Purpose of the report

1.       For the Aotea / Great Barrier Local Board to acknowledge Jono Ridler for completing more than 33 hours of non-stop unassisted open water swim from Karaka Bay, Aotea Great Barrier Island to Campbells Bay, Tāmaki Makaurau for Swim4TheGulf.

Standing Order 7.7 provides for deputations. Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

 

“An item that is not on the agenda for a meeting may be dealt with at that meeting if-

(b)        The presiding member explains at the meeting, at a time when it is open to the public,-

 

(i)         The reason why the item is not on the agenda; and

Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:

Okupu Beach Reserve Stream Restoration project grant funding

Purpose of the report

1.       To approve grant funding of $25,000 from the Aotea awa restoration budget line to Envirokiwi to deliver the community led Okupu Beach Reserve Stream Restoration project.

Executive summary

2.       On 28 June 2022 the Aotea / Great Barrier Local Board approved the allocation of $29,000 to the Aotea Awa Restoration Programme (resolution number GBI/2022/69).  The programme was proposed to be made up of two main projects; the Okupu Beach Reserve Stream Restoration project ($25,000) and the ‘Follow the Drop’ project ($4,000)

3.       The Okupu Beach Reserve Stream Restoration project was identified as a possible project within the Aotea Awa Restoration programme at a workshop on 20 September 2022. A multi-year planting plan was prepared by Envirokiwi. The intention was that Healthy Waters staff would deliver the planting project.

4.       Due to future funding uncertainties and staff shortages, the Healthy Waters team can no longer commit to a multi-year planting project.

5.       Staff have identified three options for the local board:

·   Option A – grant the unspent $25,000 funding to Envirokiwi to deliver the Okupu Beach Reserve Stream Restoration Project as a community-led project

·   Option B – return the unspent funding into council savings

·   Option C – reallocate the unspent funding to other projects within the Infrastructure and Environmental Services work programme.

6.       Due to the high value of this project and the capacity of Envirokiwi to do this work, staff recommend Option A  - to grant the $25,000 to Envirokiwi to deliver the Okupu Beach Reserve Stream Restoration Project in FY2023.

7.       If the board approves Option A staff will execute the funding agreement to ensure delivery and payment within this financial year

Context

8.       On 28 June 2022, the Aotea / Great Barrier Local Board approved its 2022/2023 environment work programme including $29,000 towards the Aotea Awa Restoration programme (resolution number GBI/2022/69).

9.       The Aotea Awa Restoration programme aims to improve water quality outcomes through school and community education sessions, citizen science, stream and wetland restoration, and provides grants for riparian planting and fencing projects. The programme was proposed to be made up of two main projects; the Okupu Beach Reserve Stream Restoration project ($25,000) and the ‘Follow the Drop’ project ($4,000).

10.     The ‘Follow the Drop’ project administered via AoteaOra Trust is on track for delivery.

11.     The Okupu Beach Reserve Stream Restoration project was proposed to be a three to five-year project to smother the kikuyu grass that currently occupies the site, and replant with suitable native vegetation. The proposed planting would be designed to create feeding and nesting habitat for pāteke.

12.     Staff approached Envirokiwi to prepare a proposal for restoring riparian vegetation at the western end of Okupu Beach Reserve (Attachment A). The intention was for Healthy Waters to deliver the programme. However due to resourcing constraints they can no longer deliver the programme.

13.     At a workshop on 21 March 2023 with the local board staff presented options for the $25,000 allocated to the Okupu Beach Reserve Stream Restoration project.

Analysis and advice

14.     Staff have identified three options for how the local board can proceed:

·    Option A – grant the unspent $25,000 funding to Envirokiwi to deliver the Okupu Beach Reserve Stream Restoration project as a community-led project.

·    Option B – return the unspent funding into council savings. This would mean no stream restoration work would be done this financial year.

·    Option C – reallocate unspent funding to other projects within the Infrastructure and Environmental Services work programme. Note that it may not be possible to reallocate all the unspent funds and anything remaining would go into savings.

15.     Staff have analysed the three options against four main criteria as below and using a 3 step scale being x for no value, one tick being some value against the criteria and two being high value.

16.     Based on the analysis above staff recommend that option A is adopted as it delivers on both environmental and local board plan outcomes and can be delivered within the financial year.

17.     At its 21 March 2023 workshop the board indicated support for option A.

18.     Conversations were held with Envirokiwi following local board feedback to investigate possible community delivery of this project. Envirokiwi were open to delivering the project through grant funding and the original proposal was updated (Attachment A). It is envisaged that the local community will be engaged in restoration for education and training with a view to them continuing this project into future years.

19.     Due to the high ecological value of this project and the capacity of Envirokiwi to do this work, staff are recommending option A, to grant the unspent $25,000 to Envirokiwi to deliver the Okupu Beach Reserve Stream Restoration Project.

Climate impact statement

20.     The awa restoration programme supports the reduction and prevention of pollution getting into waterways and receiving environments. It also increases awareness in the community of issues affecting waterways and what they can do to restore and protect them.

21.     The Okupu Beach Reserve Stream Restoration project is a riparian planting plan that seeks to restore freshwater ecosystem services such as flood mitigation, habitat for native biodiversity and carbon sequestration. These services are enhanced when the ecosystems are restored.

22.     Healthy Waters and Envirokiwi have been working alongside Parks and Community Facilities in preparation of the Okupu Beach Reserve Stream Restoration Project.

23.     On 28 June 2022 the Aotea / Great Barrier Local Board approved the allocation of $29,000 to the Aotea Awa Restoration Programme (resolution number GBI/2022/69). In subsequent workshops the local board indicated support for investigations into the Okupu Beach Reserve Stream Restoration Project.

24.     The Okupu Beach care group have indicated a desire to assist in the delivery of this project. Envirokiwi will be working with them closely with a view to community groups continuing this project into future years.

Māori impact statement

25.     Ngāti Rehua Ngātiwai ki Aotea Trust have noted that the return and restoration of wetlands is a priority in their Hapū Management Plan 2016. They have stated a desired outcome to see the return of wetlands and put in place restoration programmes in and for those areas.

26.     An approach has been made to gauge the interest of iwi in this project and to partner with them if they have an interest.

Financial implications

27.     The $25,000 is LDI opex and under the council’s financial rules cannot be carried forward. If it is not spent before the end of the financial year and does not reach the exceptions criteria for carry forwards, it will be offered up as savings to the council group.

28.     The grant funding of $25,000 to Envirokiwi to deliver the Okupu Beach Reserve Stream Restoration project is within the Aotea Awa Restoration programme budget. Grant management can be provided within existing regional resources.

29.     Following discussions with the proposed delivery agent staff are confident that this project can be delivered within the financial year and that Envirokiwi who have the capacity to complete this project.  Envirokiwi have a plan and a proven track record and have the community capacity to complete this project.

30.     Given the budget constraints indicated in the Draft Annual Budget Plan 2023/2024, it is likely funding for stream restoration activation will be limited or unavailable within the board’s locally driven initiatives budget next financial year.

31.     Staff note that the Governing Body resolved on 23 February 2023 to encourage the Chief Executive, local boards and council-controlled organisations to closely scrutinise and manage any spending and, where possible, consider stopping or limiting new discretionary spending (resolution GB/2023/10). Option B asks the local board to consider offering these funds up as savings. However, feedback provided by the local board in workshops on this topic noted a preference to continue with this environmental investment.

Risks and mitigations

32.     There is a risk that the project will not be delivered before the end of the financial year. However, this is a low risk as Envirokiwi have a project plan in place and are ready to commence work immediately and council staff are prepared to enact the grant process swiftly.

33.     There is a risk that as the project has no guaranteed funding for future years and that the overall goals may not be achieved without direct funding. However, the project will involve community groups who are already engaged and committed to the work involved in this project.  Education and engagement are a part of the initial stages of this project so the risk of this project not being seen through to future years is mitigated by encouraging local groups and the community to get involved. Future funding could come from other interested sources, not only local board funding.

34.     If the board approves option A, then staff will draw up a grant funding agreement with Envirokiwi to deliver the planting project and provide regular updates for the board on delivery.

Auckland Council’s Quarterly Performance Report: Aotea / Great Barrier Local Board for quarter three 2022/2023

Purpose of the report

1.       To provide the Aotea / Great Barrier Local Board with an integrated quarterly performance report for quarter three, 1 January – 31 March 2023.

2.       This report includes financial performance, progress against work programmes, key challenges the board should be aware of and any risks to delivery against the 2022/2023 work programme.

3.       The work programme is produced annually and aligns with Aotea / Great Barrier Local Board Plan outcomes.

4.       The key activity updates from this quarter are:

i     Okiwi ecology programme (SP ID#580) continued a range of projects including trialling a new endoscope and app with three kākāriki nests containing eggs and the capture of three mature Asian Paddle crab.

ii    Food resilience and sustainability (SP ID#1504) established the regular Growers and Makers' market days at the Claris Conference Centre. A total of six have now been held and the plan is to have them monthly going forward.

iii    Aotea Great Barrier - design and install pou (SP ID#32033) conducted a site visit with Iwi to identify sites for installing pou whenua. An additional site visit is organised in April with the Kaumatua group to identify priority sites.

5.       All operating departments with agreed work programmes have provided a quarterly update against their work programme delivery (Attachment A). Activities are reported with a status of green (on track), amber (some risk or issues, which are being managed), grey (cancelled, deferred or merged) or red (significant issues). All activities this quarter are reported as green except for five activities which are reported as amber:

i      Iwi responsiveness – respond to Māori aspirations Ngāti Rehua Ngātiwai ki Aotea coordinator (SP ID#137)

ii     Aotea ecology vision (SP ID#566)

iii     An Area Plan for Aotea Great Barrier (SP ID#1289)

iv    Aotea / Great Barrier accessways and linkages plan (SP ID#2993)

v     Local Māori responsiveness (SP #3541)

6.       Overall operating results for the nine months of the year is ten per cent below the budget due to lower operating expenditure. Revenue is above budget by $2,000. In Locally Driven Initiatives, expenditure is nine per cent below budget. Capital expenditure delivery is below budget by 74 per cent. Actual expenditure is focused on the local asset renewals programme.

10.     The graph below shows the stage of the activities in each departments’ work programmes. The number of activity lines differ by department as approved in the local board work programmes.

Key activity updates from quarter three

11.     The following are key activity highlights in the delivery of Aotea / Great Barrier Local Board’s 2022/2023 work programme for reporting period quarter three, 1 January – 31 March 2023:

i     Okiwi ecology programme (SP ID#580) - The Ecology Vision facilitator visited Okiwi Park with kākāriki expert Luis Ortiz-Catedral from the World Parrot Trust. A new endoscope and app was trialled with three kākāriki nests containing eggs; ongoing monitoring of images will continue. The Asian paddle crab trapping project continued with capture of three mature crabs, leading to meetings with Council biosecurity and marine teams for advice and development of public signage.

ii    Food resilience and sustainability (SP ID#1504) - A highlight was the establishment of regular Growers and Makers' market days at the Claris Conference Centre. A total of six have now been held and the plan is to have them monthly going forward - on the first Saturday of every month. They are generally well attended by both stall holders and punters. 

iii    Aotea Great Barrier - design and install pou (SP ID#32033) - Site visit has been conducted with iwi to identify sites for installing pou whenua. Additional site visit is organised in April with the Kaumatua group to identify priority sites.

Activities with significant and moderate issues

12.     There are five work programme activities with a status of amber (some risk or issues, which are being managed) for the reporting period quarter three, 1 January – 31 March 2023:

i      Iwi responsiveness – respond to Māori aspirations: Ngāti Rehua Ngātiwai ki Aotea coordinator (SP ID#137) role has been discontinued and the remaining budget will be allocated towards a Ngāti Rehua Ngātiwai ki Aotea Trust project.

ii     Local Māori responsiveness (SP #3541) aligns with the iwi responsiveness project line and with the role being discontinued the budget will be allocated towards a Ngāti Rehua Ngātiwai ki Aotea project.   

iii     Aotea / Great Barrier accessways and linkages plan (SP ID #2993) is on hold as consultation with mana whenua is progressed on the pou installation project.

iv     An Area Plan for Aotea Great Barrier (SP ID #1289) Project is on hold awaiting consultation with new elected members and mana whenua.

v     Aotea ecology vision (SP ID#566) had a delayed procurement process. Contract was successfully awarded this quarter and the new Ecology Vision facilitator invited community conservation groups and marae to meet and learn about and support projects.

Climate impact statement

13.     Receiving performance monitoring reports will not result in any identifiable changes to greenhouse gas emissions.

14.     Work programmes were approved in June 2022 and delivery is already underway. Should significant changes to any projects be required, climate impacts will be assessed as part of the relevant reporting requirements.

15.     The local board is currently investing in a number of sustainability projects, which aim to build awareness around individual carbon emissions, and changing behaviour at a local level. Some key updates from this quarter include:

i         Construction Waste Leadership Project (SP ID #3030) - Anamata Construction & Demolition website pages are now live https://anamata.nz/c-and-d/ and being promoted to the builders working on the island. Work was undertaken this quarter to provide alternative disposal options on the mainland for recycling construction and demolition. Rates and process is now confirmed to trial disposal at Green Gorilla sorting facility for both mixed treated timber, plasterboard and rubble.

ii        Aotea awa restoration programme (SP ID #517) - Due to funding cuts and staff shortages the golf course project has not been able to be investigated. The Okupu Beach Reserve Restoration project could not go ahead as it was dependent on three to five years of funding. From discussion with the board and Envirokiwi, a reduced value project is now being scoped with greater input from community and run by Envirokiwi.

iii       Wai resilience (SP ID#3440) - The Healthy Waters team have found an alternative supplier (Conservation Volunteers New Zealand) to deliver a programme of one day Awa Education for each of the schools, subject to board approval and school uptake. The follow the drop alternative personnel has fallen through, Aotea Ora may not be able to deliver this programme however discussions continue to try to find a solution.

16.     When developing the work programmes council group impacts and views are presented to the local board. As this is an information only report there are no further impacts identified.

17.     This report informs the Aotea / Great Barrier Local Board of the performance for quarter three ending 31 March 2023.

Māori impact statement

18.     The 2022/2023 work programme supports the Aotea / Great Barrier Local Board Plan 2020 outcome ‘Ko te tino hia hia ki a manawaroa to tatou motu / Our island is resilient’. One of the plan’s main objectives is that mana whenua will prosper.

19.     Auckland Council have been actively engaging with mana whenua on several regional and local projects. Some key updates from this quarter include:

i     Ngāti Rehua Ngātiwai ki Aotea Trust - Visitor Information Centre (SP ID #3455) - The Trust have written a strategic plan for the Visitor Information Centre focusing on Māori heritage and an upgrade to the site. Funding is being sought by the Trust to make changes to the site.

ii    Tryphena Coastal Trail directional signage (SP ID #22285) – There has been encouraging progress with mana whenua on the list of locations including Māori place name interpretation. Next steps are to present a final list of locations to Kaumatua for signing off for the April 2023 Hui and proceed to production.

iii    Māori Responsiveness: Community Te Reo course (SP ID#123) - The Trust has broken up the funding into two parts. $5,000 to run community Te Reo sessions and $5,000 to provide kapa haka and te reo teaching while at the Aotea Learning Hub. The community Te Reo classes are due to commence in Term 3.

20.     This report is provided to enable the Aotea / Great Barrier Local Board to monitor the organisation’s progress and performance in delivering the 2022/2023 work programme.

22.     Revenue of $2,000 is currently above the budget. This is from the library and local community leases.

23.     Expenditure is below the budget by $176,000 overall. In asset-based services, the budget is lower by $123,000. Higher allocation of capital grant offsets lower maintenance costs on parks and open spaces.

Risks and mitigations

26.     While the risk of non-delivery of the entire work programme is rare, the likelihood for risk relating to individual activities does vary. Capital projects for instance, are susceptible to more risk as on-time and on-budget delivery is dependent on weather conditions, approvals (e.g. building consents) and is susceptible to market conditions.

27.     The approved Customer and Community Services capex work programme include projects identified as part of the Risk Adjusted Programme (RAP).  These are projects that the Community Facilities delivery team will progress, if possible, in advance of the programmed delivery year. This flexibility in delivery timing will help to achieve 100 per cent financial delivery for the financial year if projects intended for delivery in the current financial year are delayed due to unforeseen circumstances.

Urgent decision under delegated authority - Aotea / Great Barrier Local Board feedback on Land Transport Management (Regulation of Public Transport) Amendment Bill

1.       To ratify an urgent decision made by the Aotea / Great Barrier Local Board to provide feedback for inclusion in Auckland Council’s submission on the Land Transport Management (Regulation of Public Transport) Amendment Bill.

Executive summary

2.       The Land Transport Management (Regulation of Public Transport) Amendment Bill establishes the Sustainable Public Transport Framework (SPTF), which will replace the Public Transport Operating Model. The SPTF is a new framework for the planning, procurement, and delivery of public transport services, which addresses systemic issues affecting the sector. Legislative changes are also necessary to remove barriers to decarbonisation, and to clarify and improve the regulation and administration of some public transport services.

3.       As summarised in the Bill’s explanatory note, the key changes are:

·        New objectives for planning, procurement, and delivery of services.

o   ‘The SPTF is underpinned by new objectives prioritising mode-shift, fair and equitable treatment of employees, and improved environment and health outcomes.’

·        Enabling regional councils to operate public transport services.

o   ‘The Bill enables regional councils to operate public transport services in-house or to continue to outsource the operation of services.’

·        Enabling different asset ownership arrangements.

o   ‘The Bill removes the requirement for a local authority’s interests in public transport services to be held in a council-controlled trading organisation.’

·        Supporting benchmarking of different service delivery models.

o   ‘The Bill establishes a new requirement for public transport services to be planned, procured, and operated in an open and transparent manner.’

·        Encouraging greater collaboration between regional councils and territorial authorities.

o   ‘The Bill establishes a requirement for regional councils and territorial authorities to prepare regional public transport plans (RPTPs) in collaboration.’

·        Improving framework for exempt services.

o   ‘The Bill makes several changes to the framework for exempt services, including increasing the minimum notice period to withdraw exempt services that have been identified as integral… [and] amending the criteria to add or remove an exemption to better align with the SPTF objectives.’

·        Clarifying treatment of on-demand public transport services.

o   ‘The Bill expands the definition of public transport to include unscheduled (on-demand) public transport services and shuttle services.’

4.       Note that some of these provisions will not directly impact Auckland due to its status as a unitary authority and its unique governance structure. Further assessment of the Bill’s implications for Auckland will be undertaken as part of the preparation of a submission.

5.       More information on the Land Transport Management (Regulation of Public Transport) Amendment Bill can be found here.

6.       Local boards were given the opportunity to provide feedback on Land Transport Management (Regulation of Public Transport) Amendment Bill. The consultation closed on 28 April 2023 and formal feedback from local boards needed to be received by 26 April 2023 in order to be appended to the council’s submission.

7.       The Aotea / Great Barrier Local Board submitted its feedback on Wednesday 26 April 2023, referred to as Attachment A to the report.

3.       The Hōtaka Kaupapa / governance forward work calendars aim to support local boards’ governance role by:

2.       Under section 12.1 of the current Standing Orders of the Aotea / Great Barrier Local Board, workshops convened by the local board shall be closed to the public. 3.       The purpose of the local board’s workshops is for the provision of information and local board members discussion.  No resolutions or formal decisions are made during the local board’s workshops.
