Annual Budget 2025/2026 - local board consultation content

That the Maungakiekie-Tāmaki Local Board:

a)      whakaae / approve local consultation document content (Attachment A) and local supporting information content (Attachment B) for inclusion in the Annual Plan 2025/2026 consultation material.

b)      tautapa / delegate authority to the local board Chair to approve any changes required to finalise the local consultation document and supporting information content for the Maungakiekie-Tāmaki Local Board for the Annual Plan 2025/2026. 

c)      whakaae / approve the following Have Your Say event in the local board area during the Annual Plan 2025/2026 consultation period:

i)       Drop-in session at Onehunga Bay Festival, Saturday, 1 March, from 11.00am – 3.00pm

d)      tautapa / delegate authority to the local board Chair to approve any changes required to the Have Your Say event.

e)      tautapa / delegate to the following elected members and staff the power and responsibility to hear from the public through “spoken (or New Zealand sign language) interaction” in relation to the local board agreement at the council’s public engagement events during the consultation period for the Annual Plan 2025/2026:

i)       local board members and Chair

ii)      General Manager Governance and Engagement, Local Area Manager, Local Board Senior Advisor, Local Board Advisor, Local Board Engagement Advisor.

iii)     any additional staff approved by the General Manager Governance and Engagement or the Group Chief Financial Officer.

Proposed policy refresh: Business Improvement District (BID) Policy (2022)

That the Maungakiekie-Tāmaki Local Board:

a)         tūtohi / receive the report and information regarding the proposed refresh of the BID Policy (2022) and agree to provide formal feedback on the changes proposed.

b)         support in principle for the following updates to the BID Policy (2022):

i)        Clarification of Minimum Requirements: Define the essential criteria for Business Improvement Districts (BIDs).

ii)      Issue Resolution Mechanism: Introduce provisions for resolving issues and the potential termination of funding agreements if BIDs fail to comply with the policy.

iii)     Transparency in Reporting: Implement a requirement for BIDs to report unallocated funds (whether spent or saved) in the annual report, ensuring clarity and transparency for all stakeholders.

iv)     Policy Alignment with BID Targeted Rate: Update the policy to reflect a three-year BID targeted rate cycle.

c)         recommend a regular business member engagement survey so that the local boards and business improvement districts can track business members feedback.

Proposed new community lease to One Tree Hill Community Kindergarten Incorporated, at Massey Reserve, 21 Massey Avenue, Greenlane

That the Maungakiekie-Tāmaki Local Board:

a)      grant, a new community lease to the One Tree Hill Community Kindergarten Incorporated for an area comprising approximately 1092.3m² located at Massey Reserve, 21-27 Massey Avenue, Greenlane, on the land legally described as Lot 108 Deposited Plan 20155 (or Allotment 17A Section 12 Suburbs of Auckland and defined on Deposited Plan 18700) record of title NA425/293 and is held by Auckland Council as a classified local purpose (site for a kindergarten) reserve subject to the provisions of the Reserves Act, and subject to the following terms and conditions:

b)      term – 10 years, commencing on the date of the board resolution with one 10-year right of renewal.

c)      rent – $1300 plus GST per annum.

d)      community Outcomes Plan - to be appended to the lease as a schedule of the lease agreement.

e)      approve all other terms and conditions in accordance with the Reserves Act 1977 and the Auckland Council Community Occupancy Guidelines (updated 2023).

f)       note that iwi engagement has been completed with a deadline of 3 December 2024 with no submissions or objections received.

Auckland Council's Performance Report: Maungakiekie-Tāmaki Local Board for quarter one 2024/2025

That the Maungakiekie-Tāmaki Local Board:

a)      receive the performance report for quarter one ending 30 September 2024

b)      note that the Customer and Community Services Capex work programme been updated to reflect financial deferrals.

c)      whakaae / approve Young Enterprise Scheme (MT) (Activity ID 3942) and associated budget of $3,000 into the 2024/2025 work programme from unallocated locally driven initiatives (LDI) operational budget.

d)      whakaae / approve the addition of the Tāmaki Path to tranche 1 of the activity, Te Kete Rukuruku (Maori naming of Parks and Places)

e)      whakaae / approve the following leases to be added to the Maungakiekie-Tāmaki Local Board Work Programme 2024/2025:

i)       ID452 Te Papapa Bowling Club

ii)      ID4520 Shanti Niwas Charitable Trust Inc

f)       tuhi ā-taipitopito / note that to enable added leases the following leases are deferred from the FY 2024/25 Work Programme:

Local board input to Auckland Council’s submission to the Justice Select Committee on the Principles of the Treaty of Waitangi Bill

Resolution number MT/2024/196

MOVED by Chairperson M Meredith, seconded by Member P McGlashan:  

That the Maungakiekie-Tāmaki Local Board:

a)          oppose the Principles of the Treaty of Waitangi Bill in its current form, noting:

                        i)         that members of parliament have indicated that it does not have political support for the second reading

                       ii)         the Bill and its defined principles do not align with the texts or the intent of Te Tiriti o Waitangi or the Treaty of Waitangi.

                     iii)         The Bill lacks Māori engagement in its development, which is a critical oversight in a matter that directly impacts Māori communities.

                     iv)         The timing of the Bill and the short submission period (over the Christmas period and just one week after the New Year) severely limits meaningful engagement and consultation.

                       v)         Te Tiriti and its principles provide a pathway for all New Zealanders to engage in a national conversation and civic education about Te Tiriti o Waitangi, fostering greater public understanding. Any amendments to Te Tiriti or its principles must be made jointly by Māori and the Crown, rather than unilaterally.

b)          note:

                        i)         Te Tiriti o Waitangi (Te Tiriti) is the foundational document of Aotearoa, New Zealand. All civic and political institutions in the country exist because of Te Tiriti.

                       ii)         Parliamentary and Crown sovereignty are shared with Māori under the terms of Te Tiriti o Waitangi. Therefore, a simple majority in Parliament should not have the power to alter the Te Tiriti o Waitangi principles. Such a decision must involve a more thorough and inclusive process.

                     iii)         The Bill undermines existing Treaty principles, which have been developed over nearly 50 years through case law, the work of the Waitangi Tribunal, and the ongoing efforts of Māori and others to gain rights and seek redress for past injustices. The principles established over these decades must be respected, not disregarded.

c)         note, Auckland Council and local boards play an integral role in Aotearoa’s constitutional framework. This is reflected in our policies and strategic documents, which align with statutory obligations and guide our work to support Māori aspirations, including:

 

               i)         Auckland Plan 2050: Te Tiriti o Waitangi forms the foundation of local government efforts in Tāmaki Makaurau to achieve Māori outcomes.

              ii)         Kia ora Tāmaki Makaurau: A key document that guides the delivery of Māori outcomes.

            iii)         Houkūra Independent Māori Statutory Board Statutory Instruments: This includes addressing issues of significance through He Waka Kotuia.

            iv)         Tūpuna Maunga Authority: The statutory body created under the Ngā Mana Whenua o Tāmaki Makaurau Collective Redress Act 2014 to manage the fourteen ancestral mountains of Tāmaki Makaurau / Auckland.
