8 Ngā Tono Whakaaturanga | Deputations
Standing Order 7.7 provides for deputations. Those applying for deputations are required to give seven working days notice of subject matter and applications are approved by the Chairperson of the Waiheke Local Board. This means that details relating to deputations can be included in the published agenda. Total speaking time per deputation is ten minutes or as resolved by the meeting.

10 Ngā Pakihi Autaia | Extraordinary Business
Section 46A(7) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
“An item that is not on the agenda for a meeting may be dealt with at that meeting if-
(a) The local authority by resolution so decides; and
(b) The presiding member explains at the meeting, at a time when it is open to the public,-
(i) The reason why the item is not on the agenda; and
(ii) The reason why the discussion of the item cannot be delayed until a subsequent meeting.”
Section 46A(7A) of the Local Government Official Information and Meetings Act 1987 (as amended) states:
“Where an item is not on the agenda for a meeting,-
(a) That item may be discussed at that meeting if-
(i) That item is a minor matter relating to the general business of the local authority; and
(ii) the presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but
(b) no resolution, decision or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion.”

Staff advice relating to the raising of the Palestinian flag

Purpose of the report
1. To receive staff advice in response to resolution WHK/2023/165 relating to the raising of the Palestinian flag from the Waiheke Local Board office (Attachment A).
2. To note community correspondence the Waiheke Local Board received and sent in response to resolution WHK/2023/165 (Attachment B).
3. To provide opportunity for the Waiheke Local Board to revisit its resolution considering staff advice.

Executive summary
4. At its business meeting on Wednesday 29 November 2023, the Waiheke Local Board resolved to:
a) support the community request for a call for an immediate and permanent ceasefire in Palestine.
b) call on the Government of New Zealand to call for an immediate and permanent ceasefire in Palestine.
c) fly the Palestinian flag from the Waiheke Local Board offices as of today, 29 November 2023 International Day of Solidarity for the Palestinian People, until one month from today.
5. The Palestinian flag has not been risen at the Auckland Council offices on Waiheke Island pending staff advice.
6. A preliminary set of risks and potential impacts of implementing the resolution have been identified for members to consider (Attachment A).
7. Correspondence has also been received from members of the community who have views that differ from the decision (Attachment B).

Purpose of the report
1. To endorse two appointees to the Advisory Committee of the Kennedy Point Marina Maritime Trust.

Executive summary
2. In September 2021 the Waiheke Local Board were invited by Kennedy Point Boatharbour Limited to provide their feedback to the Kennedy Point Marina Maritime Trust Fund charter (Attachment A).
3. The fund will be administered by the Auckland Foundation and the Advisory Committee will comprise of three members. One will be appointed by Kennedy Point Boatharbour Limited and two members appointed by the Chair of the Waiheke Local Board.
4. In line with the charter, appointees should be residents of Waiheke Island with local maritime associations and experience.
5. The local board Chair requested board members put forward possible candidates who aligned with the charter criteria. These names and maritime experience were forwarded to Kennedy Point Boatharbour Limited and Auckland Foundation representatives to assess criteria and liaise with possible nominees. (Attachment B – under confidential cover).
6. As per the charter, the Chair has authority to appoint the two Advisory Committee members, however members have requested a formal report be presented to the board for endorsement.
7. Appointment to the Advisory Committee will be subject to nominated appointees:
· being approved by the Foundation; and
· confirming to the Settlor that they have read this Charter, acknowledged its terms, and agreed to be bound by its provisions while they are a member of the Advisory Committee.
Recommendation
That the Waiheke Local Board:
a) whakaae / endorse two appointees to the Advisory Committee of the Kennedy Point Marina Maritime Trust in line with the Trust Charter.
