain appointments
(1) This clause applies to -
(a) the election or appointment of the chairperson and deputy chairperson of a regional council; and
(b) the election or appointment of the deputy mayor; and
(c) the election or appointment of the chairperson and deputy chairperson of a committee; and
(d) the election or appointment of a representative of a local authority.
(2) If this clause applies, a local authority or a committee (if the local authority has so directed) must determine by resolution that a person be elected or appointed by using one of the following systems of voting:
(a) the voting system in subclause (3) (system A):
(b) the voting system in subclause (4) (system B).
(3) System A -
(a) requires that a person is elected or appointed if he or she receives the votes of a majority of the members of the local authority or committee present and voting; and
(b) has the following characteristics:
(i) there is a first round of voting for all candidates; and
(ii) if no candidate is successful in that round there is a second round of voting from which the candidate with the fewest votes in the first round is excluded; and
(iii) if no candidate is successful in the second round there is a third, and if necessary subsequent, round of voting from which, each time, the candidate with the fewest votes in the previous round is excluded; and
(iv) in any round of voting, if 2 or more candidates tie for the lowest number of votes, the person excluded from the next round is resolved by lot.
(4) System B -
(a) requires that a person is elected or appointed if he or she receives more votes than any other candidate; and
(b) has the following characteristics:
(i) there is only 1 round of voting; and
(ii) if 2 or more candidates tie for the most votes, the tie is resolved by lot.
Recommendation/s That the Manukau Harbour Forum: a) select either System A or System B of Schedule 7, Part 1, Clause 25 of the Local Government Act 2002, to elect a co-Chairperson for the Forum from local board delegates for the 2019 - 2022 political term. b) seek nominations and elect a co-Chairperson from local board delegates for the 2019 - 2022 political term.

Approval of part-time Manukau Harbour Forum Coordinator project for delivery as part of the 2019/20 Manukau Harbour Forum work programme

Purpose of the report
1. To give approval of a fixed term part-time Manukau Harbour Forum Coordinator role and the allocation of $22,000 for its delivery as part of the 2019/2022 Manukau Harbour Forum work programme report.

Executive summary
2. The total budget received from member local boards for work programme allocation in 2019-20 is $70,000. Eight of the nine member local boards allocated $8,000 towards the forum’s work programme. The Franklin Local Board resolved to allocate $6,000 as the projects for the work programme had not yet been confirmed.
3. Of the $70,000 allocated to it by members boards for the 2019/20 work programme. $48,000 has already been allocated as outlined below.
i) delivery of a youth leadership sustainability wanānga ($15,000)
ii) communications plans ($10,000)
iii) support for the Southern Auckland Youth Environmentalists ($5,000)
iv) enabling Seaweek volunteer action across the Manukau Harbour ($18,000).
4. A balance remains of $22,000 to be allocated for delivery in the remainder of this 2019/20 financial year and this report proposes a coordinator role funded by this balance.
Part-time Manukau Harbour Forum Coordinator
5. This report is recommending the 2019-20 work programme balance of $22,000 be allocated to the role and support budget of a fixed term part-time Manukau Harbour Forum Coordinator.
6. The labour component is based on $80 / hour for 8 – 10 hours per week for the remaining 24 weeks of the financial year - $15,500 - $19,200. The balance being support for associated mana whenua and other engagement activities.
7. Appointment and ongoing management of the role would be provided by the Auckland Council Healthy Waters team and Wai Ora Partnerships.
8. The 2019 Manukau Harbour Forum governance and management support review resulted in a total of 18 recommendations which focus on long-term and short-term actions. These recommendations are summarised into the following themes:
· continuation of the Manukau Harbour Forum
· engagement and development of relationships with mana whenua
· comprehensive and ongoing stocktake of activities within the Manukau Harbour
· acquiring adequate resourcing and operational support for delivery of activities within the Manukau Harbour
· expansion of the forum membership to better align with Auckland Council’s Governing Body
· preparation of an integrated state of the harbour report to enable the development of an outcomes focussed strategic plan and programme of works.
9. To assist with progressing matters from the review it is recommended that a part-time Manukau Harbour Forum Coordinator be appointed to work with the Forum to support the delivery of their vision:
The Manukau Harbour is recognised and valued as a significant cultural, ecological and economic asset, and through integrated management has a rich and diverse marine and terrestrial environment that is able to be enjoyed by all.
10. They will assist with planning a work programme, project identification, management, administration and ensure the recommendations from the governance review of the forum are delivered.
11. The coordinator will also work with the forum to develop a plan for mana whenua engagement which should be co-developed with willing mana whenua entities.
Recommendation/s That the Manukau Harbour Forum: a) approve the allocation of $22,000 from the Manukau Harbour Forum 2019/20 work programme to fund and support a fixed term part-time Manukau Harbour Forum Coordinator.
