b)      thank the Pohutukawa Coast Trails Committee for presenting their petition

c)      refer the petition to the Parks, Sport and Recreation department for advice and report back to the local board.

a)    thank Tim Kerwin, General Manager of Glenbrook Vintage Railway, Glen Deed, Board Chair, and Aaron Wong, Financial Administrator, for their attendance and presentation on projects underway with the Glenbrook Vintage Railway

b)    refer the presentation to Parks, Sport and Recreation and Community Facilities departments for advice and report back, particularly in relation to the extension of rail to Waiuku (Tamakae Reserve).

Adoption of the Franklin Local Board Agreement 2021/2022

 

Resolution number FR/2021/89

MOVED by Chairperson A Baker, seconded by Member A Cole:  

That the Franklin Local Board:

a)      adopt the local content for the 10-year Budget, which includes the Franklin Local Board Agreement 2021/22, the message from the chair, and local board advocacy which was tabled at the meeting

b)      adopt a local fees and charges schedule for 2021/2022 (Attachment B)

c)      delegate authority to the Chair to make any final changes to the local content for the 10-year Budget 2021-2031 (the Franklin Local Board Agreement 2021/22, message from the chair, and local board advocacy)

d)      note that the resolutions of this meeting will be reported back to the Governing Body when it meets to adopt the 10-year Budget 2021-2031, including each Local Board Agreement, on 29 June 2021.

Grant of new community leases in the Franklin Local Board area and the classification of Maraetai Drive Reserve.

That the Franklin Local Board:

a)      grant a new community lease to Auckland Manukau Dressage Group Incorporated pursuant to the Local Government Act 2002 for a portion of Clevedon Showgrounds Reserve, 107 Monument Road, Clevedon (Attachment A) for 10 years commencing 1 July 2021 with one 10 year right of renewal, rent of $1.00 plus GST per annum if requested

b)      grant a new community lease to Counties Manukau Kindergarten Association Incorporated for Clevedon Kindergarten pursuant to the Local Government Act 2002 at 14R Monument Road, Clevedon (Attachment B) for 10 years commencing 1 July 2021 with one 10 year right of renewal, rent of $1.00 plus GST per annum if requested

c)      grant a new community lease to Maraetai Bowling Club Incorporated pursuant to the Reserves Act 1977 at Maraetai Drive Reserve,160R Maraetai Drive, Maraetai (Attachment C) for 10 years commencing 1 July 2021 with one 10 year right of renewal and rent of $1.00 plus GST per annum if requested

i)       approve the classification of Maraetai Drive Reserve,160R Maraetai Drive, Maraetai being Lot 82 DP 46586 comprising 4065 square metres and contained in NA5C/230 as a recreation reserve

d)      grant a new community lease to Morris Register of New Zealand Auckland Branch Incorporated pursuant to the Local Government Act 2002 for a portion of Ngahere Road Scenic Reserve, 34 Ngahere Road, Pukekohe (Attachment D) for 10 years commencing 1 July 2021 with one 10 year right of renewal, rent of $1.00 plus GST per annum if requested

e)      grant a new community lease to Te Whānau Tupu Ngātahi o Aotearoa - Playcentre Aotearoa for Manukau Peninsula Playcentre) pursuant to the Reserves Act 1977 for a portion of Matakawau Domain Recreation Reserve, 2610 Awhitu Road, Matakawau (Attachment E) for 10 years commencing 1 July 2021 with one 10 year right of renewal and rent of $1.00 plus GST per annum if requested

f)       grant a new community lease to Waiuku Citizens Silver Band Incorporated pursuant to Section 73(3) of the Reserves Act 1977 for a portion of Massey Park, 2 Belgium Street, Waiuku (Attachment F) for 10 years commencing 1 July 2021 with one 10 year right of renewal, rent of $1.00 plus GST per annum if requested

g)      approve all other terms and conditions of the leases to be in accordance with the Auckland Council Community Occupancy Guidelines 2012 and the Reserves Act 1977 or Local Government Act 2002 depending on the status of the land

h)      approve Community Outcomes Plans for each lease (Attachments G, H, I, J, K and L) to be attached as a schedule to the agreements

i)       approve the grant of leases subject to public notification and iwi consultation where required and appoint a hearings panel of its members consisting of the Chair, Deputy Chair and a member from the relevant subdivision to consider and decide on any submissions received.

Local board views on a Notice of Requirement for a new secondary school and early childhood education centre at Jesmond Road, Drury West

 

Resolution number FR/2021/91

MOVED by Chairperson A Baker, seconded by Member M Bell:  

That the Franklin Local Board:

a)      provide local board views through Urgent Decision on the Notice of Requirement for a new secondary school and early childhood education centre at 401 Jesmond Road and part of 281 and part of 341 Jesmond Road, Drury West

b)      appoint the Local Board Chair to speak to the local board views at a hearing [if one is held] on the Notice of Requirement

c)      delegate authority to the chairperson of Franklin Local Board to make a          replacement appointment in the event the local board member appointed in          resolution b) is unable to attend the private plan change hearing [if one is held].

Delegation of feedback to be provided to the Establishment Unit Board of the City Centre to Māngere light rail project

That the Franklin Local Board:

a)      delegate the local board chair to provide feedback on behalf of the local board to the Establishment Unit Board of the City Centre to Māngere light rail project as required.

Urgent Decision by Franklin Local Board to provide feedback on the draft Freedom Camping submission

 

Resolution number FR/2021/93

MOVED by Chairperson A Baker, seconded by Member A Cole:  

That the Franklin Local Board:

a)    note the urgent decision made on 13 May 2021 providing the following feedback to the Auckland Council submission on proposed changes to the Freedom Camping Act 2011:

i)        support proposal one, whereby it would be mandatory for all freedom camping in a vehicle to be done in a certified self-contained vehicle so that freedom campers have access to proper toilet facilities at all times

ii)       does not support proposal two whereby it would be mandatory for freedom campers to stay in a vehicle that is certified self-contained unless they are staying at a site with toilet facilities noting that few areas have 24-hour public toilets. Most facilities at desirable freedom camping areas such as parks, beaches and town centres are closed overnight

iii)      does not accept the stated rationale, that ‘normal use’ of public conservation land means that visitors to regional parks would be familiar and comply with the traditional ‘backcountry code’ for remote areas (toileting a safe distance from tracks/waterways and burying waste).

iv)      supports proposal three, to improve the regulatory tools for government land managers and agrees that that people and organisations that undertake sanitary plumbing work on vehicles would be the most appropriate groups to be licensed to undertake and certify self-containment

v)       supports proposed amendments to improve proposal three as outlined within Auckland Council’s draft submission

vi)      supports proposal four, to strengthen the requirements for self-contained vehicles, including requiring toilets to be permanently plumbed

vii)     agrees that government should also take steps to clearly distinguish homelessness from freedom camping in the Freedom Camping Act 2011, to support public understanding and to guide compliance and enforcement staff

viii)    suggests that the term ‘freedom camping’ could be reframed as ‘responsible camping’ to reinforce expectations of those camping and those benefiting from camping

ix)      recognises that proposed changes to the Freedom Camping Act 2011 will improve the local experience, however continue to be concerned at the permissive, rather than permission based approach to enabling camping, noting that this approach creates unnecessary risk to the visitor experience as they are enabled to camp in areas that are not fit for purpose

x)        recommends that government works closely with the New Zealand Motor Caravan Association as the expert ‘user-group’ and New Zealand Plumbers Association as experts in appropriate toileting solutions to understand the practical implications of any Freedom Camping 2011 Act changes.
