Selected extracts from the Hauraki Gulf Marine Park Act 2000

 

 

3          Purpose

 

The purpose of this Act is to—

 

(a)           integrate the management of the natural, historic, and physical resources of the Hauraki Gulf, its islands, and catchments:

(b)           establish the Hauraki Gulf Marine Park:

(c)            establish objectives for the management of the Hauraki Gulf, its islands, and catchments:

(d)           recognise the historic, traditional, cultural, and spiritual relationship of the tangata whenua with the Hauraki Gulf and its islands:

(e)           establish the Hauraki Gulf Forum.

 

Part 1  Management of Hauraki Gulf

 

7          Recognition of national significance of Hauraki Gulf

 

(1)        The interrelationship between the Hauraki Gulf, its islands, and catchments and the ability of that interrelationship to sustain the life-supporting capacity of the environment of the Hauraki Gulf and its islands are matters of national significance.

(2)        The life-supporting capacity of the environment of the Gulf and its islands includes the capacity—

(a)        to provide for—

(i)      the historic, traditional, cultural, and spiritual relationship of the tangata whenua of the Gulf with the Gulf and its islands; and

(ii)      the social, economic, recreational, and cultural well-being of people and communities:

(b)        to use the resources of the Gulf by the people and communities of the Gulf and New Zealand for economic activities and recreation:

(c)        to maintain the soil, air, water, and ecosystems of the Gulf.

 

8          Management of Hauraki Gulf

 

To recognise the national significance of the Hauraki Gulf, its islands, and catchments, the objectives of the management of the Hauraki Gulf, its islands, and catchments are—

 

(a)           the protection and, where appropriate, the enhancement of the life-supporting capacity of the environment of the Hauraki Gulf, its islands, and catchments:

(b)           the protection and, where appropriate, the enhancement of the natural, historic, and physical resources of the Hauraki Gulf, its islands, and catchments:

(c)            the protection and, where appropriate, the enhancement of those natural, historic, and physical resources (including kaimoana) of the Hauraki Gulf, its islands, and catchments with which tangata whenua have an historic, traditional, cultural, and spiritual relationship:

(d)           the protection of the cultural and historic associations of people and communities in and around the Hauraki Gulf with its natural, historic, and physical resources:

(e)           the maintenance and, where appropriate, the enhancement of the contribution of the natural, historic, and physical resources of the Hauraki Gulf, its islands, and catchments to the social and economic well-being of the people and communities of the Hauraki Gulf and New Zealand:

(f)             the maintenance and, where appropriate, the enhancement of the natural, historic, and physical resources of the Hauraki Gulf, its islands, and catchments, which contribute to the recreation and enjoyment of the Hauraki Gulf for the people and communities of the Hauraki Gulf and New Zealand.

 

Part 2  Hauraki Gulf Forum

 

15        Purposes of Forum

 

The Forum has the following purposes:

 

(a)           to integrate the management and, where appropriate, to promote the conservation and management in a sustainable manner, of the natural, historic, and physical resources of the Hauraki Gulf, its islands, and catchments, for the benefit and enjoyment of the people and communities of the Gulf and New Zealand:

(b)           to facilitate communication, co-operation, and co-ordination on matters relating to the statutory functions of the constituent parties in relation to the Hauraki Gulf, its islands, and catchments, and the Forum:

(c)            to recognise the historic, traditional, cultural, and spiritual relationship of tangata whenua with the Hauraki Gulf, its islands, and, where appropriate, its catchments.

 

16        Establishment of Forum

 

(1)        A body called the Hauraki Gulf Forum is established.

(2)        The Forum consists of the following representatives:

(a)              1 representative appointed by the Minister:

(b)              1 representative appointed by the Minister of Fisheries:

(c)              1 representative appointed by the Minister of Maori Affairs:

(ca)       7 representatives appointed by the Auckland Council:

(d)              1 representative appointed by each of the following local authorities:

…(iv) Hauraki District Council:

…(vi) Matamata-Piako District Council:

…(ix) Thames-Coromandel District Council:

…(x) Waikato District Council:

…(xi) Waikato Regional Council:

(e)               6 representatives of the tangata whenua of the Hauraki Gulf and its islands appointed by the Minister, after consultation with the tangata whenua and the Minister of Maori Affairs.

(2A)     The representatives appointed in accordance with subsection (2)(ca) must—

(a)        be members of—

(i)         the Auckland Council; or

(ii)        a local board of the Auckland Council elected in accordance with the Local Electoral Act 2001; and

(b)        include 1 member of each of the Great Barrier Island and Waiheke Island local boards.

(3)        The representatives appointed in accordance with subsection (2)(d) or (5) must be members of the local authority elected in accordance with the Local Electoral Act 2001.


 

17        Functions of Forum

 

(1)        To promote sections 7 and 8, the Forum has the following functions in relation to the Hauraki Gulf, its islands, and catchments:

(a)   to prepare a list of strategic issues, determine a priority for action on each issue, and regularly review that list:

(b)   to facilitate and encourage co-ordinated financial planning, where possible, by the constituent parties:

(c)   to obtain, share, and monitor information on the state of the natural and physical resources:

(d)   to receive reports on the completion and implementation of deeds of recognition:

(e)   to require and receive reports from constituent parties on the development and implementation of policies and strategies to address the issues identified under paragraph (a):

(f)    to receive reports from the tangata whenua of the Hauraki Gulf on the development and implementation of iwi management or development plans:

(g)   to prepare and publish, once every 3 years, a report on the state of the environment in the Hauraki Gulf, including information on progress towards integrated management and responses to the issues identified in accordance with paragraph (a):

(h)   to promote and advocate the integrated management and, where appropriate, the sustainable management of the Hauraki Gulf, its islands, and catchments:

(i)    to encourage, share, co-ordinate where appropriate, and disseminate educational and promotional material:

(j)    to liaise with, and receive reports from, persons and groups having an interest in the Hauraki Gulf and business and community interests to promote an interest in the purposes of the Forum:

(k)   to commission research into matters relating to the functions of the Forum.

(2)        When carrying out its functions under subsection (1), the Forum must have particular regard to the historic, traditional, cultural, and spiritual relationship of tangata whenua with the natural, historic, and physical resources of the Hauraki Gulf, its islands, and catchments.

 

18        Powers of Forum

 

(1)        The Forum has the powers that are reasonably necessary to carry out its functions.

(2)        The Forum’s powers include the powers—

(a)     to consider issues related to its purpose; and

(b)     to receive reports from constituent parties; and

(c)     to make recommendations to constituent parties; and

(d)     to advise any person who requests the Forum’s advice; and

(e)     to commission or undertake those activities that are necessary to achieve its purpose.

(3)        The Forum must not—

(a)     appear before a court or tribunal other than as a witness if called by a party to proceedings; or

(b)     take part in a decision-making process under any enactment other than to advise when requested to do so.


 

Governance Statement – updated May 2021

 

 

Whakatauki

“He waka kōtuia kāhore e tukutukua ngā mimira.”

A canoe that is interlaced will not become separated at the bow. In unity there is strength.” In the highly developed craft of building ocean going waka the bow section was laced to the centre hull. The waka provides a metaphor for tangata whenua, in that a people interlaced will not be separated and through that unity we find strength.

 

This Governance Statement replaces all prior versions. It covers how the Forum works, and key roles and responsibilities. The Forum’s purposes, membership, functions and powers are set out in detail in Part 2 of the Hauraki Gulf Marine Park Act 2000 (HGMPA) and are not repeated here.

 

How the Forum works

 

Te whakahonore i o maatau hononga Tiriti hei painga mo Te Moananui-ō-Toi; Tīkapa Moana; Hauraki Gulf. The Forum will operate in partnership under the Treaty of Waitangi in accordance with the Hauraki Gulf Marine Park Act, including the principles of the Treaty of Waitangi under Section 6.

 

It will integrate and respect both Te Ao Māori and other world views.

 

The Forum’s conduct, and all those that interact with it, will adhere to the intent of the following principles:

·       Aroha: being considerate – having respect for relationships and being of service.

·       Openness and impartiality: having an open mind when making decisions and listening to other points of view.

·       Tautoko: supporting others by respecting and upholding others mana, dignity, identity and unique perspective.

·       Manaaki: caring for others by responsibly valuing others and ensuring they feel valued.

·       Stewardship: using powers and resources prudently.

·       Awhi: helping others by entering into effective engagements in the spirit of co-operation and good faith.

·       Leadership: inspiring action toward achieving common goals.

·       Tika: being responsible – doing the right thing with integrity and accountability.

·       Pono: being effective – building credibility.

·       Ethics: maintaining the highest standard of ethical conduct.

The Forum will endeavour to meet quarterly, with meetings split between the Auckland and Waikato regions. It will hold additional workshops and meetings as required.

 

Our Roles and Responsibilities

-          Co-Chairs

o   One Co-Chair is from and elected by the membership at large

o   One Co-Chair is from and decided by the Tangata Whenua members

o   Co-Chairs lead the Forum and are its spokespeople

o   Co-Chairs work in partnership with each other

o   Co-Chairs exemplify the principles by which we work

o   Co-Chairs chair Forum meetings, set strategic direction, support and work with all Members, and front public engagement

(A separate Co-Chairing arrangement records the practical aspects of Co-Chairing)

 

-          Members

o   Members support and work with the Co-Chairs and each other to take effective decisions and progress the agenda of the Forum

o   Members bring their expertise and mana to ensure quality decision making in the interests of the Marine Park

o   Members represent their Constituent Party, as defined under the HGMPA

o   Members may send alternates to meetings they are unable to attend so long as this is notified in advance and in accordance with any applicable practice

 

-          Executive Officer

o   The Executive Officer functions as the Chief Executive of the Forum and is responsible for taking forward resolutions of the Forum, ensuring adherence to the HGMPA, supporting the Co-Chairs and all Members, preparing meeting papers, coordination with external partners, and the Forum’s management, contracts, finance and administration.

o   The Executive Officer chairs meetings of Technical Officers and works closely with the Governance Advisor.

 

-          Governance Advisor

o   The Governance Advisor is responsible for collating and publishing meeting agendas, writing minutes and providing advice on process.

 

-          Technical Officers

o   Members are encouraged to have technical officers to provide them and the Forum with expert support and advice.

o   Technical Officers will work with their Members, the Executive Officer and each other to progress the Forum’s resolutions, as appropriate.

 

-          Administering Authority

o   Auckland Council is the Administering Authority (for responsibilities see s28, HGMPA)

This Governance Statement will be reviewed every 3 years.

5          Extraordinary Business

 

Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

 

“An item that is not on the agenda for a meeting may be dealt with at that meeting if-

 

(a)        The local  authority by resolution so decides; and

 

(b)        The presiding member explains at the meeting, at a time when it is open to the public,-

 

(i)         The reason why the item is not on the agenda; and

 

(ii)        The reason why the discussion of the item cannot be delayed until a subsequent meeting.”

 

Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

 

“Where an item is not on the agenda for a meeting,-

 

(a)        That item may be discussed at that meeting if-

 

(i)         That item is a minor matter relating to the general business of the local authority; and

Purpose of the report

1.       To provide an update from the Forum’s Co-Chairs.

Executive summary

2.       We arrive at our final hui for the term and reflect on how much has happened over the past two and a half years.

3.       We have taken the opportunity to capture the progress witnessed from 2020 – 2022 in an infographic (see Attachment A), which speaks to the endeavours of members, mana whenua, community groups, and so many from all around the Hauraki Gulf, Tīkapa Moana, Te Moananui-ō-Toi.

4.       Commentary on the state of the Hauraki Gulf is often justifiably negative, and it is true that our moana remains under great stress from activities on land and at sea. But we must also acknowledge and celebrate the successes, communicating just how much is happening that will - over time - improve the health of the Gulf and restore its mauri. There is much that all members can be proud of.

5.       The last quarter has been another busy one, capped off by the incredible achievement of not only New Zealand’s but the world’s largest restored green-lip mussel bed in the waters off Kawau Island. 150,000kg of kūtai have been deposited onto the seafloor, in what is only the beginning of this home-grown restoration story. This is a true partnership, with mana whenua working with community groups, universities, philanthropists, industry, central and local government, transport operators and rangatahi/youth. It is the physical representation of what we mean when we talk about a Treaty partnership model. Ngā mihi nui ki Ngāti Manuhiri and Forum members Mook Hohneck and Nicola MacDonald for their leadership of this impressive project (see photo below).

6.       The winter months are also peak planting season and we have been doing our bit to contribute to this massive effort across the catchment (see photos below). We wish to acknowledge Forum member Charmaine Bailie and technical officer Mike Wyatt for their outstanding mahi to organise and support many of these planting efforts, as well as the numerous trusts, councils, agencies, community organisations and landowners who are ramping up the planting of our islands and the catchment.

7.       We also met recently with new Ports of Auckland Chief Executive Roger Gray and had a refreshingly open and honest conversation about the Ports’ important role in harbour health. It was heartening to hear their continued commitment to the voluntary ship speed protocol to avoid strikes of our resident Bryde’s whales, and the fast-scaling shellfish-restoration efforts where they have supplied capability and shell hash.

8.       This time of the year is also when our Annual Report must be presented to Parliament and it was recently on its way to the capital and to our new Minister of Conservation, Hon. Poto Williams. Please see Attachment B.

9.       Finally, we wish to record our thanks to all members, technical officers and our Executive Officer and Governance Advisor for your contributions over the past two and a half years. It has been an honour to be the inaugural Co-Chairs of the Hauraki Gulf Forum.

3.       These welcome reports detail significant effort and progress by the Forum’s Constituent Parties over the past year, and some important reforms and consultations either underway or scheduled for later this year.

4.       The report from Fisheries New Zealand also includes an update from Biosecurity NZ on the concerning spread of the invasive seaweed Caulerpa, which recently breached the controlled areas cordon on Aotea Great Barrier and is also present at Ahuahu Great Mercury.

Purpose of the report

1.       To provide an update from the Executive Officer.

2.       The past quarter has provided a wonderful opportunity to reengage in person and I have been busy making full use of it:

-     Delivering six speeches (to the Ponsonby Cruising club, Devonport Yacht Club, NZ Marine Transport Association, Sir Peter Blake Marine Education and Research Centre, Friends of Regional Parks AGM and National Bluegreens Forum).

-     Representing the Forum at a range of events (including Thames Aquaculture Forum, speech by Minister for Oceans and Fisheries, Tamaki Estuary Environmental Forum meeting, launch of the Waiheke koura survey results, Foundation North’s GIFT Year 5 report launch, and the Hauraki Gulf indicators work stream of Revitalising the Gulf).

-     Engaging with many stakeholders including Z-pier charter operators, environmental consultancies, philanthropic funders, community groups, and biosecurity teams.

3.       I have also been following up with the Ministry for the Environment on changes they will propose to the Hauraki Gulf Marine Park Act because of the Resource Management Act reforms, as I want to bring those to you for your feedback once available.

4.       Behind the scenes, a particular focus has been the tender and contracting process for our next State of the Gulf report, due for public release in mid-2023. I am pleased to be able to say that the process has now concluded with the award of the contract to Coast & Catchment Limited. The core team of Dr Shane Kelly, Peter van Kampen, Carina Sim-Smith and Shaun Lee are all experts in their fields, know the Hauraki Gulf inside/out, and have a proven track record of delivering high quality work. As we progress, we will be reaching out to all members to help with the provision of the latest information and data to form part of the report.

5.       Another piece of work I have been quietly progressing, which I mentioned orally at our last meeting, is an updated economic valuation of the Hauraki Gulf. For too long we have had piecemeal or extractive-only valuations. With the kind help of Auckland Council’s Chief Economist, I have been working on a draft request for proposal document (see Attachment A) to seek to establish a new ‘minimum floor valuation’ for the Hauraki Gulf. This would be based on an extrapolation of all the sources of value it provides – not just economic but also social, well-being, and cultural value, plus the value it brings to things like our housing stock and tourism markets. Given the healthy state of our Forum finances (see below), and the need for specialist expertise for such an exercise, I recommend allocating $50,000 to this tender process.

6.       Last month Forum Technical Officers and I had a productive discussion to lay the ground for this meeting and update each other on issues front of mind. The notes from our discussion are appended to this report (see Attachment B).


 

 

Ship speed update

7.       Ship speeds continue to be at or below the target of 10kts and the past quarter was the lowest average speed recorded in recent years. Our thanks to the Ports of Auckland for their continued monitoring of this and provision of quarterly reports to the Forum. See Attachment C.

Financial update

8.       The Forum has successfully saved for its largest 3-yearly spend with the next State of the Gulf report. COVID continued to impact on some planned spend over the past year, but this means we do have a small additional surplus to put towards the economic valuation work. See Attachment D.

Looking ahead

9.       While this is the last Forum meeting for the year, we do have another gathering planned for Tuesday 18 October: the Hauraki Gulf Conference – te Mana o te Moana – at Auckland’s War Memorial Museum. Tickets are now on-sale at the Museum’s website and we are looking forward to a great engaging event. The event is also part of the broader Auckland Climate Festival, which will run through October 2022.

10.     In addition, the next few months are also peak season for our work on investigating both live and desceased kekeno / fur seals – particularly around the Mercury Bay area. Anyone with information on sightings of these wonderful animals is encouraged to report to kekeno@doc.govt.nz. See flyer below.

Interim arrangements October 2022 - March 2023

Purpose of the report

1.       To outline arrangements for the period following the 2022 Local Body Elections in October 2022 until the first meeting of the Hauraki Gulf Forum in March 2023 (‘the interim period’).

2.       Prior to the appointment of the current Co-Chairs, the Forum resolved (HGF/2019/32) that the term would be until the next Local Body elections or the conclusion of their individual term, whichever was earlier.

3.       As a result, both Co-Chairs will end their current terms on 8 October 2022.

4.       The first meeting of the Forum post-local body elections is not expected until March 2023. At that meeting the Forum will:

-     induct new and returning members; and 

-     hold an election for the Co-Chair position.

5.       The selection of the Co-Chair Tangata Whenua has its own tikanga. As confirmed by resolution HGF/2020/6, the tangata whenua members meet and decide which of them is to be the Co-Chair Tangata Whenua and notify the Forum of their decision. This may occur at any time prior to or post-8 October 2022, as the Tangata Whenua members’ current terms run until early 2024. Upon receipt of this decision the Executive Officer will notify Forum members.

6.       For the interim period, the Executive Officer will:

-     manage the Forum in line with existing decisions and resolutions;

-     provide support to the Co-Chair Tangata Whenua if/when that person is confirmed; and

-     prepare an induction process for new members. 

7.       In addition, the Governance Advisor and Executive Officer will receive decisions of the selection of representatives of Auckland Council (including 1 member from each of the Aotea Great Barrier and Waiheke local boards), Waikato Regional Council, Waikato District Council, Thames Coromandel District Council, Hauraki District Council and Matamata-Piako District Council.

8.       The Governance Advisor will prepare for and conduct the election of the Co-Chair at the Forum’s first meeting in 2023.

2023 Meeting Dates

1.       To confirm the Forum’s quarterly meetings for 2023.

2.       With consideration to the maramataka (Te Wānanga o Aotearoa), the schedules of Constituent Parties, and public / school holidays, the Forum’s four hui in 2023 are proposed to take place on:

-     Monday 6 March – Ōhua. Tānemahuta good day. A day for planting day including of knowledge.

-     Monday 12 June – Tangaroa-ā-mua. Tangaroa good day. A good day for eeling, fishing and planting food. A great time to do work.

-     Monday 11 September – Tangaroa-ā-kiokio. Time to set the cray and eeling baskets. A good day to fish. High energy day. Schedule gatherings on this day.

-     Monday 4 December – Korekore te piri ki Tangaroa. Productive eeling from midday to sundown. Foods plentiful. A good day to get moving. Reinvigorate those office projects.

3.       Keeping with tradition, on those days the Forum’s meetings will commence at 1pm and will wrap up by 5pm. Space is kept in the morning of each meeting date for a workshop or other event/opportunity. Members and officers are kindly asked to keep 10am – 5pm free on those dates.

4.       Also in keeping with tradition, the Forum will endeavour to meet in person (COVID willing) and hold two meetings each in the Auckland and Waikato regions.

5.       The first meeting of the year, on Monday 6 March, will also feature an induction to the Forum for new and returning members. With the last two meetings of this year having been in the Waikato, it is likely that first meeting for 2023 will be in the Auckland region.
