10        Extraordinary Business

 

 

10.1

Extraordinary Business - Finalisation of local board input into Auckland Council’s submission on the Department of Internal Affair’s changes to Māori ward and Māori constituency processes

 

The board is required to submit their feedback on the Finalisation of local board input into Auckland Council’s submission on the Department of Internal Affair’s changes to Māori ward and Māori constituency processes by 25 August 2021.

The board considered this item at its 17 August Business Meeting, and deffered the item to the 24 August Community Forum for consideration.

 

 

Resolution number DTCF/2021/29

MOVED by Chairperson R Jackson, seconded by Member T Deans:  

That the Devonport-Takapuna Local Board Community Forum:

a)       consider an extraordinary item regarding local board input into Auckland Council’s submission on the Department of Internal Affair’s changes to Māori ward and Māori constituency processes at Item 11.1 of this agenda

 

            i.       the reason the matter was not on the agenda is that local board deffered the item to the 24 August Community Forum after the agenda was built.

 

          ii.       the reason for urgency is that local board feedback is due on 25 August 2021, which is prior to the next ordinary buisness meeting of the Devonport-Takapuna Local Board.

11        Consideration of Extraordinary Items

 

 

11.1

Finalisation of local board input into Auckland Council’s submission on the Department of Internal Affair’s changes to Māori ward and Māori constituency processes

 

The report on the Finalisation of local board input into Auckland Council’s submission on the Department of Internal Affair’s changes to Māori ward and Māori constituency processes was tabled. A copy has been placed on the official minutes

Resolution number DTCF/2021/30

MOVED by Member T Deans, seconded by Member G Wood:  

That the Devonport-Takapuna Local Board:

a)         supports in principal the draft ‘ Auckland Council Submission to the Discussion Document Changes to the Māori Ward and Constituency Processes’ (Attachment B), in particular:

i.       paragraph 4.13 in which Auckland Council would conduct its representation review using the updated Maori Electoral Population (MEP) and General Electoral Population (GEP) figures which are next due to be done in 2024.

b)        provides the following additional Devonport-Takapuna Local Board feedback to be appended to the Auckland Council submission, noting that this is required by 25 August 2021:

i.       notes that Auckland Council is unique in that it is subject to the Local Government (Auckland Council) Act 2009 (LGACA), which has not been fully considered in the discussion document.

ii.      notes that the provisions of the Local Government (Auckland Council) Act 2009 includes limits on the number of councillors permitted on Auckland Council’s Governing Body.

iii.    notes that amendments to the Local Government (Auckland Council) Act 2009 would be required support changes to Auckland Council representation, which is an additional legislative process which does not apply to any other territorial local authority:

iv.    asks that legislative changes and the scope of representation reviews and public consultations should consider and address the representation arrangements of Auckland Council as set out in LGACA.

v.      requests that recommendations made in the Auckland Governance Report 2009 (Chapt 22) be re-examined in relation to Maori representation on Auckland Council.

vi.    endorses that the proposals affects only Governing Body representation arrangements.

c)         notes that there is also an opportunity to make a full submission on the draft bill when it is at the select committee stage.
