2.       John Tupper on behalf of Robyn Clerk, John Tupper, Judy Johannessen, Simon Taylor and Jo Larkin, residents of Jellicoe Parade and Wellington Road, is making a presentation to the Waiheke Transport Forum on the re-establishment of the "request stop" of the aforementioned streets which has been deleted from the new bus timetable.

3.       The correspondence from the deputation is included in this agenda report as Attachment A.

8          Extraordinary Business

 

Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

 

“An item that is not on the agenda for a meeting may be dealt with at that meeting if-

 

(a)        The local  authority by resolution so decides; and

 

(b)        The presiding member explains at the meeting, at a time when it is open to the public,-

 

(i)         The reason why the item is not on the agenda; and

 

(ii)        The reason why the discussion of the item cannot be delayed until a subsequent meeting.”

 

Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

 

“Where an item is not on the agenda for a meeting,-

 

(a)        That item may be discussed at that meeting if-

 

(i)         That item is a minor matter relating to the general business of the local authority; and

Purpose of the report

1.       To provide guidance to members of the Waiheke Transport Forum on the background to the forum and procedural matters.

2.       At its meeting on 4 December 2020, the Waiheke Local Board resolved the following:

MOVED by Deputy Chairperson B Upchurch, seconded by Member R Tucker:  

That the Waiheke Local Board:

a)      establish the Waiheke Transport Forum as a sub-committee of the Waiheke Local Board for the 2019/2022 term of the local board.

b)      appoint Deputy Chairperson Upchurch and Member Tucker of the Waiheke Local Board to the Waiheke Transport Forum.

c)      appoint the local Station Commander of the Waiheke Police station ex officio to the Waiheke Transport Forum.

d)      provisionally appoint the Auckland Transport Local Board Relationship Manager ex officio to the Waiheke Transport Forum pending the appointment of the proposed Auckland Transport Operations Manager for Waiheke, upon which the proposed Auckland Transport Operations Manager for Waiheke shall be appointed ex officio to the Waiheke Transport Forum as the Auckland Transport representative.

e)      request Local Board Services staff to implement a recruitment process in 2020 for local community representatives, subject to the board approving the terms of reference. 

3.       The Waiheke Transport Forum will provide advice and input on transport matters and initiatives which fall within the remit of Auckland Transport for the Waiheke Local Board area.

4.       Officer support will be provided for the inaugural meeting on the process for election of the chair and deputy, the size of the quorum, selection of meeting dates and advance notice of agenda items.

Context

5.       This report provides procedural information to guide the new members of the Waiheke Transport Forum (the forum), in deciding on procedural matters.

6.       The forum can consider transport-related actions, improvements, proposals and initiatives associated with roading, cycling, walking, horse-riding, ferries, wharves, and coastal matters which fall within the statutory scope of Auckland Transport. Regional transport initiatives which may have an impact on the islands and seas of the Waiheke Local Board area can also be considered. A map of the area under the jurisdiction of the Waiheke Local Board is included in this report as Attachment A. The forum can also identify and refer actions for the Waiheke Ten Year Transport Plan and consider strategies for meaningful community engagement on transport matters. The terms of reference for the forum are contained in Attachment B.

7.       The forum is mentioned as an action in the signed Memorandum of Understanding which seeks to extend the boundaries of the working relationship between Auckland Transport and the Waiheke Local Board. The document, which is attached to this agenda report as Attachment C, states in paragraph 18:

“AT agrees to support the board by providing an active representative on the Waiheke Transport Forum and supporting the forum with timely, active information as required.”

A report on the first review of the Memorandum of Understanding is included in this agenda report as Attachment G.

 

8.       The forum’s transport role is also informed by Essentially Waiheke, the island’s strategic framework developed with the Waiheke community and adopted by the board. Essentially Waiheke contains clear aspirations for a transport network that fits the island’s character and needs. The relevant section of Essentially Waiheke is included in this agenda report as Attachment D.

9.       The forum is an official subcommittee of the Waiheke Local Board and as such must use Waiheke Local Board standing orders, a copy of which is attached as Attachment E. Members should familiarise themselves with standing orders before the first meeting.

Election of Chairperson and Deputy Chairperson

11.     The chairperson and deputy chairperson of the forum will be elected meeting using System B from Waiheke Local Board standing orders, as cited in clause 1.11.1 page 23. In the interim, the deputy chair of the Waiheke Local Board will preside. Further advice on procedures for electing the chairperson and deputy chairperson will be provided at the business meeting on June 17, 2020.

Approval of meeting dates for 2020

12.     The previous forum met on a two-monthly basis at 5pm at the Waiheke Local Board office. The meeting needs to take place on the first or second week of the month to ensure that its recommendations can be submitted before the agenda closing date of the Waiheke Local Board which takes place on the fourth Wednesday of the month. At the first meeting of the forum, members will be asked to agree on a time and frequency for forum business meetings.

Establishment of accessibility representative

13.     Accessibility to footpaths, public transport, beaches and ferries is a key challenge on semi-rural Waiheke Island. A need has been identified for a representative on the forum to consider transport issues through an accessibility lens and to advocate for improved public access in the local board area. The board decided that the position of accessibility representative will be re-established on the forum, with applications considered as part general recruitment process. Don McKenzie was the applicant for the position.

Explanation of procedures affecting forum members

14.     The agenda will close two calendar weeks before the scheduled meeting date.

15.     Meetings will take place at the Waiheke Local Board Office using the standard Waiheke Local Board open agenda and will be open to members of the public, except when there is a confidential agenda.

16.     An agenda containing presentations from the public in the deputations section and staff reports on proposals in the reports section, will be circulated during the week before the meeting.

17.     The forum may resolve to exclude the public from a meeting. The grounds for exclusion are those specified in Section 48 of the Local Government Official Information and Meetings Act 1987 where:

·        discussion in open forum would be likely to result in the disclosure of information for which good reason for withholding would exist.

·        discussion in open forum would be contrary to the provisions of a specified enactment.

·        discussion in open forum would constitute contempt of court or of the House of Representatives.

·        the exclusion of the public from the whole or the relevant part of the proceedings of the meeting is necessary to enable the forum to deliberate in private on its decision or recommendation.

18.     Requests to speak at public forum may be accepted at the discretion of the chair before the meeting and each speaker may have up to three minutes to present, followed by questions from forum members.

19.     Each deputation can present for up to 10 minutes, with a maximum of two speakers, followed by questions from forum members. A proforma is available for those wishing to submit transport proposals to the forum as a deputation.

20.     Under standing orders, forum members cannot pass a resolution about a deputation, or public forum item, at the same meeting. However, members can call for additional information. After each presentation, members will discuss the benefits and risks of the proposal and can request additional information through the Relationship Manager (as representative of the Chief Executive) on topics such as project feasibility, costings, risks, or alignment with existing programmes. The information will be prepared for the next meeting of the forum and presented as a report on the agenda.

21.     Under the reports section of the agenda, members will consider transport project reports requested at previous meetings and can make resolutions to the Waiheke Local Board recommending specific actions for these projects.

22.     The chair may invite subject matter experts from the council, Auckland Transport, iwi and other organisations as required to advise on agenda items.

23.     A report will be submitted to the Waiheke Local Board after each forum meeting detailing matters for investigation and recommendations for approval by the local board.

24.     A quorum will be made up of five members and the chair will have a casting vote.

25.     The forum may consider transport proposals from the Waiheke community that have potential positive impacts on carbon emissions and recommend that these be approved by the board for action or advocacy.

Council group impacts and views

26.     Auckland Transport, as part of its agreement with the board in a signed Memorandum of Understanding, supports the re-establishment of the forum. It will be represented on the forum by Richard La Ville the Waiheke Operations Manager.

27.     Agreement has also been reached that the proposals presented at the forum can contribute to future updates of Waiheke’s approved Ten Year Transport Plan.

28.     Board members have indicated support for re-establishing the forum and believe that the transport forum would provide meaningful community input into transport matters on Waiheke.

29.     Development of transport initiatives on Waiheke is an area of interest for mana whenua and mataawaka. Consequently, minutes of the transport forum will be circulated to mana whenua representatives and to the Piritahi Marae Komiti.

30.     A mana whenua and/or mataawaka representatives will be invited to attend the transport forum when matters of interest are on the agenda.

Financial implications

31.     There is no budgetary allocation required for the transport forum and the forum has no delegated authority. Any financial resources required to support approved recommendations will be approved by the board from existing budgets.

32.     In order to promote a spirit of openness and transparency, staff will ensure that reports and community proposals are included on the business meeting agenda which is published at least one week before the meeting.

Next steps

33.       Members of the forum to decide upon a meeting schedule for the 2020/22 term, chair and deputy to provide an agreed structure for the two years ahead. In order to provide continuity with the previous transport forum, the action tracker from 2019 (Attachment F) and the minutes from the last meeting of the previous term (Attachment H) have been provided for the information of members.

Purpose of the report

1.       To seek input from the Waiheke Transport Forum to New Zealand Transport Agency’s (NZTA) Innovating Streets Pilot Fund for the Surfdale precinct.

Executive summary

2.       The Innovating Streets Pilot Fund is available for transport projects that make temporary or semi-permanent physical changes to urban streets, in advance of future permanent upgrades. The fund will provide councils with a 90 per cent funding assistance rate, as well as capability building support for successful applicants. Projects which support walking and cycling, and which include community representation are preferred.

3.       The Waiheke Local Board submitted a first-round expression of interest to the pilot programme for a project called “Re-imagining Surfdale precinct – co-design for improved safety, cycling and walking”.

4.       This project concerns co-design of the Surfdale precinct to improve safety and liveability for cyclists, pedestrians, residents, motorists and businesses from the western commencement of Hamilton Road through to Hooks Lane, encompassing three cul-de-sacs and an esplanade road/cycleway on the southern side.

5.       The roads in Surfdale have been pinpointed in multiple reports and through residents’ complaints as a significant safety hazard. In particular from the Surfdale Road left turn into Hamilton Road through to the Miami Avenue retail area.

6.       If the application is successful, there will be an opportunity for the transport forum to provide input to the full application to NZTA. The board’s expression of interest and the round two application form are included in this agenda report as Attachments A and B respectively.

Purpose of the report

1.       The purpose of this report is to inform the Waiheke Transport Forum of the proposal to develop a Transport Design Manual for the Waiheke Local Board area.

2.       According to the signed Memorandum of Understanding between Auckland Transport and the Waiheke Local Board, Auckland Transport agrees to work with the board to progress development of transport design guidelines which reflect the island’s character (as attached to the agenda report on Transport Forum meeting procedures)

3.       Inputs to the transport design manual include the following legacy documents which are attached to this agenda report as follows:

·    Waiheke Local Board feedback (dated 2015) into development of the Transport Design Guide for the Hauraki Gulf Islands (Attachment A).

·    Waitakere Ranges Urban Design Guidelines (Attachment B). Auckland Transport worked with the Waitakere Ranges Local Board to develop these guidelines which reflect the local character and specific requirements of the Waitakere Ranges.

·    The Waiheke Roading Strategy 1995 (Attachment C)

·    Auckland Transport  Roads and Streets Framework (Roads and Streets Framework and the Transport Design Manual)

·    Essentially Waiheke Refresh 2016 (as attached to the agenda report on Transport Forum meeting procedures)

4.      Members of the forum will be actively involved with Auckland Transport on the development of a Waiheke Transport Design Manual in the future.

Update on the Mātiatia Plan

Purpose of the report

1.       To update the Waiheke Transport Forum on the completion and implementation of the Mātiatia Plan.

Executive summary

2.       The development of Mātiatia as the principal gateway to the island is a critical transport issue for Waiheke. The Waiheke Transport Forum is a key stakeholder and a request will be made for input during the upcoming consultation process.

3.       A report on the completion and implementation of the Mātiatia Plan was on the agenda of the Waiheke Local Board’s 27 May 2020 business meeting agenda and is attached for the information of forum members as Attachment A.

4.       John Nash, Programme Manager Waiheke & Gulf Islands, will attend the 17 June meeting of the forum to give a presentation on the Mātiatia Plan.
