Standing Order 7.7 provides for deputations. Those applying for deputations are required to give seven working days notice of subject matter and applications are approved by the Chairperson of the Devonport-Takapuna Local Board. This means that details relating to deputations can be included in the published agenda. Total speaking time per deputation is ten minutes or as resolved by the meeting.

A period of time (approximately 30 minutes) is set aside for members of the public to address the meeting on matters within its delegated authority. A maximum of 3 minutes per item is allowed, following which there may be questions from members.

Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
“An item that is not on the agenda for a meeting may be dealt with at that meeting if-
(a) The local authority by resolution so decides; and
(b) The presiding member explains at the meeting, at a time when it is open to the public,-
(i) The reason why the item is not on the agenda; and
(ii) The reason why the discussion of the item cannot be delayed until a subsequent meeting.”
Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
“Where an item is not on the agenda for a meeting,-
(a) That item may be discussed at that meeting if-
(i) That item is a minor matter relating to the general business of the local authority; and
(ii) the presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but

Local board feedback on the resource consent for Bayswater Marina, 21 Sir Peter Blake Parade, Bayswater

Purpose of the report
1. To provide feedback on the proposed resource consent for the Bayswater Marina, 21 Sir Peter Blake Parade, Bayswater.

Executive summary
2. Bayswater Marina Limited has applied for resource consents to develop the landward portion of Bayswater Marina with terraced and apartment buildings, with associated landscaping, open space, roads, infrastructure, earthworks, unit title subdivision and commercial activities. Overall, the proposal is a discretionary activity.
3. The resource consent has been publicly notified, in accordance with Auckland Unitary Plan (AUP) section I504 – Bayswater Marina Precinct, which requires the following: (2) Any application for resource consent for any of the following activities must be publicly notified: (a) Dwellings; and/or (b) Food and beverage”.
4. As part of the resource consent process, the Devonport-Takapuna Local Board (the local board) are given the opportunity to provide comments and feedback on the proposed consent.
5. It is important to note that the submission period is for stakeholders, such as the local board and community organisations to submit their own views and comments on the resource consent. Council planners and subject matter experts (i.e. Auckland Transport) who input into the resource consent do not assess the overall specifics or provide formal advice on a resource consent application until the completion of public consultation.
6. The local board were given a briefing on 19 October 2021 from council’s Resource Consents unit which provided the following:
· an overview of the proposal and its key components; and
· information on the relevant Auckland Unitary Plan provisions which guide development in this area.
7. The briefing also included advice from on where the local board may wish to focus their feedback, which included:
· design and appearance of the terraced houses;
· transport and parking;
· the open space and esplanade strip;
· trees and tree strategy, particularly the removal of pohutakawa in a coastal setting; and
· hazards during construction.
8. Several other key points and considerations were raised by local board members, which included:
· ensuring Sir Peter Blake Parade is designed and built to safely accommodate a mix of transport options (i.e. buses, cycling and cars with boat trailers);
· the area which includes Cross Street, Sir Peter Blake Parade and the boat ramp may become be a high-volume traffic area with several competing activities (i.e. pedestrian movement, buses and cars with boat trailers). This area may become a ‘pinch point’ that becomes an unsafe area and create conflict between users;
· the applicant’s Assessment of Environmental Effects (AEE) and associated documents is silent on sustainability outcomes or incorporating sustainable design elements;
· support for the ongoing provision and retention of the ferry terminal until and beyond 2031, when the berth licence expires; and
· the does not contemplate public toilets, despite the current site having toilets owned by Auckland Council (the council).
9. To support the feedback process, staff have provided comments to inform the focus areas and respond to key considerations from members for local board consideration. This is outlined in the following table:

· That the Design Manual places too much emphasis on promoting diversity and variation, rather than uniformity and a consistent design palette. Diversity and variation may lead to poor design outcomes. · Suggest the Design Manual include stronger provisions and clauses for terraced houses which ensure high-quality and consistent urban design outcomes. This may include design palettes that are in keeping with the maritime character; undertaking sustainable design; incorporating local Māori identity and history. · Place greater emphasis on sustainability outcomes or incorporating sustainable design elements into the proposed terraced houses and apartments (i.e. community gardens and rainwater harvesting schemes). |
Transport and parking |
· Sir Peter Blake Parade is designed and built to safely accommodate a mix of transport options (i.e. buses, cycling and cars with boat trailers). · Speed mitigation measures (i.e. speed and traffic calming) are incorporated into all the roads proposed in the development. · That the area which includes Cross Street, Sir Peter Blake Parade and the boat ramp may become be a high-volume traffic area with several competing activities (i.e. pedestrian movement, buses and cars with boat trailers. This area may become a ‘pinch point’ that becomes an unsafe area and create conflict between users. |
Open space and esplanade strip |
· The proposed 7,515m² of open space will transform the current area, which is largely a closed-off, private space to become a people-friendly space for the public to use and enjoy. · Fulfils the purpose and functions of an esplanade strip, as outlined in the Reserves Act 1977. · Provides strong connectivity between the existing ferry and bus terminals. · The proposed 3.5m pedestrian path and boardwalk is suitable to accommodate both walking and cycling provision. · Creates a natural connection to council-owned local parks, such as Marine Parade Reserve and Quinton Park. |
Trees and tree strategy |
· Suggest the retention or transplanting of the existing pohutukawa trees. Although the trees are not scheduled or protected through the AUP, they are iconic and form part of character of the local area, and Auckland’s coastlines. |
Hazards during construction |
· All measures are taken to ensure people’s safety during the construction phase of the project, specifically for public transport and boat ramp users. · The mix of activities (i.e. construction site, public transport terminals and boat ramp) within a constrained area needs to be carefully managed and monitored to ensure everyone’s safety. |
Ferry terminal |
· Support for the ongoing provision and retention of the ferry terminal until and beyond 2031, when the berth licence expires. |
Public toilets |
· Support the continued provision for public toilets on the Bayswater Marina site. · Requests the applicant work with the council’s Community Facilities department to ensure the toilet can be moved to an appropriate location. |
10. The submission period to provide feedback is between Monday 11 October and 11 November 2021. This 20-day working period is in accordance with the Resource Management Act 1991.
11. It is recommended the local board approve its feedback on the resource consent to meet the public consultation timeframes as indicated in paragraph 10.
12. The local board has the additional option to delegate their feedback at the business meeting, to allow for more time to provide feedback and comments. It is important to however that feedback must still be submitted by 9 November 2021.
13. It is also recommended that the local board’s resource consent delegate leads, members Trish Deans and Toni van Tonder, be appointed to speak at the hearing in the event one is required. It is important note that council has not set formal dates for the hearing yet, and that further information and advice on any potential hearing will be provided following the completion of public consultation.

That the Devonport-Takapuna Local Board:
a) provide feedback on the proposed resource consent for the Bayswater Marina, 21 Sir Peter Blake Parade, Bayswater.
b) appoint members Trish Deans and Toni van Tonder to speak at the hearing for the Bayswater Marina resource consent, should one be organised.
