Purpose of the report

1.       To update the Ngāti Whātua Ōrākei Reserves Board (reserves board) on the operational work carried out on the whenua by Ngāti Whātua Ōrākei Whai Maiā.

Whakarāpopototanga matua

Executive summary

2.       Ngāti Whātua Ōrākei is continuing to advance the Work Schedule, which includes a regular audit hīkoi to enhance alignment with the maintenance agreement outcomes and performance standards.

3.       The operations team have continued to make good progress over the past 5 months despite the impacts of the significant and severe weather events. A key focus has been on the storm remediation work that is essential to the long-term plan and operation of Pourewa.

4.       The severe storm events that occurred in January and February 2023 caused damage to pathways and stormwater infrastructure at Pourewa, including washed-out pathways and driveways, scoured debris blocking stormwater swales, and damaged stormwater collection points. Management is working on an essential emergency plan to remediate the damage caused and also preventative work to mitigate the risk of future storm damage. The emergency work includes clearing and repairing damaged catchpits, swales, and pathways, while the preventative work includes stabilizing the surface of the lost metal driveway and replacing non-native trees with natives.

5.       A new management team is in place and continues the work of those who have contributed to the success of the Ngāti Whātua Ōrākei Reserves Board kaupapa.

6.       The Ngāti Whātua Ōrākei Reserves Board is recommended to approve two budgets: $200,000 for the Nursery Staff budget to fund operational expenses of Pourewa, where the staff plays a vital role in achieving positive outcomes in landscaping, ecology, maara, and nursery operations; and $150,000 for the Management budget to finance essential administrative and technical officer services provided by Ngāti Whātua Ōrākei Whai Maia and Ngāti Whātua Ōrākei Trust on behalf of the Reserves Board.

7.       The Reserve Board has allocated $100,000 towards the Kaitiaki Service budget, a crucial initiative that aligns with the Board's commitment to the protection and preservation of the Whenua.

Operational Update

Whenua Maintenance & Ecology

8.       Horticulture/ Vegetation: We continue to produce plants in the Pourewa native nursery with a good propagation season. We are growing plants predominantly for both restoration and landscaping with a nursery planting plan in development. Seeding machine is operational and will also be factored into the nursery plan and ongoing planning.

 


 

 

9.       Turf: Due to an abnormally wet year notably the number of significant and severe weather events, the Turf has managed to stay on top of the required mows as best as can. Navigating unforeseen variables and extensive damage to certain areas we are confident that land has been replenished and damaged areas are remediating well in time for winter which we will have to keep an eye on.

10.     Ecological Restoration – Weed, Plant and Pest Control: Significant amounts of invasive and noxious weed plants and pests were identified on Whenua Rangatira, to note:

            Areas identified as blocks Kitemoana – Kelly Tarltons, Taharapaki, Ngahere bush are of concern with extensive waves of Japanese honeysuckle.

            Immediate action has been taken on this block and updating the restoration action plan has to guide and give more rigour to the wider ecology scope, Ki uta – ki tai (land and sea).

            Pockets of weeds throughout the Whenua Rangatira

 

            At Pourewa, the weeds to note:

 

-     Kepa Bush connection – Privet, Japanese Honeysuckle, others

-     Pourewa creek edge – privet

 

11.     Ecological Restoration – Pest Animal Control: Ongoing support from eastern songbird in completing trapping rounds across Pourewa and Whenua Rangatira.

Weekly trapping undertaken by the team noting ongoing issues with Pukeko, Magpies, Spur winged plover.

12.     Parakore: The parakore activity is growing and the team continue to work on environmental wellness and assist in upholding a sustainable and regenerative relationship with the environment.

The team have begun waste audits for Ngāti Whātua Ōrākei group sites.

Volunteers and Visiting Groups

13.     Volunteers: Have recorded 50 volunteers

Visitors: Have hosted average 20 walk-in visitors with 3 significant events of 100 each.

We have seen 800 visitors over 5 months.

Biodiversity

14.     Bio-diversity monitoring: The team is continually reassessing this objective to determine its relevance to Ngāti Whātua Ōrākei and to clarify its intended purpose.

15.     Water monitoring: Water testing routine established in partnership with Healthy Waters reports and findings and reports on tranche 1 tributaries available on request.

Health and Safety

16.     There is nothing to report.

Maintenance Work Outside of Scope

17.     The team continue to provide regular mowing and weed-eating support at the old Ōkahu Bay Bowling Club site.

Kaitiaki Service

18.     In 2020, the Ngāti Whātua Ōrākei Reserves Board approved the implementation of the revised Kaitiaki Service for Whenua Rangatira and Ōkahu. The operating model involves providing services at the Marae, with a team of Kaimahi managed by the Ngāti Whātua Ōrākei Trust. The majority of the service cost is being borne by the Ngāti Whātua Ōrākei Trust, and the Ngāti Whātua Ōrākei Reserve Board has allocated $100K towards the Kaitiaki Service budget for the Whenua.

19.     It is highly recommended that the Ngāti Whātua Ōrākei Reserves Board approve the budgeted spend for the Kaitiaki Service as it is a crucial initiative that aligns with the Board's commitment to the protection and preservation of the Whenua.

20.     The Kaitiaki service levels are in the process of being reviewed. The service will align with the current environment and future direction of Ngāti Whātua Ōrākei.

21.     The self-sufficient unit on the whenua has been completed and Kaitiaki kaimahi have moved into the new space.

22.     There has been minimal disruptive activity on the Whenua Rangatira, at Ōkahu and Michael Joseph Savage. The team continue to monitor these areas daily.

Auckland Transport Investment - Hapimana Street

23.     In November 2022, Ngāti Whātua Ōrākei granted Auckland Transport landowner approval to proceed with the proposed works at Hapimana in order to minimize the negative impact of the boy racer community in this area and on the Whenua Rangatira.

24.     The installation of speed humps and lighting at Hapimana was completed prior to the start of the summer holiday period. Images of the work undertaken can be viewed in Attachment A.

25.     The Ngāti Whātua Ōrākei Reserve Board would like to express our gratitude to Auckland Transport for their ongoing support in maintaining and improving transport infrastructure within our rohe. The partnership is invaluable in ensuring the safety and accessibility of our communities.

Nursery Staff

26.     The allocation of $200,000 for the Nursery Staff budget serves to fund the operational expenses of Pourewa. The nursery staff play a vital role in driving various ecological initiatives and achieving positive outcomes in landscaping, ecology, maara, and nursery operations. The Pourewa nursery is a lasting legacy that supports the Ngāti Whātua Ōrākei and Reserves Board’s responsibility as knowledge bearers, guardians of cultural practices, and leaders in research related to kaitiakitanga and traditional use. It is highly recommended that the Ngāti Whātua Ōrākei Reserves Board approves the proposed budget to sustain the critical work of the nursery staff.

Management Support

27.     The allocation of $150,000 for the Management budget aims to finance the crucial administrative and technical officer services provided by Ngāti Whātua Ōrākei Whai Maia and Ngāti Whātua Ōrākei Trust on behalf of the Ngāti Whātua Ōrākei Reserves Board. These services are essential for the efficient management and operations of the Reserve Board. Therefore, it is strongly recommended that the Ngāti Whātua Ōrākei Reserves Board approves the proposed budget for Management support.

Storm Remediation

28.     The unprecedented storm events of January and February 2023 that affected much of the North Island, including the torrential rain that led to the Auckland floods between 27 January – 1 February and the subsequent Cyclone Gabrielle in February, have caused damage to pathways and stormwater infrastructure at Pourewa.

29.     Damage included washed-out pathways and driveways, slips and scoured debris blocking stormwater swales, scoured material blocking catchpits, grating, scruffy domes and channels, scoured material collecting in stormwater storage tanks (the tanks that collect and recycle rainwater for irrigation).

30.     Management are working on a plan to remediate the damage caused and also preventative work to mitigate the risk of future storm damage. This is essential, emergency work that must be completed before winter. The work will need to be carried out during April 2023.

31.     The emergency work includes clean and clear all swales, stormwater collection points, repair damaged catchpits in the nursery and replace damaged Enviropod Gross Pollutant Traps, glean out stormwater storage tanks, repair washed out section of the access driveway, repair washed out sections of hoggin pathways and relay hoggin.

32.     The preventative works required to mitigate risk of future storm events include concrete steepest section of the lost metal driveway, to stabilize the surface and prevent future wash-out, substantially prune the non-native deciduous trees along the southern border of the nursery and prepare an ecological succession plan to ultimately replace them with natives that do not drop leaves.

Purpose of the report

1.       To update the Ngāti Whātua Ōrākei Reserves Board on the active projects underway in relation to the Combined Reserve Management Plan, Urupā, Pourewa Access: Pathways & Signage (Phase 3), Te Matatini Pōwhiri and the Bastion Point 45th Anniversary Activation.

Whakarāpopototanga matua

Executive summary

2.       As per the delegation on April 2022 to the Chair and Deputy Chair, approved the amendments to the spelling, grammar and wording based on legal advice for the Combined Reserve Management Plan. The approved version is going through the final design phase so it is fit for publishing and ministerial approval in June.

3.       A consolidated report for the ground water level testing has been received. This report executive summary confirms three sites suitable for urupā end use. The Ngāti Whātua Ōrākei Taumata (Taumata) have resolved to undertake the necessary testing to check ground conditions and ground water levels during the winter season on the Takaparawhau site, surrounding the Joanee Memorial. Management will be begin testing on this site after the Bastion Point 45th Anniversary.

4.       The Taumata have had a first go at ranking sites in order of preference, to which they hope to do this exercise again with others who were not present before they move to make a decision on a preferred site. For this exercise, the Taumata are treating the Takaparawhau site as if it is suitable for urupā end use. If the Takaparawhau site is not suitable, it will be removed from the rank and not considered.

5.       Pourewa Pathways, phase 1 and 2 have been completed. Phase 3 of the Pourewa Pathways & Signage completion is delayed by one month due to the remedial and prevention work that management is needing to undertake following the severe weather in January and February.

6.       Progress has been made on Phase 3 with the design and construction of pathways and signage. Pathway design is complete, and marker posts have been temporarily set out on site. Refinements to path routes and markers posts have been made following a hikoi with whānau. Bi-lingual narratives for interpretive signage is being finalised. Construction of pathways is 50% complete.

7.       Te Matatini Pōwhiri was an event that provided the opportunity for people from across the country to visit Ōkahu Bay, a significant location for Ngāti Whātua Ōrākei. The event was focused on manaakitanga and welcoming guests, with the guiding words “Whiria te kaha tuatinitini” encouraging unity and strength as a community. Ngāti Whātua Ōrākei Reserve Board played an important role in making the event possible. A special thanks to the Reserve Board for the budgeted contribution of $151,000 to the event.

8.       Ngāti Whātua Ōrākei is set to hold the 45th Anniversary of the Bastion Point event, and the whānau have arranged various events and activities on the land to honor the occasion. It is suggested that a 5K contribution for the mauri tent be directed towards supporting the 45th Anniversary celebrations.

Purpose of the report

1.       To provide Ngāti Whātua Ōrākei Reserves Board (reserves board) an update on annual plan for 2023/24 and indicative timeframe for the next 10-year budget (LTP) process.

Executive summary

2.       During this year several financial matters will be brought to the reserves board for decision making as outlined in this report.  A lot of this discussion will focus on the current Ngāti Whātua Ōrākei Reserves Board 2021-2031 LTP, which is attached to this report (Attachment A).

3.       Management have reviewed the total annual budget for 2023/24 and think this is sufficient for current forecast works and therefore do not feel that there is a need for a revised funding with Council through the 2023/24 annual plan process. However, given the current financial challenges facing council, the board may discuss and resolve in June hui to provide some savings to council through a reduction in operating expenditure and by deferral of some capex projects.

4.       The reserves board has the opportunity, between now and end of November this year, to review the current long-term budget and extend to the year 2034.  Following this review process the opportunity exists for the reserves board to seek confirmation of funding or revised funding from Auckland Council for the 2024-2034 period as part of the development of the 2024-2034 LTP. The current Funding Memorandum of Understanding (MOU) has guidelines associated with this process and is attached to this report for information purposes (Attachment B).

5.       At the time of writing this report the LTP timeline for 2024-2034 was still in development and subject to Governing Body approval.

Recommendation/s

That the Ngāti Whātua Ōrākei Reserves Board:

a)      confirm that the 2023/2024 annual budget as reflected in the Ngāti Whātua Ōrākei Reserves Board 2021-2031 LTP (Attachment A) is sufficient for the 2023/2024 proposed reserves board work programme. 

b)      note the need to review the current LTP and prepare a submission to the Auckland Council’s Long Term Plan for 2024-2034 by November 2023. 

 


 

 

 

Discussion  

6.       Over the course of 2023 a number of financial matters will be bought to the reserves board for decision making.  Most of these steps are outlined in the Funding MOU as detailed in Attachment B.  At a high level the matters to be considered by the reserves board over 2023 are:

·        Confirm the forecast position for financial year end 2022/23 and advise Auckland Council accordingly.

·        Review the forecast budget for 2023/24 financial year and determine if the annual amount needs to be varied through the Annual Plan process.

·        Review the and complete the 2024-2034 LTP for the reserves board by 30 November and submit the funding required from Auckland Council to the Governing Body for consideration.

7.       As context for all of these financial matters the current Ngāti Whātua Ōrākei Reserves Board 2021-2031 LTP is attached to this report (Attachment A).  This was adopted by the reserves board on 30 November 2020.   

Annual Plan for 2023/24

8.       In relation to reviewing the budget for 2023/24, management have reviewed and have found there is sufficient budget for all forecast works and therefore do not feel that there is a need for a revised funding with Council as part of the 2023/24 annual plan process. 

9.       The LTP includes provision to fund the proposed activities of the reserves board.

10.     Given the current financial challenges facing council, the board may discuss and resolve in June hui to provide some savings to council through a reduction in operating expenditure and by deferral of some capex projects. 

LTP 2024-2034

11.     The LTP is Auckland Council’s 10-year budget and work programme, which sets out the funding and implementation of strategic priorities to deliver on the Auckland Plan. The LTP will include council’s proposed levels of service and activities and their costs; financial information, policies and fees; local board information and agreements; and council’s infrastructure strategy.

12.     The 2021-2031 LTP includes provision to fund the proposed activities of the reserves board as per the reserves board 10-year budget shown in Attachment A.

13.     Between now and November there is opportunity to discuss and workshop the reserves board 10-year budget to ensure there is an appropriate mix of operating and capital expenditure to achieve the vision as outlined in the Combined Visual Framework and as is reasonable to achieve over this 10-year window.  This can then be submitted to council for funding consideration. 

14.     The timeframe and proposed process for the development of Auckland Council’s LTP 2024-2034 has not yet been finalised.  


 

 

15.     Based on previous processes the following indicative timeframe is foreshadowed:

·        Mayoral proposal – early in the new financial year (post 1 July 2023)

·        Draft LTP to be approved by reserves board – before 30 November 2023

·        Decision making meetings by Auckland Council and Ngāti Whātua Ōrākei Reserves Board– Early 2024

·        Adoption of LTP– June 2024.

Recommendation/s

That the Ngāti Whātua Ōrākei Reserves Board:

a)      delegate authority to the Chair and Deputy Chair to sign the letter of representation for external auditor Moore Markhams for the year ending 30 June 2022 (Attachment A)

b)      delegate authority to the Chair and Deputy Chair to sign the audited financial performance report for the year ending 30 June 2022 (Attachment B) and the subsequent events declaration form (Attachment C)

c)      note the draft audit report (Attachment D)

d)      approve the distribution of a copy of the audited financial performance report to the Ngāti Whātua Ōrākei Trust as the trustee of the reserves board and to Auckland Council.

 

Audit of annual financial performance

2.       The financial statements of Ngāti Whātua Ōrākei Reserves Board (reserves board) are the responsibility of the reserves board.  The reserves board members are made up of equal representation from Ngāti Whātua Ōrākei and Auckland Council.  In this regard, the reserves board is responsible for:

·   ensuring that it keeps accounting records which at any time disclose with reasonable accuracy the financial position of its operations

·   establishing and maintaining an internal control structure

·   preparing financial statements which present fairly, in all material respects, the reserves board’s financial position and performance

·   ensuring the reserves board complies with laws and regulations applicable to its activities and safeguarding of its assets

·   the audit of performance report does not relieve the reserves board of these responsibilities.

3.       In accordance with the Ngāti Whātua Ōrākei Claims Settlement Act 2012, Schedule 4 clause 5(3), the financial accounts for each year must be audited by a chartered accountant.  At the hui on 22 June 2020, the reserves board agreed to engage Moore Markhams as the external auditor for a three year term.

 

 

Scope of audit

4.       The audit opinion provides reasonable assurance to board members that the financial performance reports are free of material misstatements and comply with generally accepted accounting practice in New Zealand. 

The procedures used to form an audit opinion include examination, on a test basis, of evidence supporting the amounts and other disclosures in the financial statements. It also includes evaluation of accounting policies and adequacy of internal control structure to gain an understanding of the accounting system as a basis for the preparation of the financial statements.

Letter of Representation

5.       Attachment A is the letter of representation.

The reserves board is required to sign a letter of representation as a matter of standard audit practice. This letter involves the reserves board making representations to the auditor that the financial statements are materially correct and that the reserves board approved all expenditure incurred on its behalf as reflected in the financial statements.

Annual financial performance report

6.       Attachment B includes annual financial performance report of the reserves board covering the period 1 July 2021 to 30 June 2022.

7.       The annual performance report:

·   reflects the current understanding of the reporting requirements for the reserves board under the Ngāti Whātua Ōrākei Claims Settlement Act 2012

·   meets the generally accepted accounting practice in New Zealand

·   is prepared independently by the Auckland Council’s Financial Control team

8.       It is proposed that the reserves board approve all recommendations and adopt the annual financial performance report for year ended 30 June 2022.

Purpose of the report

1.       To provide Ngāti Whātua Ōrākei Reserves Board (reserves board) an update on financial performance as at 31 March 2023. 

Whakarāpopototanga matua

Executive summary

2.       Net operating expenditure as at end of March was $358k lower than budget, mainly due to timing of some expenses as shown in the finance summary table below.  Funding agreements for nursery staff ($200k) and management support ($150k), Kaitiaki services ($100k) and Te Matatini ($151k) are currently being drafted for approval by the reserves board.

3.       It should be noted that a payment of $1.0m was made upfront in July 2022 to cover for the maintenance costs for the financial year.

4.       Management plan costs is $76.5k favourable and yet to be invoiced. This budget is expected to be fully used and invoiced by end of the financial year.

5.       Nursery income is not reflected in the numbers yet as management are still working on the legal framework for this stream of income.  There were no events income recorded as at 31 March 2023. 

6.       Capital expenditure is $2.3m underspent and capital work programmes are currently being looked at and being prioritised.
