Purpose of the report

1.       To delegate authority to approve the Auckland Civil Defence Emergency Management Group’s submission on the government discussion document ‘Strengthening New Zealand’s emergency management legislation’ to the Chair and Deputy Chair of the Civil Defence and Emergency Management Committee.

Executive summary

2.       The government has signalled its intentions to replace the Civil Defence Emergency Management Act 2002 with a new piece of legislation.

3.       Reforming emergency management legislation is part of the government’s response to the Government Inquiry into the Response to the North Island Severe Weather Events which reported back to the Minister for Emergency Management and Recovery on 26 March 2024.

4.       From 15 April to 5pm 13 May 2025 the National Emergency Management Agency is inviting submissions on options to strengthen New Zealand’s overarching emergency management legislation. This work is intended to inform the design of a new Emergency Management Bill.

5.       The Minister for Emergency Management and Recovery has stated that they intend to introduce a new Emergency Management Bill in the second half of 2025.

6.       The proposed objectives of the new bill are to:

·    strengthen community and iwi Māori participation in emergency management

·    provide for clear responsibilities and accountabilities at the national, regional, and local levels

·    enable a higher minimum standard of emergency management

·    minimise disruption to essential services

·    ensure agencies have the right powers available when an emergency happens.

7.       The National Emergency Management Agency has released a discussion document Strengthening New Zealand's emergency management legislation that outlines sixteen issues and options for addressing them in the new legislation.

8.       The Auckland Civil Defence and Emergency Management Committee meets quarterly throughout the year with the next meeting scheduled for 17 June 2025. This meeting date is after the submission deadline of 13 May 2025. 

9.       Given the tight timeframe for the submission, staff recommend that the Civil Defence and Emergency Management Committee delegate authority to approve the Auckland Civil Defence Emergency Management Group’s submission on the government discussion document to the Chair and Deputy Chair of the Civil Defence and Emergency Management Committee.

10.     The Auckland Civil Defence Emergency Management Group’s submission will be based on existing adopted Auckland Council and Civil Defence and Emergency Management Committee positions and plans where possible.
