Members are reminded of the need to be vigilant to stand aside from decision making when a conflict arises between their role as a member and any private or other external interest they might have.

Standing Order 7.7 provides for deputations. Those applying for deputations are required to give seven working days notice of subject matter and applications are approved by the Chairperson of the Waiheke Local Board. This means that details relating to deputations can be included in the published agenda. Total speaking time per deputation is ten minutes or as resolved by the meeting.
At the close of the agenda no requests for deputations had been received.
A period of time (approximately 30 minutes) is set aside for members of the public to address the meeting on matters within its delegated authority. A maximum of 3 minutes per item is allowed, following which there may be questions from members.
Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
“An item that is not on the agenda for a meeting may be dealt with at that meeting if-
(a) The local authority by resolution so decides; and
(b) The presiding member explains at the meeting, at a time when it is open to the public,-
(i) The reason why the item is not on the agenda; and
(ii) The reason why the discussion of the item cannot be delayed until a subsequent meeting.”

(a) That item may be discussed at that meeting if-
(i) That item is a minor matter relating to the general business of the local authority; and

(b) no resolution, decision or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion.”

Purpose of the report
1. To consider the request from Waiheke Island Tourism Incorporated (WITI) to urgently advocate to government for the immediate removal of the health order that prevents non-resident day-trips to Waiheke Island.

2. The local board have received a request from Waiheke Island Tourism Inc (WITI) for the board to advocate directly to government for the urgent rescinding of Clause 21/6 (c) COVID-19 Public Health Response (Alert Level Requirements) Order (No 12) Amendment Order (No 4) 2021 on behalf of WITI and other organisations it represents in this matter (Attachment A).
3. Consequently, the board have called for an extraordinary meeting to facilitate a formal decision-making process and enable public participation.
4. Results from a COVID response survey carried out by WITI are attached for information (Attachment B).
Recommendation
That the Waiheke Local Board:
a) consider the request received from Waiheke Island Tourism Inc to advocate directly to government for the urgent rescinding of Clause 21/6 (c) COVID-19 Public Health Response (Alert Level Requirements) Order (No 12) Amendment Order (No 4) 2021.

Clause 21/6 (c) COVID-19 Public Health Response (Alert Level Requirements) Order (No 12) Amendment Order (No 4) 2021
On behalf of the following organisastions, we write to request that the Waiheke Local Board urgently advocates with Government for the immediate removal of the health order that prevents non-resident day-trips to Waiheke Island.
· Waiheke Island Tourism Inc.
· Waiheke Winegrowers Association
· Love Oneroa Retailers
· Waiheke Restaurant Association
The continuation of the ban on non-resident day-trips to the island is proving catastrophically damaging to members of the above organisations. Waiheke businesses rely on its visitor economy, and the local economy alone is not sizable enough to support the large number of businesses on the island.
With Auckland moving to alert level 3.2 on Wednesday 10th November, the maintenance of the health order will put Waiheke’s hospitality, retail and transport businesses at a significant disadvantage to their mainland peers, where free movement within the rest of the Auckland-region is permitted.
The island’s business community has been severely damaged by some of the strongest border restrictions anywhere in New Zealand and we need Government to act with urgency to remove this clause. Without the intervention of the Waiheke Local Board we fear Government may fail to fully apprehend the urgency of the situation.
