Purpose of the report
1. This report provides information and a summary of public submissions to assist the Hearings Panel to consider the granting of a proposed community lease to Sport Waitakere Trust, 545 Don Buck Road, Massey.

Executive summary
2. The Henderson-Massey Local Board approved a two-year lease with a two year right of renewal to Sport Waitakere Trust for the council owned site known as the ex-Massey Library, 545 Don Buck Road, Massey in August 2020.
3. The site is held in fee simple by Auckland Council under the Local Government Act 2002. Under Section 138 of the Act a local authority granting a lease for more than six months must consult on the proposal. Similarly, engagement with mana whenua is required under section 81 of the Act.
4. In September 2020, Auckland Council publicly notified the proposal to grant a community lease to Sport Waitakere Trust and invited submissions or objections from persons with an interest in the proposal.
5. The public submissions period closed 5 October 2020 and two submissions were received, one objection from Niutao Community Trust and one submission from Sport Waitakere Trust in support of the proposed community lease.
6. Both submitters requested to be heard in person at a hearing, scheduled for 16 February 2021.
Recommendation/s
That the Henderson-Massey Local Board Hearings Panel:
a) receive the report and information in relation to the granting of a new community lease to Sport Waitakere Trust at 545 Don Buck Road, Massey.
b) hear the submitters in relation to the granting of a new community lease to Sport Waitakere Trust at 545 Don Buck Road, Massey.
c) make recommendations to the Henderson-Massey Local Board on the outcome of its deliberations on the public submissions considered in relation to the granting of a new community lease to Sport Waitakere Trust at 545 Don Buck Road, Massey.

Context
7. The recommendation for a new community lease to Sport Waitakere Trust is based on an objective analysis of the applications, including local board plan criteria, local need, Auckland Council Community Occupancy Guidelines 2012 provisions (Attachment A) and the assessment of information provided by each applicant.

Analysis and advice
The site
8. The proposed leased area is known as the ex-Massey Library space and is part of the council owned Massey Leisure Centre and Library, 545 Don Buck Road, Massey.
9. The Massey Leisure Centre is managed by YMCA who are a facility-based service organisation operating across multiple sectors including youth, sports, recreation, outdoor education, accommodation, out of school care and early childhood education.
10. The ex-Massey Library space is approximately 939m2 and is mainly open plan with a smaller area providing separate offices, has structural pillars throughout, multi-level floors and exposed ceiling trusses. The basic kitchen and toilets are shared with the YMCA and members of the public who may utilise the facility on an ad-hoc basis.
11. The land is described as Lot 1 Deposited Plan 174335 comprising approximately 1.9 hectares (Attachment B) and is currently held in fee simple by the Auckland Council under the Local Government Act 2002.
Expressions of Interest Process
12. On 26 September 2019, Auckland Council invited expressions of interest from community groups and organisations interested in leasing the ex-Massey Library space. (Attachment C).
13. At the close of the expressions of interest process, applications from six community groups were received. All six applicants met the criteria of eligible applicants outlined in the Auckland Council Community Occupancy Guidelines 2012.
14. An analysis and assessment of the applications was undertaken by council staff. All six applicants were assessed using a tool (Attachment D) to rate a range of criteria including:
· the alignment with local board plan outcomes
· identified need and conversely, existing service provision in the locality
· organisational structure
· evidence of sound financial management
· partnership opportunities
· hours of use and staff numbers
· sharing opportunities.
15. The results of the staff assessment indicated Sport Waitakere Trust attained the highest score.
16. All applications were discussed with the Henderson-Massey Local Board at workshops held between February 2020 and June 2020.
17. On 18 August 2020, the Henderson-Massey Local Board approved, subject to public notification, the granting of a new community lease to Sport Waitakere Trust (Attachment E).
Sport Waitakere Trust
18. Sport Waitakere Trust was incorporated under the Charitable Trusts Act 1957 on 31 October 2005 and registered as a charitable entity under the Charities Act 2005 on 5 May 2008. Its purpose is to enable healthy and active lives in communities by providing programmes, workshops, activations, mentoring, resources, events and support at low to no cost to the community.
19. Sport Waitakere is currently operating from a temporary prefab of 300m2, located on the grounds of the Waitematā Rugby Football Club and pay a monthly ground lease.
20. Sport Waitakere is not membership based and is a group of organisations providing services to the wider community. The Trust has approximately 40 staff and approximately 28 volunteers. There are currently eight contractors/sporting organisation representatives sharing the temporary prefab space.
21. Sport Waitakere vision for the library space is to have a West Auckland regional sport and recreation hub incorporating the services of several sporting agencies, at a reasonable cost, allowing easy access for the community. These services will add substantial value to the existing services of YMCA Massey through wider partnerships and a unique youth hub.
22. Sport Waitakere wish to share the facility with YMCA to develop a youth hub and to offer opportunities for other community clubs and organisations who have little or no resource, as well as other services interested in supporting its concept.
23. Sport Waitakere indicated it will utilise between 600 square metres and 800 square metres with approximately 80-100 staff, visitors and youth visitors on site daily. Sport Waitakere anticipate the space will be utilised from Monday to Friday 7.00am to 6.00pm by Sport Waitakere and other sport and community organisations. From 3.30pm to closing and on weekends the space will be utilised by Sport Waitakere and other organisation running workshops, club development, community activities, YMCA Youth Hub, club volunteers and community meeting spaces. The remaining space of 140m2 will be utilised as activity/meeting space.
Niutao Community Trust
24. Niutao Community Trust was incorporated under the Charitable Trusts Act 1957 on 1 August 2001. There is a total of 44 volunteers and Niutao currently operate in the Henderson-Massey area. Niutao are a Tuvaluan community group who provide a platform for members to prosper culturally, socially and holistically. Membership is open with 1200 active members.
25. Niutao strength is in its art activities, which has seen them partner with the Auckland Museum, Creative New Zealand, Pacifica Arts Centre and Ministry of Pacific Peoples. Niutao has a women’s arts collective called Fafine Niutao/Aotearoa who have exhibited throughout New Zealand.
26. Niutao hold Tuvalu language week programmes that have been running for the last five years and focus on promoting its culture to young people. Since 2014 a reading club for kids of all ethnicities has been run at the Ranui Library and youth meet twice weekly for Tuvalu music at Massey Community Hub. Weekly volleyball events are held at Rutherford College.
27. In its application, Niutao indicated its plan to continue with the above activities and to include weaving, dance, language and vaka (canoe making) in the library space. Advocacy will be provided for Tuvaluan settlement in terms of immigration and social services and the large space could be co-shared for different groups within the Tuvaluan community for performance and cultural practices.
28. Niutao vision for the space is to promote cultural identity and be a vibrant place of belonging. It will be open to all community groups to use, where collaboration will happen between groups. Niutao see opportunities to work with migrant business owners, Maori entrepreneurs and current businesses including creative arts.
29. Niutao has indicated that the facility will be used immediately and are keen to work with Tangata Whenua, non-Pasifika, rainbow and other communities.
30. The space would be utilised by Niutao 40 hours per week. A further 20 plus hours would be used to optimise the space for sharing and collaboration with other pacific groups.
Public notification
31. Under Section 138 of the Local Government Act 2002, a local authority granting a lease for more than six months must consult on the proposal.
32. A public notice was placed in the Western Leader and on the Auckland Council website on 3 September 2020 inviting submissions or objections from persons with an interest in granting a new community lease to Sport Waitakere Trust (Attachment F). The closing date for submissions or objections was 5 October 2020.
33. Following public notification, one objection (Attachment G) and one submission (Attachment H) in support of the lease was received. Both submitters requested to be heard in person.
34. Public notification satisfies the requirements of the Local Government Act 2002 and the Auckland Council Community Occupancy Guidelines 2012 relating to issuing community leases.

37. On 16 February 2021 the Hearings Panel will hear from the objector and submitter and then make a recommendation to the Henderson-Massey Local Board on the outcome of its deliberations on the public submissions considered.

Māori impact statement
38. Mana whenua engagement is required under section 81 of the Local Government Act 2002. Consultation documentation on the proposed site had been provided to mana whenua in August 2019. No objections were raised.
39. The recommendation from the Hearings Panel will have no direct impact on Māori.

Financial implications
40. There are no costs associated with considering the recommendations of the Hearings Panel. If the Henderson-Massey Local board decide to rescind the earlier resolution to grant a community lease to Sport Waitakere Trust and to grant a community lease to another group, there will be additional advertising costs that will be met by the Community Facilities Department.

Risks and mitigations
41. If the Henderson-Massey Local board decide to rescind the earlier resolution, this will require a new public notification of the intent to grant a community lease. There is the potential for the disaffected group or other entity to lodge an objection and request to be heard further in this regard.

Next steps
42. This report recommends the Henderson-Massey Local Board receive the recommendation from the Independent Hearings Commissioner following a public hearing being held on 16 February 2021.
43. If there are no further decisions required staff will administer the decision of the board dated 18 August 2020 (resolution number HM/2020/110).
