Decision to remove or retain the trees on Anne Street, Devonport

 

Resolution number DT/2024/20

MOVED by Chairperson T van Tonder, seconded by Member M Powell:  

That the Devonport-Takapuna Local Board:

a)         note the concerns raised by Anne Street residents regarding flooding in this location.

b)        note that staff recommend retaining the two Anne Street trees as they: contribute to canopy cover, they are rare specimens, and that removal will not rectify the flooding in Anne Street as the street sits in a flood zone.

c)         note that healthy waters has identified Anne street as a priority location for stormwater improvements to address the flooding and that this project may require the removal of the two mallet flower trees that are of concern to residents.

d)        note that this stormwater project will be better understood in July once investigations and design has been completed.

e)         note that it is not advised to remove the two Anne Street trees to be replaced with two natives in the case that these will need to be removed later as part of the stormwater project.

f)          note that the four existing catchpits on Anne Street have been placed on a ‘hot spot’ register and that cleaning of the grills takes place on a monthly basis.

g)        note that Restoring Takuranga Hauraki have generously offered to work with Anne Street residents and their ecological volunteers to undertake weekly catchpit clearing.

h)        agree to retain the two trees on Anne Street and to review this decision once Healthy Waters reports back on the extent of the stormwater project and the impact the trees are having on flooding on Anne Street.

Proposed new community ground lease for Ngataringa Tennis Club Incorporated at Stanley Bay Park, Stanley Point

 

Resolution number DT/2024/24

That the Devonport-Takapuna Local Board:

a)         note the local board’s concern that this site is exposed to the impacts of climate change and sea level rise and request the lessee does all things practicable to manage and mitigate that risk.

b)        tuku / grant, under section 54(1)(b) of the Reserves Act 1977 and section 138 of the Local Government Act 2002, a new community ground lease for Ngataringa Tennis Club Incorporated for approximately 2,825 square metres (more or less) located at Stanley Bay Park, R 166 Calliope Road, Stanley Point on the land legally described as Part Harbour Bed Deposited Plan 15479, comprised in record of title NA353/180 and Part Lot 159 Allotment 31 Section 2 Parish of Takapuna, comprised in record of title NA566/80 (as per Figure 1 and Attachment A – Site Plan), subject to the following terms and conditions:

i)          term – 10 years commencing 19 March 2024, with one (1) 10-year right of renewal commencing 19 March 2034, effecting final expiry on 18 March 2044

ii)         rent – $1.00 plus goods and services tax per annum if demanded

iii)       rent review – two (2) years, on the second anniversary of the commencement date, and thereafter every five (5) years.

iv)       community outcomes plan – to be appended to the lease as a schedule of the lease agreement (as per Attachment B – Community Outcomes Plan).

c)         whakaae / approve all other terms and conditions in accordance with the Auckland Council Community Occupancy Guidelines 2012 (Updated July 2023) and the Auckland Council standard form community lease agreement.

Representation review and local board reorganisation

 

Resolution number DT/2024/25

MOVED by Chairperson T van Tonder, seconded by Member G Wood:  

That the Devonport-Takapuna Local Board:

a)         provides the following feedback on representation review:

i)          note that the Devonport – Takapuna Local Board has previously expressed an interest in a more suitable Board name that is inclusive of residents North of Takapuna.

ii)         agrees that given the potential for reorganisation, now is not the time to pursue this opportunity. 

iii)       supports a minor boundary change to include the whole of Saunders Reserve in the Upper Harbour Local Board area.

b)        provides the following feedback on the reorganisation proposal:

i)          Does not support the reorganisation proposal in its current form and makes the following comments:

A)        expresses concern that no detailed case for change has been developed and elected members are not properly informed to make a decision of such significance.

B)        notes that residents in the Devonport-Takapuna Local Board area are highly engaged in local matters with one of the city’s highest voter turnouts; diluting local voice may result in disengagement or a corrosion of trust.

C)        expresses concern that the establishment of a larger Board covering both Kaipātiki Local Board and Devonport-Takapuna places a greater distance between elected members and residents.

D)        expresses concern that a Devonport-Takapuna subdivision of any new ‘North Shore Board’ would have a minority of elected members and will become a minority voice at the decision-making table. There would be no possibility of a local Chair with the benefit of a casting vote. 

E)        considers that the communities of interest for the Devonport-Takapuna Local Board go north along the coastline, rather than West to Kaipātiki and recommends work be conducted exploring the movements of residents and asset utilisation.

F)        considers that the current proposal to reduce Local Boards from 21 to 15 is not adequately developed, and that simply merging boards under Wards is a rudimentary tool for creating change without any consideration for other possibilities or unintended impacts.

G)       notes that the 15 Local Board proposal excludes any changes made to both Waiheke Local Board and Aotea/Great Barrier which both have 5 members for a population of 7300 and 1000 respectively. The Devonport-Takapuna Local Board currently has 6 elected members representing 60,000 residents, and questions why they remain untouched in this proposal.

H)        do not support a proposal to increase all local board roles to full time positions. This will lead to a decrease in diversity of representation, noting fewer people would be in a position to stand for the more demanding role and the candidate pool would be reduced in favour of those who have already retired and those with specific political ambitions.

I)          recommend that a proper inquiry into the form and function of Auckland Council, including the model proposed by the royal commission, be funded and that there is meaningful Local Board and Public consultation with recommended changes executed prior to the 2028 local election.

Representation project – issues specific to Devonport-Takapuna Local Board

That the Devonport-Takapuna Local Board:

a)      support the proposal to align the local board boundary with the boundary to Saunders Reserve and note that this requires adjustment to a meshblock.

Proposals for More Empowered Local Boards

 

Resolution number DT/2024/27

MOVED by Deputy Chairperson T Harpur, seconded by Chairperson T van Tonder:  

That the Devonport-Takapuna Local Board:

a)         strongly supports the recommendations for more empowered local boards in the report, including:

i)          Local boards receiving sufficient strategic advice to be able to fulfil their purpose on behalf of their community, as outlined in section 15, a) to e) in the report.

ii)         Local boards should receive sufficient resourcing and have greater decision-making and accountability over their funding arrangements, as outlined in section 16, a) to b) and 17, a) to i)) 

 

b)        supports greater governance delegation and empowerment of local boards in relation to CCO operations within the local board area. Currently there is no direct local governance on Auckland Transport, Watercare, Auckland Unlimited or Eke Panuku operations within local boards and this is contrary to what residents expect or presume.

 

c)         does not support the reduction in number of local boards as outlined in item 15 above, from 21 to 15.  Notes there are significantly better ways of achieving efficiencies and better governance in Auckland Council, including and not limited to: review of the Governing Body, CCO model and funding allocations between areas of the city.

 

d)        supports staff exploring more efficient ways of working to avoid duplication of information across boards, including more group video conference meetings and cluster meetings.

Local board feedback on freshwater management in Tāmaki Makaurau / Auckland

 

Resolution number DT/2024/28

MOVED by Chairperson T van Tonder, seconded by Member P Allen:  

That the Devonport-Takapuna Local Board:

a)         notes that the government has moved the RMA deadline for the plan change on Fresh Water Management from 31 December 2024 to December 2027.

b)        support the proposed vision and hierarchy of obligations proposed for Tamaki Makaurau -Auckland; first the health and wellbeing of waterbodies and freshwater management, second the health needs of people (drinking water) and thirdly the ability for people and their communities to provide for their social, cultural and economic wellbeing now and in the future.

c)         support the Fresh Water Management Units that places Lake Pupuke in the Hauraki FMU.

d)        support the inclusion of ‘resilience’ in freshwater values in the AUP.

e)         support the setting of targets to improve the health of Auckland’s freshwater bodies.

f)          support the inclusion of temperature as an attribute in the plan change.

g)        request work be conducted that addresses and mitigates wastewater contamination in freshwater bodies, as well as sedimentation and pollutants that flow from stormwater drains.

h)        note only 8 individuals and no groups gave feedback from the Devonport-Takapuna Local Board.

Local board input to Auckland Council Submission on the draft Government Policy Statement on Land Transport 2024-2034

 

Resolution number DT/2024/29

MOVED by Chairperson T van Tonder, seconded by Deputy Chairperson T Harpur:  

That the Devonport-Takapuna Local Board:

a)         confirm, as written in the Local Board Plan, “we want our transport network to be connected, multimodal, safe, and efficient”. As such, the Local Board provides the following views on the Government Policy Statement on Land Transport;       

i)          Support the commitment to doubling renewable energy through the Electrify NZ policy by removing red tape and regulatory constraints.

ii)         Support the delivery of 10,000 public EV chargers by 2030 to support the reduction of emissions and the electrification of NZ’s vehicle fleet.

iii)       Does not support any decreases in public transport funding, and notes that the draft GPS 2024 proposes a reduction in funding for both the Public Transport Infrastructure and Public Transport Services activity classes compared to what is set out in the GPS 2021 for the same time period. The local board is of the firm belief that a city the scale of Auckland needs to supercharge investment and delivery in public transport to provide affordable transport choices and improve access for all.

iv)       Support fast-tracking of consents for major infrastructure projects to enable a less expensive and faster pathway to delivery; request that a gendered lens be placed on transport infrastructure projects to ensure jobs created are shared across the gender divide.

v)         Support the enabling and expediating of time-of-use charging on the most congested parts of NZ’s road network.

vi)       Support the proposed amendment to the Land Transport Management Act to require future Government Policy Statements on land transport to adopt a 10-year investment plan, but request that a bipartisan approach be taken to future GPS Land Transport to ensure continuity.

vii)      Do not support that Lake Road be funded through the remaining Regional Fuel Tax, and request that an alternative allocation be provided through the National Land Transport Fund, as it has become clear that what remains of the RFT is not adequate to deliver this important local upgrade.

viii)     Request the inclusion of the Frances-Esmonde Greenways link as a priority local project, noting this will provide transport options for the Devonport Peninsula, support mode shift, and support the reduction of congestion on Lake Road.

ix)       Supports work to deliver additional Waitematā Harbour connections and recommends that a multi-modal project is delivered to bring opportunity and benefit to the residents of the North Shore, as well as to provide resiliency in our cross-harbour transport network.

x)         Do not support that investment in walking and cycling should only take place where there is a clear benefit for increasing economic growth and productivity; noting a policy stance such as this is detrimental to the accessibility, safety and wellbeing of children and young adults, as well as our older and more vulnerable residents. Preventing these people from getting to where they need to go unless there’s an economic reason for them to go there, is not ethical. We note that less than 40% of those between 16 and 24 years of age have a full drivers’ licence. These are the people who will be most impacted by this investment criteria.

xi)       Support increased road maintenance funding and request this be extended to increased footpath maintenance funding; noting a considerable number of people are getting badly injured tripping on poorly maintained and narrow footpaths.

xii)      Support the work proposed on reducing expenditure on temporary traffic management which adds undue expense to roading projects, and is making it cost prohibitive for communities to deliver events and activations that support local economic development and community building.

xiii)     Support the Value for Money strategic priority to support prioritisation of intervention options. 

xiv)     Support the emphasis on DSI created by alcohol and drug influenced-driving, and request investment is made in reducing the availability of both alcohol and drugs particularly in vulnerable communities.

xv)      Request inclusion of speed detection and monitoring by the appropriate authorities to reduce DSI.

xvi)     Recommends that Auckland receives an adequate share of transport funding and that the government works collaboratively with Auckland Council to set the prioritisation for investment in the region.
